SUBJECT: Draft Municipal Resolution No. 2015-09-118 "Resolution authorizing the proposed borrowing of the
Municipality of Dingras; !locos Norte in the amount of 15 Million Pesos to fund for the acquisition of several heavy
equipment.
FOR: The Hon. Presiding Officer and Honorable Members of the Sangguniang Bayan
The Joint Committee to which the above-subject has been referred has the honor to report back to the
Sangguniang Bayan the foilowing findings and recommendations:
1. That the Municipality of Dingras 1li intended to purchase various heavy equipment for the implementation and
realization of its thrust and programs, thus, the int ention to enter into a loan agreement with any bank or
financial institution;
2. That the MDC-Excom passed Resolution No. 4 series 2015, favorably approving the Supplemental Annual
Investment Plan of the Municipality of Dingras, ilocos Norte for the purchase of heavy equipment in the amount
of P15 Million Pesos;
3. That the Development Bank of the Philippines expressed its intention to accommodate the loan application of
the municipality;
4. That however, there was a previous and existing loan agreement with the Land Bank of the Philippines with the
following provisions, to wit:
Section 12. Negative Provision. For as long as the loan or any other sum or balance that may be due or
outstanding in relation thereto, have not been duly paid and performed , the Borrower shall not,
without the written consent of the Lender, which consent shall not be unreasonably withheld, perform
or allow any of the following:
12.1 Make any loan to, xxxxxxxxx, for any oher company, business or person, except in money
placements of its available funds or in the ordinanry course of business.
5. That in consonance of the above cited provision, there is a need to amend the said resolution;
6. Consistent with the above-findings, the committee recommends for the adoption of the committee report and
further recommends that Draft Municipal Resoplution No. 2015-09-118, as amended, be tackled for 2"d and final
reading on today's session .

1. That the Implementing Rules and Regulations of the Local Government Code
provides that an LGU may reorganize through the Sangguniang its present
organizational structure or alter its present staffing pattern in accordance with
laws pertinent to government reorganization and implementing rules and
regulations;
2. That the position of Administrative Officer Ill (Supply Officer II), SG - 14 is
vacant, and is highly recommended to be reclassified by changing its duties and
functions;
3. That after a committee hearing attended by the Local Finance Committee and
the Administrative Officer, it was found out that the said reclassification/creation
of Plantilla Position of Administrative Officer Ill is recommended for better
delivery of public service;
4. Consistent with the above-findings, the joint committee recommends for the
adoption of the committee report and further recommends that draft ordinance
no. 2015-09-024 be tackled for 2nd reading on today's session.

vacant, and is highly recommended to be reclassified by changing the duties and 25

Norte, particularly at the old municipal plaza and adjacent open spaces on every Fridays
from 5pm to 11pm.
6. The open night market/tiangge shall be open to the public regardless of town or city of
residence.
7. The imposition/~olle~tion pf spa~e fees ami or business ta~, as the case may be, shall be
determined by the office of the municipal treasury in accordance with the provisions of the
Local Revenue Code and the rules and regulations provided specifically for this Ordinance.

to enter into a Contract of lease with the stallholders in the Public Market, Food Court and Civic Center,
Dingras, !locos Norte;

The Joint Committee to which the above-subject has been referred have the honor to report
back to the Sangguniang Bayan the following findings and recommendations:
1. The Local Government Code of 1991 provides that upon authorization of the Sangguniang
Bayan, the Local Chief Executive may represent the municipality in all its business transactions
and sign on its behalf contracts and such other documents made pursuant to law or ordinance;
2. That there is a need to renew the Contract of Lease entered into by the Municipal Government
and the Stallholders in the Public Market, Food Court and Civic Center, as the same expired on
December 31, 2014;
3. That said renewal of Contract of Lease is very important to ensure their continuous operation;
4. That said resolution has been presented to all the members of the Stallholders Association of
Dingras (SHAD};
5. Consistent with the above-findings, the committee recommends for the adoption of the
committee report and further recommends that Draft Municipal Resolution No. 2015-09-006 be
tackled for 2"d and final reading on today's session.

Article I. 17
PRESCRIPTION OF ENTRANCE FEES 18
Section 1. The Municipality of Dingras, llocos Norte shall collect the following fees 19
for every tourists who shall visit the Dona Josefa Llanes Museum, to wit: 20
a. An entrance fee of Twenty Pesos (Php 20.00) for every adult person; and 21
b. An entrance fee of Ten Pesos (Php 10.00) for every minor. Provided that, 22
the minor shall not be more than three (3) feet in height, otherwise the fee in 23
the preceding paragraph shall be applied therewith . 24

Section 1. The Municipal Treasury Office shall be prescribe the guidelines and rules 27
in collecting the entrance fee . Provided that there shall be a record of the entrance 28
fees that were collected. Provided further, that the Municipal Treasury Office shall 29
furnish the Office of the Mayor a copy of record pertaining the amount collected, 30
which shall be submitted every end of a fiscal year. 31
Section 2. The proceeds from the Entrance Fee shall be distributed as follows: 32 '
a. 50% to the Municipal Government of Dingras, llocos Norte; and 33
b . .50% to the Provincial Government of llocos Norte. 34
Section 2. The collection of Entrance Fee may be exempted by the Municipal Mayor 35
in favor of students/pupils who are conducting field trips or educational trips. 36
Provided, that the collection of fees shall be suspended during the celebration of 37
Independence Day, Araw ng Kagitingan, or Escoda Day. 38

Section 1. Any portion of this ordinance which is inconsistent with law or higher 41
authorities is hereby repealed, amended, and modified accordingly and shall not 42

SUBJECT: Draft Municipal Ordinance No. 2015-09-020, An Ordinance Allowing the Use of Birth
Certificates in Schools issued by the Local Civil Registrar of the Municipality of Dingras, !locos
Norte.
FOR: The Hon. Presiding Officer and Honorable Members of the Sangguniang Bayan
The Joint Committee on Rules & Laws and Committee on Education to which the above-
subject has been referred have the honor to report back to the Sangguniang Bayan the
following findings and recommendations:
1. That DepEd requires Grade I enrollees to submit their individual NSO-issued Birth
Certificates as one requirement upon enrollment in order for the school concerned to
secure individual/personal information of would-be enrolled pupils.
2. That the local government of Dingras would like to give relief to parents of upcoming
grade I enrollees from burden and difficulty of unnecessary time and expenses in
securing birth certificates issued at NSO Field Offices by enjoying the issued birth
certificates at the office of the LCR free of charge during last week of February of every
year.
3. That the local government would like to give further relief to parents of upcoming grade I
including kindergarten enrollees of securing the aforementioned document free of
charge through out the year if it is used for the purpose of enrollment.
4. That DepEd has no mandatory order as per existing Department Orders to use birth
certificates issued by NSO specifically for this purpose, hence the use of birth certificates
issued by the Local Civil Registrar of the municipality for the above purpose shall be
allowed and/or admitted and enjoyed.
5. Consistent with the above-findings, the joint committee recommends for the adoption of
the Committee Report and further recommends that the Draft Municipal Ordinance be
treated for 2nd reading on today's session.

2. That the Municipality of Dingras, llocos Norte regularly receiving share from R.A. 7171 and R.A. 8240.
3. That 20% from the share of RA7171 and 50% from the share of RA 8240 will be used directly for farmers
producing tobacco and it will be in form of fertilizer and insecticide assistance;
5. Consistent with the above-findings, the joint committee recommends for the adoption of the committee
report and further recommends that Draft Municipal Ordinance No. 2014-09-015 be tackled for 2nd reading
for today's session.

3. That the site has facilities where young farmers and other farmers' organization conducts their meeting
and sports festival;
4. That it is only but appropriate and justified that the name will be Young Farmers Sports Complex and
Convention Center;
5. Consistent with the above-findings, the committee recommends for the adoption of the committee

SUBJECT: Draft Municipal Ordinance No. 2013-09-009 an ordinance declaring the first Friday of July of
every year as Arbor Day in the municipality and for other purposes.
FOR: The Hon. Presiding Officer and Honorable Members of the Sangguniang Bayan
The Joint Committee on Rules and Laws and Committee on Environment to which the above-
subject has been referred have the honor to report back to the Sangguniang Bayan the following
findings and recommendations:
1. That This ordinance shall be known as the "Arbor Day Ordinance in the Municipality of Dingras,
llocos Norte"
2. It is hereby declared as policy of the Municipality to protect and advance the right of the people
to a balanced and healthful ecology in accord with the rhythm and harmony of nature. Towards
this end, the vital role and importance of trees in ecological stability is recognized. Hence, there
is a need for collaborated effort between the State and its citizenry to combat the loss of our
natural resources and rejuvenate our environment by undertaking nationwide tree planting
activities and providing effective measures for their maintenance and sustainability.
3. That the Arbor Day Celebration shall be done every first Monday of July; provided, that the
Arbor Day (Tree Planting) designated shall be declared as public working holiday in order to
ensure the participation of the different sectors of society.
4. That the Joint Committee presented the ordinance in a public hearing and it was attended by
proper authorities concerned;
5. Consistent with the above-findings, the joint committee recommends for the adoption of the
committee report and further recommends that said ordinance be tackled for 2"d reading on
today's session.

Sectoral STI, HIV and AIDS council and its Technical Working Group: for the
prevention and control of sexually transmitted infection human immunodeficiency
virus (HIV) and acquired immune deficiency syndrome (AIDS). Defining its functions,
providing response, appropriating funds and other related purposes;
2. That there is a need to create working committee for the information and
dissemination of the ill effects of sexually transmitted disease in order to keep our
constituents well informed of these diseases;
3. That the Joint Committee presented the ordinance in a public hearing and it was
attended by authorities concerned;

3. That Dingras Tricycle Operators and Drivers Association made a petition for the increase
of fare.
4. That there is a need to increase tricycle fare taking into account the rising of fuel price
and the cost of living.

3. That Draft Municipal Ordinance 2013-09-005, the same ordinance, has been archived
but again presented to consider some provisions recommended by the Local Chief
Executive.
4. That said ordinance has been presented for public hearing.
5. Consistent with the above-findings, the committee recommends for the approval of
the committee report and further recommends that Draft Municipal Ordinance No.
2013-09-010 be tackled for 2"d reading for today's session.

period limited to the yuletide season starting December 20 until December 31 of each year
for plying trade in regards to the distribution or sale of various kinds of fireworks and
pyrotechnics; and that no other areas in Dingras shall .be used for the same purpose,
providing penalties in violation hereof.
2. That the municipality has to adopt measures in consonance with Memorandum Circular No.
2012-193 and Republic Act 7183 to promote and ensure public safety and to somehow
mitigate the dangers of the improper distribution or sale of various kinds of fireworks and
pyrotechnics.
3. That the Joint Committee presented the ordinance in a public hearing and it was attended
by proper authorities concerned;
4. Consistent with the above-findings, the joint committee recommends for the adoption of the
committee report and further recommends that said ordinance be tackled for 2nd reading on
today's session.

048 which is "Regulating the sale Manufacture, distribution and use of Firecrackers, Polyvinyl Pipe or 11
"BOGA'1 and other Pyrotechnic Devices. 11 12
WHEREAS, every Yu\et ide Season, particularly on New Year's eve has become a part of the Filipino 13
tradition to welcome the new year in full jubilation and with a "big bang" using various kinds of 14
fireworks; 15
WHEREAS, national record showed that there was a large number of fire works related injuries and 16
disastrous events recorded that occurred because of uncontrolled and improper management on the 17
sale, distribution and use of powerful and dangerous fireworks and pyrotechnics; 18
WHEREAS, in the Municipality of Dingras, the yuletide season of each year is an opportunity which 19
dynamic entrepreneurs do not want to go by without taking advantage of the huge profits that is gained .20
in business undertakings, a situation where fireworks of various kinds are sold almost everywhere, 21
anywhere, that can place many things such as public safety in jeopardy; 22
. · WHEREAS, the Municipal Government has to adopt measures based on Memorandum Circular No. 23
2010-0148 and Memorandum Circular No. 2012-193 and as provided under Republic Act 7183, with all 24
noble intentions of promoting and ensuring public safety, and measures that can somehow mitigate 25
the dange·rs of the improper distribution or sale various kinds of fireworks and pyrotechnics, 26
Be It Ordained that: - 27
Section 1. CASTRO STREET FROM ILOCOS NORTE -APAYAO NATIONAL ROAD UP TO VERSOZA STREET 28
IN BARANGAY MADAMBA AS THE FIREWORKS AND PYROTECHNIC ZONE OF THE MUNICIPALITY OF 29

Section 2. PROHIBITION(s}. 34
2. a. No one shall be allowed to ply trade in the area without the proper permit to 35
operate business in the area without the corresponding licence or business permit to 36
operate. 37
2. b. No permanent structures shall be constructed in the designated area. 38

2. c. No one shall exceed more than the space provided, allowed by or defined by the 39
terms and conditions governed in the permit to operate business or set by duly 40
authorized offices. 41
2. d. Smoking within the area shall be strictly prohibited. 42
2. e. No testing of fireworks or any pyrotechnics devices shall be allowed in the 43
designated area. 44
Section 3. SAFETY MEASURES. The following safety and preca utionary measures shall be observed: 45
a. Members of the Phil. National Police and deputized Barangay Tanods shall be 46
deployed in the area to ensure that order and rules are observed. 47
b. Corresponding signages shall be put in strategic places within the area as reminders 48
that Safety shall be observed at all times. 49
c. When and where possible, the Rural Health Ambulance with its personnel on duty, as well as the mini so
fire truck of the Bureau of Fire Protection of the Municipality shall be stationed in an 51
area nearby for the duration of the period of operation granted by the municipal 52
government. 53
Section 4. PENAL PROVISION. In violation of this Ordinance, the following penalty shall be apply: 54
4. a. For individuals who are selling outside the prescribed area the items mentioned in 55
this ordinance: 56
4. a. 1. First Offense - outright confiscation of all pyrotechnics, firecrackers and 57
fireworks that are in the possession of the individual. 58
4. a. 2. Second and Final Offense - outright confiscation of all pyrotechnics and 59
or imprisonment of not less than two (2) days but not more than five (5) 60
days depending upon the decision of the civil courts. 61
4. b. For owners of business establishments who maintain and own a structure caught 62
selling pyrotechnics, firecrackers and fireworks outside the prescribed area: 63
4. b. 1. First Offense - outright confiscation of all pyrotechnics, firecrackers and 64
fireworks that are in the possession of the entity and a fine of Phpl, 65
500.00. 66
4. b. 2. Second Offense - outright confiscation of all pyrotechnics, firecrackers 67
and fireworks that are in the possession of all establishment and a fine 68
of Php2, 000.00 69
4. b. 3. Third Offense - outright confiscation of all pyrotechnics, firecrackers and 70
fireworks that are in the possession of the establishment and a fine of 71

Section 5. IMPLEMENTATION. 73
5. a. This Ordinance shall be implemented by the Local Chief Exeq.1tive with the Phil. 74
National Police and the other law enforcement agencies. 75
S. b. The Punong Barangay and the Barangay Tanods that have jurisdiction over the location 76
of the Fireworks and Pyrotechnic Zone shall be activated and deputized to monitor and 77
apprehend violators of this Ordinance. 78
Section 6. Eff.ECTIVITY CLAUSE. This Ordinance shall take effect immediately upon approval. 79
Section 8. REPEALING CLAUSE. All Ordinances, resolutions, motions, legal orders and other issuances 83
inconsistent with this Ordinance shall be deemed repealed, modified or amended . 84

DRAFT MUNICIPAL ORDINANCE NO. 2014-09-020 1
ARTICLE I: TITLE
Section 2. When used in this ordinance, the following are defined as follows: 20
Section 4. The annual cockpit permit fee is payable upon application of a permit 98
before a cockpit shall be allowed to operate and within the first twenty days of 99
January of each year in case of renewal thereof.On derbies and special· 100
cockfights, the fees herein imposed shall be payable to the Municipal Treasurer 101
before the saine can be lawfully held. 102
Section 5. The permit fee for cockpit personnel shall be paid before they 103
participate in a cockfight and pay annually upon renewal of the permit of the 104
cockpit. Only duly registered and licensed personnel shall take part in all kinds 105
of cockfights held in this Municipality. No operator or owner of a cockpit shall 106
employ or allow to participate in a cockfight any of the above-mentioned 107
personnel unless he has registered and paid the fee herein required. 108
Section 7. No Cockpit shall be operated within the radius of 200 meters from 115
school and other public buildings and churches. 116
Section 8. Aside from the operations of a cockpit all other business activities 11 7
inside the premises of the cockpit will have to secure a Mayor's Permit relative to 118
its operations and pay corresponding business taxes and Mayor's Permit Fees. 119
Section 1. The following requirements must be complied with for the application 121

Section 2. Derbies may be conducted and allowed upon application of the 158

d. That there should be fixed time in bringing a livestock in corral at the
slaughterhouse, with the following recommended hours: 7a.m.-10am and
3pm-5pm;
e. That slaughtering hour should be 10pm-3am for market days and 1am-4am
for nonmarket days;
f. That there is a need to purchase a meat van for sanitation purposes;
g. That no extension of slaughtering should be strictly implemented;
h. That burnina of rubber materials for cookinQ is strictly prohibited.
· That meat vendors should put matting on the flooring of the tricycle (kurong kurong) they are using in

transporting livestock in order to ensure that pig manures are not being scattered on its way.

regulations has been issued for a proper implementation of SK Development Programs of
the Katlpunan ng mga Kabataan;
3. That there is a need to implement youth development programs, projects and activities on
the remaining months for C.Y. 2014 until the conduct of SK elections, as such, tasked force
shall be created and 8 members shall be nominated at large;

Procedure for the Sangguniang Barangay of Madamba, Dingras, llocos Norte.
2. That upon review by the committee, said resolution was returned for proper rehassment,as it
was inconsistent to the provision of the Local Government Code;
3. That the Sangguniang Barangay of Brgy. Madamba, Dingras, llocos Norte made the
necessary amendment to the said resolution ;
4. That the committee finds the said resolution, as amended, not contrary to existing laws;

5. Consistent with the above-findings, the committee recommends for the adoption , of the
committee report and further recommends that Brgy. Resolution No. 5 series of 2014 of Brgy.
Madamba be approved.

SUBJECT: Brgy. Resolution No. OS, series 2013 of Brgy. Madamba, Dingras, llocos Norte
FOR: The Hon. Presiding Officer and Honorable Members of the Sangguniang Bayan
The Committee on Rules and Laws to which the above-subject has been referred has the honor
to report baek to the Sangguniang Bayan the following findings and recommendations:
1. That Brgy. Resolution No. 05, series 2013 of Brgy. Madamba, Dingras, llocos Norte is a resolution
adopting the Internal Rules of Procedure for the Sangguniang Barangay of Madamba, Dingras,
!locos Norte;
2. That the provision of the resolution, most particularly on Disciplinary Actions - Rule XIII Section 56
subsection e, · run contrary to the provision of the local Govt Code of 1991.
3. That said Brgy. Resolution be returned to the concerned sangguniang barangay for proper
rehassment and further amendment.
