Inspector” In Electricity Dispute Resolution
Under Electricity Act 1910, Electricity Rules
1937, Regulation, Generation, Transmission
And Distribution Of Electric Power Act 1997
and In The Light Of Decisions of Superior
Courts.

INTRODUCTION:
If we look over the Electricity consumers
weather commercial or domestic then we will find
that every second consumer has a complaint
against the electricity distribution companies, in
shape of Excessive billing, Metering (slowness or
fastness) detection bills and unfair assessments,
these consumer are approaching to the following
institutions for resolution of their Electricity
disputes.
1. Civil courts
2. Consumer courts
3. Federal Ombudsman

4. Electric Inspector
One thing is of Prime Importance that
almost all the electricity disputes involve
technical issues relating to Electrical
Engineering works.
In other words the institution before
which the dispute is pending for adjudication
needs himself to be technical forum or it
needs technical assistance of Electricity
Matters/ Disputes.
Now if we look over the first three
categories of institutions i-e Civil Court,
consumer Court and Fedral Ombudsman they
of course posses legal competence but
unfortunately they lacks Electrical Engineering
related Expertise or assistance in shape of
Lawyers or other staff members, but if we look
over the office of “Electric Inspector”
appointed under Electricity Act, 1910 and
RGTDEP Act 1997, there we will find that he
is Electrical Engineer with deep insight of
technical issues, apart from other powers and
functions his major role is to resolve Electricity
disputes between consumers and distribution
companies.

4. How can it be improved further .

SIGNIFICANCE
Apparently this topic will be less
interesting or non attractive due to the
resent tendency of legal research going
on in the field of law.
But if we look over the practical
issues involved in the field of Electricity
Dispute Resolution and the legal and
technical problems involved in this field,
then we will come to the conclusion that
exploration of “Office of Electric
Inspector” is of prime importance and is
need of the day because it will not only

redress the issues of resolution and
understanding of technical Electricity
matter and disputes which the other
hand it will reduce the burden on Civil
Court, Consumer Courts provide
specialized services in the field of
Electricity disputes.
LITERATURE REVIEW

In order to explore the jurisdiction,

Power, Functions and as alternative
forum of Electricity dispute resolution
detail study of available literature in
shape of Electricity Act, 1910, NWFP
Procedure Relating Violation of
Instructions Order 2002, Punjab
(Establishment and Powers of office of
inspection) order 2005, NEPRA Laws
and in the light of Supreme Court and
High Court’s decisions will be required.
METHODOLOGY
Keeping in view the nature of
research problem, the research is
qualitative the researcher will use
analytical method to equalize the
provisions of various statues and rules

relating to the jurisdiction, Powers and
functions of Electric Inspector in
Electricity dispute resolution in addition
this research involve a document
analysis from
1. Primary Sources like statutes, rules
and decision of the superior courts.
2. Secondary Sources like books,
reports, internet, journals and News
Papers.
The study will rely on library and
scholarly works of learned people and
in detail study of case Laws of
Supreme Court and High Courts and
the research will be carried on under
the supervision of my honorable
supervisor.
