RESOLUTION NO. 70-96

A RESOLUTION REGULATING THE HOLDING OF FUND RAISING ACTIVITIES

WITHIN THE MUNICIPALITY OF PUERTO GALERA, ORIENTAL MINDORO

WHEREAS, pursuant to the provisions of Presidential Decree No. 1654, otherwise known
as the Solicitation Permit law and to render Department Order No. 40-A, Series of 1994,
responsive to public welfare, there is a need to regulate fund raising activities;

WHEREAS, R.A. 7160, otherwise known as the Local Government Code of 1991, the
Municipal Mayors are authorize to regulate the holding of activities for charitable and welfare
purposes within their territorial jurisdictions;

NOW, THEREFORE ON MOTION of ABC President Danilo M. Visayana and duly

seconded by All Members

Be it ordained by the Sangguniang Bayan of Puerto Galera, Oriental Mindoro that:

MUNICIPAL ORDINANCE NO. 57

SECTION 1. TITLE

An ordinance regulating the holding of fund raising activities within the

municipality of Puerto Galera, Oriental Mindoro

SECTION 2. DEFINITION OF TERMS: As used in this ordinance.

Fund raising - this refers to all kinds or types of fund raising such as popularity
contest, benefit shows, Bingo Social, round table, raffle, caroling, solicitation in forms of
letter, envelopes and other similar activities.
SECTION 3. REGULATED ACTS

No person/individuals or juridical shall hold any forms of fund raising within the
jurisdiction of Puerto Galera, Oriental Mindoro without first securing the hereunder
requirements prior to the issuance of mayor’s permit.

1. Permit from the DSWD

2. Barangay Clearance where the fund raising be conducted
3. Purpose of the fund raising and name of the project to be funded.

SECTION 4. EXEMPTIONS

This rules and regulation shall not apply to:

1. To any committee, organization, association or institution established for

charitable and public welfare purposes, whose activities relative to the
solicitation of donation and voluntary contributions or other means for
collecting funds has been duly authorized by Presidential Proclamation; and
2. To fund raising activities conducted by the Sangguniang Barangay for
Barangay projects in accordance with Section 391 or Article 88 of R.A. 7160

SECTION 5. PENAL PROVISIONS

Violation of any provisions of this ordinance shall be punished by a fine of not

less than ONE THOUSAND PESOS (Php 1,000.00) but not more than TWO
THOUSAND FIVE HUNDRED PESOS (Php 2,500.00) or imprisonment of not less than
fifteen (15) days but not more than six(6) months, or both fine and imprisonment at the
discretion of the Court.

SECTION 6. EFFECTIVITY

This ordinance shall take effect ten (10) days upon its approval.
