MOTION FOR THE ISSUANCE OF

WRIT OF EXECUTION

COMES NOW the state, through the undersigned Associate
Provincial Prosecutor and unto this Honorable Court, in support of
this Motion, respectfully alleges:

1. That the Honorable Court rendered a Decision in the above-

entitled case, dated September 18, 2018, in favor of the
private-complainant, the dispositive portion of which reads
as follows:

“WHEREFORE, premises considered, JUDGMENT is

hereby rendered as follows:

In Criminal Case No. 3663, this court finds accused

MICHAEL BAYUGA, GUILTY of the crime of Maltreatment,
as defined and punished by Art. 266, par. 3 of the Revised Penal
Code. A fine of Fifty (Php50.00) is hereby imposed as his
penalty.

Accordingly, accused is hereby ordered to pay private

complainant the aggregate amount of Thirteen Thousand Two
Hundred Sixty Three 26/100 (Php13,263.26) Pesos as actual
damages with legal interest at the rate of six (6%) per annum
from finality of this judgment until fully paid.

In Criminal Case No. 3664, accused MICHAEL

BAYUGA is hereby ACQUITTED of the crime of Grave
Slander as the Constitutional Presumption of Innocence in favor
of the accused has not been effectively destroyed by the
evidence of the prosecution.

2. That the Decision has become final and executory;

PRAYER

WHEREFORE, premises considered, it is most respectfully

prayed of this Honorable Court to issue a Writ of Execution in
order to enforce its Decision dated September 18, 2018.

Other reliefs just and equitable under the premises are

likewise prayed for.
