petitioner Office of the Ombudsman (Ombudsman) seeks

of the Ombudsman and Fact Finding and Intelligence

words in a statute is indicative of the legislative intent to make the
statute mandatory. A statute or provision which contains words of

otherwise than designated is mandatory. Prohibitive or negative words
can rarely, if ever, be directory, for there is but one way to obey the
