III. Presenting Problem

Petitioners Lito Cruz and Grace Cruz seeks to legally adopt herein client Jon Cruz as their
child for the reason that the client’s biological parents have abandoned the child since March
of 2018 and their presence can no longer be located despite exhaustion of all available
remedies. The court has also ordered a judicial declaration of abandonment against the
client’s parents.

IV. History of the Case

Rose Cruz and Ernie Luna have been together for several months and been living together
although unmarried. Rose got pregnant with Jon and Ernie during Rose’s pregnancy left her
side with no apparent explanation and his location can no longer be located, only after Rose
gave birth that he went back to Rose and Jon. A month after that, Ernie once again left his son
and his common wife. Two months Rose left Jon with her parents. Rose and Ernie can no longer
be found since then.

V. Family Background
Jon is a product of broken family and was left under the welfare of his mother’s parents
when he was barely two months old. At that time, his father eloped with another woman and
his mother went somewhere else and both of their location cannot be found.

Lito Cruz is Jon’s grandfather and is working as a Hospital Physician in Corazon Locsin
Montelibano Regional while Grace Cruz is the spouse of Lito and grandmother of Jon who is
also working in the same hospital as Head Nurse.

VI. Assessment and Recommendation

 Lito and Grace have been married for 25 years with a loving home where Jon’s mother
grew up. With the guidance and protection of his grandparents, Jon will be placed in a care
conducive for his growth and development.

It is recommended that the client be legally adopted and be taken cared of by his own
grandparents by reason of abandonment made by his biological parents. There are no other
family members within fourth civil degree of consanguinity that suits better to be Jon’s
adoptive parent than his grandparents Lito and Grace Cruz.
