SURROGACY VS ADOPTION 1

"Biology is the study of living organisms, divided into many specialized fields that cover their

morphology, physiology, anatomy, behavior, origin, and distribution" (Oxford university press,2018).

Oprah Winfrey (2004) said: "Biology is the least of what makes someone a mother". This quote explains

that choice is not the most important factor, it is the love that a mother carries. Surrogacy and Adoption

are two ways of having a child without sexual relations from the intended parents. Adoption is the

permanent legal transfer of all parental rights from one person or couple to another person or couple.

Surrogacy, the process of giving birth as a surrogate mother or of arranging such a birth. Surrogacy and

Adoption differ in the measure of advantages, the process of obtaining a child and the cost of having a

child. Despite this, both have rewarding experiences that allow prospective parents to complete their

families.

Firstly, both process in obtaining a child, surrogacy and adoption have an influential to the

present days around the world. In surrogacy case has a lot of steps to follow to have the child, first:

Medical process; involves a planned pregnancy complex producer that are not involved in adoption. In

medical process most people will need an egg and/or sperm donor. For the surrogate mother regular

check-ups (20 days of menstrual cycle) for endometrium preparation, transvaginal scan for endometrial

lining measurement, the blood test for estradiol and progesterone hormone check, and medications for

hormones. Frozen embryo transfer (day 21st of the menstrual cycle) an egg is removed from the

intended mother or anonymous, then the eggs are fertilized in the laboratory to create an embryo. (10

days later after embryo transfer) pregnancy test check, when it is positive surrogate mom moves into

provided serviced apartment with professional caretakers. (Week 6 to 11 week of pregnancy period)

follow up check-ups at the clinic with transvaginal scan to: Detect for any abnormalities, confirm having

one or multiple babies, and check the size of the baby. (Week 12 to week 39 of pregnancy period)

antenatal care program and check-ups, for physical examinations and treatments prenatal vitamins for

better health for mom and baby. Second: legal process, the variations of surrogacy laws depends state

by state, surrogacy is not like adoption where adoption is legal in every state, and surrogacy is still

considered illegal or invalid in certain states in USA for example: New York, Washington and Michigan.

The next step to do is hire a surrogacy attorney, people are really entail a specialist in this area because

the law have a lot of formalities and people assist an expert that is doing everything up to code. The first

thing that surrogacy attorney is going to do is draft a contract between prospective parents, and

surrogate mother and the contract is made in order to lay out what is treat happen after surrogacy takes

place. Basically the contract is going to say that be egg donor is no longer the birth mother of the child

or perhaps that the sperm donor is no longer a deep birth father of the child, surrogates are going to

finish legal rights as parents of the child that surrogates has assisted create in order to conclude the

contract the attorney will be a key piece there because surrogates know how to address the law in the

contract and word things in a way that is recognized for the particular state courts, also that attorney is

able to go to court and get an order that allows prospective parents to be on the bursar of the child.

However, the adoption processes are rigorous, there are no other ways of bypassing the system of being

assessed and approved by the relevant government department. There are some steps to follow before

a final adoption order is granted. First, complete an expression of interest form; it expires if people are

not selected for assessment within two years of names being entered in the register. Second, suitability

assessment: Health checks, criminal history, domestic violence history, traffic history, referee few days

interviews in the couple's home. Third, suitable adoptive parents register: If people are found suitable to

be adoptive parents instantly the names are entered: in the list of parents register. Fourth, selecting

prospective adoptive parents: Departments decide which couples from the suitable adoptive parents

register best meets the child needs and interests. Five, accepting a placement proposal: It includes

information about the child needs to support the prospective parent’s decision about the child
SURROGACY VS ADOPTION 3

placement. If parents make the placement will become the prospective adoptive parent under an

interim adoption order. Parents must have the custody at least 12 months before a final adoption order

is made. Six, adoption plan: It is an agreement between the birth parents and the prospective adoptive

parents. Seven, adoption order: After a final adoption order is made by the children court, then become

the child only legal parents.

Secondly, "In 31 cases (91%), the decision of when to hand the child over was the result of a

mutual agreement between the couple and the surrogate mother. In three cases (9%), the surrogate

mother had decided when the child was to be handed over. All of the women were happy with the

decision reached about when to hand over the baby, and none had experienced any doubts or

difficulties whilst handing over the baby". (Lycett, 2003). The advantages of surrogacy are clear to the

hundreds of families who have been created in this special way. Here are few surrogacy benefits:

Surrogacy allows infertile couples and every kind of people to want to become parents when they are no

able to have children. Also in some cases, the babies can have both of the intended parents own DNA,

the DNA of one of them combined with DNA of a donor or two donors DNA. Surrogacy gives intended

parents more control and peace of mind throughout the pregnancy than they usually have with

adoption. In the same way, surrogates have benefits as they receive compensations, a variety of services

throughout the process, and they enjoy the situation helping others. On the other hand, adoption offers

several advantages for birth parents, adoptive parents, and adoptive children. For birth mother: An

unplanned pregnancy can delay or stop a person’s dream or goals, people are not always financially able

to raise a child, in plenty cases mothers don`t have a partner to raise the child, or just aren`t ready to

raise the child. Adoption brings a lot of benefits for people in this case as: Tend to have higher

educational aspirations are less likely to live in poverty and receive public assistance, are more likely to

be employed a year after the baby is born, a meaningful advantage of choosing adoption is the ability to
SURROGACY VS ADOPTION 4

still be in a touch of your child`s life. Many birth mothers are able to stay in contact with the adoptive

family and their child through open adoption. Advantages for adopted children: There are many

advantages, they grow up in a family who is willing to love and conduct the child. According to a report

by the U.S department of health and human services (2007), 85% of adopted children were in excellent

or very good health and received more attention than non-adopted children. Some substantial

advantages for adoptive families are: Receiving the joy and blessing of adding a child to their family, and

the ability to fulfill dreams of a child.

Last but not least, the cost vary based on what the intended parents need. “There are very

variables involved with how much a surrogacy journey will cost. Such as the location of

surrogate/intended parents, clinic choice, the number of cycles/techniques and expenses claimed by the

surrogate". (Surrogacy in Canada online, 2001). For example: If the intended parents need IVF + egg

donor + selection of healthy embryo, in the USA can cost $20.500. If people need a sperm, egg, and

uterus, it can cost $120.000. The overall cost can be between $80.000 to $100.000. Affortunaly now and

days there are few different ways to pay or make installments depends on the country and the state.

The cost of adoption is less than surrogacy if people want to adopt internationally or privately through

private domestic adoption that varies considerably and can cost run from $10.000-20.000, that the cost

involved depends on how intended parents can find a child and where the child lives. In foster care

adoption it is free and that is something that not a lot of people realize, the things and have to pay is for

the documents that are require, for example: (financial support and police record checks) that this can

cost around $25 or $30 dollars.

SURROGACY VS ADOPTION 5

However in my opinion I prefer adoption because with that I feel more safe and is quicly, also I

can help child that are without a family and give to them a better lives, with surrogacy I think that a lot

of live can be lost with all the procedures that doctors apply to create a live.

In conclusion, surrogacy and adoption are different and important ways to have babies for

women that can’t or want became mother, people have a special experience that allow to complete

their families. It is true that this both process make a woman mother and the process that a mother

prefer it doesn’t matter. According to the book of Marian Faux :‘Women mother because they have an

innate drive-a maternal instinct-to do so”.
