Dear Judge ·Davis:

During a telephone conversation with Ellis Rubin today, I was

informed that you have schedualed a status conference on the Hunt vs.

Weaerman lawsuit for March 7, 1980. Would it be possible to postpone

this hearing until March 17, 1980, or whatever date is convenient for

you that week?

Before I can leave for Flor~da I need at least a week and a halfs

notice to buy tickets, make arrangements with my mother etc . Currently,

I am in the midst of preparing pleadings in an Freedom of Information

case - these pleadings are due on March 10, 1980. (see attach .)

The reason I am asking for this delay may also concern some

mix-up in getting information about this case to me I have not received

notice of this status conference in the mail from the Court, nor for

that matter did I receive a copy of your Order dated 25 February 1980

regarding instant matter. The reason I am aware of this Order is a


result of Ellis Rubin sending me a copy . Perhaps my ex-attorney, Mark
Friedman, is getting this information?

I shall attempt to contact your office telephonically regarding

this matter.

MOT ION TO QUASH THE SUBPOENA

NOW COMES Joe Trento, by his undersigned attorneys,

and respectfully moves the Court to quash the subpoena served

upon him o n September 3, 1 980 . A copy of the aforesaid

subpoena issued b y the Clerk of the District Court for the

District of De l aware is annexed hereto as Exhibit A.

The grounds for the aforesaid Motio n are as follows:

A. Joe Trento is currently empl oyed as a newspaper

reporter with The News J ournal Compan y, a division of Gannett ,

Inc . The News-Journal Company publishes its newspaper s in

Wilmington , Delaware;

B. Mr . Trento , a former r esident of Wilmington ,

Delaware, currently is a resident of Philadelphia , Pennsylvania;

C. Mr. Trento was served in Wilmington , Delaware

wi th t he a f o resaid subpo ena on September 3, 19 80;

D. The subpoena seeks to require Mr. Trento to

appear at a deposition on September 30, 198 0 at 117 North


Fairfax Street, Alexandria , Virginia;
E. Rule 45(d) (2) of the Rules of this Court states
that a nonresident of the District in which the deposition
is to be taken may be required to attend only in the County

wherein he is served with a sub poena or within 40 miles from


the place of service .

F. It would be inconvenient and contrary to

Rule 45(d) (2) for Mr. Trento to be deposed in Alexandria,

Virginia.

G. On information and belief, Mr. Trento is

to be deposed on matters related to articles written by

him and published in the News Journal Company's newspapers.

To that extent, the subpoena constitutes an excessive re-

straint upon the scope of legitimate news gathering activity

and will have a chilling effect upon the flow of information

to the press and the public. Thus, the subpoena should be

quashed under the First Amendment to the United States

Constitution.

H. On information and belief, if Mr. Trento is


to be deposed, he will be requested to breach his confidential

relationships in violation of Mr. Trento's rights under the

First Amendment of the United States Constitution to protect

confidential news sources. Further, to the extent this

subpoena seeks to require Mr. Trento to disclose confidential

sources, the subpoena violates the applicable Shield laws,

including the Delaware Reporter's Privilege Act, 10 Del.C.

§4320 et~.;

I. To the extent that the subpoena duces tecum

seeks to require Mr. Tren.to to produce any notes concerning

any article he wrote, the subpoena duces tecum violates

Mr. Trento's First Amendment privilege to protect confidential


news sources, constitutes an excessive restraint on the scope

of legitimate news gathering activity, and constitutes a

violation of the applicable Shield laws, including the

Delaware Reporter's Privilege Act, 10 Del.£. §4320 et seq.

WHEREFORE, Mr. Trento respectfully requests that

this Court issue its Order to quash the subpoena and that

he have such other relief as justified in the premises.

FACTS

12. On 3 September 1980, Joe Trento was personally served with

j a deposition subpeona issued by J.R. McAllister, Jr., Clerk,

j United States District Court for the District of Delaware. (see


l' Attachments "A" and "B"). On 10 September 1980 Mr. Trento, rep-

resented by Richard G. Elliot Jr., filed a motion to quash this

subpeona. This motion is filed in response to this motion.

CAUSE OF ACTION
I
11 3· Rule 26 (b) (1), Federal Rules of Civil Proceedure, states:

"Parties may obtain discovery regarding any matter, not privil-

edged, which is relevant to the subject matter involved in the

pending action ••• " Attachment "C" contains excerpts from the

d eposition of A.J. Weberman, 3/12/80, which concern Mr. Trento.

Attachment "D" is Mr. Trento's front page article regarding Mr.

Hunt's alleged presense in Dallas, Texas, on 22 November 1963.

4. Rule 30 (a) states: "The attendence of witnesses may be

compelled by subpeona as provided for in Rule 45."


5. Rule 45 (f) states: "Contempt - Failure by any person

without adequate excuse to obey a subpoena served upon him may

be deemed a contempt of the Court from which the subpeona issued."

ARGUEMENT

6. In paragraphs D. and E. of Motion to Quash Subpoena, Mr.

Trento bases his cause of action on Rule 45 (d) (2), F.R.C.P.,

which states: " ..• a non-resident of the District in which the

deposition is to be taken may be required to attend only in the

County wherein he is served with a subpoena or within forty

miles from the place of service ••. " Defendant Weberman and Plain-

originally scheduled for 30 September 1980 in Alexandria, Virginia !

7. In paragraph G of Mr. Trento's Motion to Quash, he claims

"the subpoena constitutes an excessive restraint upon the scope

of legitimate newsgathering activity •.. Thus, the subpeona should

be quashed under the First Amendment to the U.S. Constitution."

The First Amendment does not give reporters blanket immunity from

i testifying at Civil proceeding s.

8. In paragraph H Mr. Trento cites his right to protect con-

fidential news sources. If Mr. Trento objects to any of the

questions that are asked of him during this deposition he can

refuse to answer. If Plaintiff or Defendant so desires, these

questions can be certified and the Court may determine if they

are proper.

9. In paragraph~ Mr. Trento cites the De laware Reporters


Privilege Act 10 De l. c. 4320 et seq. Thi s i s a State law and
not enforce a b l e by a Fe deral Court.

SUMMARY

10. Joe Trento should be compelled to appear at the deposition

in question. Defendant prays tha~ this honorable Court will grant

this motion and issue an order compelling Mr. Trento to appear.

Plaintiff, E. Howard Hunt, joins with me in this appeal.

At Wilmington in the aforesaid District , it

appear ing that Alan Jules Weberman , Defendant in a libel

suit pending in the United State s District Court for the

Southern District of Florida, 76 -125 2 -Civi l-EBD , requested

t his Court to issue its subpoena duc e s tecum directing that

Joe Trento appear at a deposition i n Virginia, and that

the subpoena was served .upon Joe Trento on September 3 , 1980 ,

and it appearing t hat Joe Trento i s currently e mployed as

a newspaper reporter with The News - Journal Company , a

division of Gannett, Inc. , and that on September 10 , 1980

Joe Trento filed a Motion to Quash said subpoena alleging

among other things that this subpoena violated his rights

as a reporter under the First Amendment to the United States

Constitution , and on September 12 , 1980 this Court advised

the parti es , including Mr . Weberman of a hearing to take

place on September 22 , 1980 at 9 a . m. for the purpose of

establishing a brief schedule on the Motion t o Quash , and

it appearing that on September 1 8 , 1980 Mr. Weberman filed a

"Mot ion to Campell Deposition ," and it appearing that counse l

for Mr . Trento has ende a vored to establish a brief schedule


with Mr . Weberman but Mr . Weberman has not responded, and

on September 22, 1980 Mr . Weberman failed to appear at the

aforesaid hea ring and the Court waited an additiona l two

hours for Mr . Weberman to appear and he did not do so ,

and based upon the record before it , t he Court finds that

Joe Trento is not a par ty to t he F l orida litigation and

that Mr . Weberman has failed to make any showing to overcome

the protections granted to Mr . Trento under the First

Amendment . For the foregoing reasons , it is

ORDERED THAT the Motion to Quash filed herein

by Joe Trento is granted .

NOW COMES the defendant, A.J. Weberman, and prays this

honorable Court grant him relief under Federal Rules of Civil

Proceedure, Rules 26, 30 and 45.

FACTS

On 28 July 1976, plaintiff, E. Howard Hunt filed Civil

Action # 76-1252-EBD in Federal Court for the Southern District

of Florida, Miami, Florida·, alleging that defendant, A. J.

Weberman was guilty of libel for the publication of book titled

Coup D'Etat In America . (Third Press- New York City-1975)

On 12 March 1980 defendant A.J. Weberman, pro se, and

attorney Ellis Rubin, representing E. Howard Hunt, agreed on the

need to depose Richard M. Nixon, a former employer of Mr. Hunt.

(see Defendant's Attachment "A")

On 18 April 1980 Mr. Rubin was mailed a Notice of Taking

Deposition regarding Mr. Nixon. On 9 May 1980 Mr. Rubin was

ARGUEMENT AND SUMMARY

In Khashoggi vs. Khashoggi ( a divorce action in Southern

California} Richard Nixon was subpeoned to a deposition and

11 was deposed. Mr. Nixon's testimony was relevant because he had

I visited and received visits from Mr. Khashoggi on several
ii occassions in San Clemente, California. Mr. Khashoggi's wife's
attorney deposed Mr. Nixon in order to prove that Mr. Khashoggi

had business interests in California in order to establish

jurisdiction in the case. {Miami Herald 23 Nov. 1979}

The connection between Mr. Hunt and Mr. Nixon is much

firmer than the connection between Mr. Khashoggi and Mr. Nixon:

Hunt was employed by the White House Special Operations Division

as a full-time salaried employee with an .office in the White

House. His testimony is ·relevant to the instant matter and

Mr. Nixon enjoys no immunity from the judicial process as an

eX-President.

Defendant prays that this honorable Court will grant this

motion and issue a n Order compelling Mr. Nixon to appear.
