AFFIDAVIT

I, PACIFICO CATINDIG, Filipino, of legal age, married and with

residence at ------------------------------------------------, after having been duly sworn in

accordance with law, hereby depose and state that:

(1) This an affidavit is being filed to support the complaint affidavit of

Rosa Catindig charging Marty Reyes, Filipino, of legal age, single

and resident of ------------------------------- of the crime of of Rape

committed by an act of Sexual Assault under Article 266-A par.

(2) of the Revised Penal Code, Rape by Carnal Knowledge

under Art.266-A par. (1), all in relation to Republic Act 7610

(2) That on November _____, 2018, Marty Reyes came to our house

and spent some time chatting with my son and my daughter Rosa

Catindig;

(3) That he usually comes to our house after school and during

weekends;

(4) That during his visits he would try to talk to my daughter Rosa

Catindig and is very friendly towards her and will tease her

sometimes. He also spent much time talking to my son, being both

a basketball enthusiast;

(5) That me and my family treat Marty Reyes as our close family friend

and did not mind his frequent visits in our house;

(6) That my daughter Rosa Catindig is very shy and would not comment

to his teasing. We find this things usual and without meaning since

he is a classmate of our daughter Rosa and they are sharing

homeworks and class works;

(7) That on November _____, 2018 Marty Reyes stayed later than

usual after their basketball game with my son;

(8) That when my wife and I was preparing to sleep at 9 pm Marty

Reyes is still outside our house;

(9) That I woke up at around midnight because I heard commotion near

Rosa’s bedroom, then my wife called me, in a very tense and loud

voice. Outside of her room I saw Marty Reyes standing and looking

topsy turvy and as if he was in shock upon seeing me;

(10) That I went out of our room and went to my daughter’s room

and there I saw my daughter Rosa Catindig disoriented and crying;

(11) That I saw blood stains on her shorts and there are bruises on

her arm;

(12) That there were tears in her eyes and she was very afraid and

was gesturing towards Marty Reyes;

(13) That it dawned on me that he raped my daughter Rosa Catindig

and I became very angry and started shouting at him;

(14) That when he saw that I was very angry he immediately fled the

house;

(15) That when I tried to chase him my wife and other children

stopped me;
(16) That when I checked the room of Rosa Catindig there is a sign

of struggle, that there is blood on the foam and that upon closer

inspection there was a small knife beside the pillow;

(17) That based on the following I believe that Marty Reyes raped my

daughter Rosa Catindig and should be dealt with by law.
