Bid Evaluation criteria

1 Technical Experience criteria


1.1 The bidder must have been carried out detailed Techno-
economical feasibility study and preparation of Detailed
feasibility Report for “revamping and modernization of
petroleum/ petro-chemical industry/ refinery/ natural gas
compressor station during last 5-7 years and the value of
project cost should be at least Rs. 25 Crore. The bidder shall
submit the duly notarized documentary evidence including the
work order and completion certificate for the above.
1.2 The consultant must have commensurate resources to complete
the present commitments. The bidder shall submit the details of
present commitments and the organizational capabilities in
support of same.
1.3 The bidder must have various latest softwares for design and
project management. A list of such software shall be submitted
along with the bid.
1.4 The consultant should have in-house design capabilities to
develop Civil, electrical and instrumentation system and other
required engineering functions.

Special Conditions of Contract

GAIL (India) Ltd (erstwhile Gas Authority of India Ltd), India's principal gas transmission
and marketing company, was set up by the Government of India in August 1984 to create
gas sector infrastructure for sustained development of gas market in the country. Today
GAIL has expanded into Gas Processing, Petrochemicals, Liquefied Petroleum Gas
Transmission and Telecommunications. The company has also extended its presence in
Power, Liquefied Natural Gas re-gasification, City Gas Distribution and Exploration &
Production through equity and joint ventures participations.
The organization has attained a leading status in the Indian business through its all-round
contribution to the nation's gas-based economy with a countrywide presence of
Pipelines, Gas Processing Plants, and Marketing network, including 60 work centers. The
organization maintained its growth trajectory for last ten years.
GAIL manages following infrastructure:
 India's largest Gas Transmission Networks.
 World's largest LPG pipeline network.
 Seven Gas Processing Facilities with an aggregate capacity of 1.3 MMTPA of LPG,
Propane, Pentane and SBPS/ NAPTHA
 India's largest gas-based Petrochemicals Complex with an installed capacity of
310,000 TPA of Polyethylene (HDPE, LDPE, LLDPE)
 Optic Fiber Cable Network of more than 8,000 KM to offer bandwidth as a
Carrier's Carrier in the Telecom sector
 An Equity Participant in E&P blocks in India and other countries

HVJ Gas Compressor Station:
The HVJ pipeline system consists of six compressor stations Hazira, Vaghodia, Jhabua,
Kheda, Vijaipur, Auraiya. These compressor stations boost the pressure of natural gas for
efficient transmission and for meeting the contractual pressure requirements of
different consumers.
Hazira compressor station is the gateway of HVJ pipeline system. Any disruption at
Hazira, immediately affect the operation of M/s ONGCL as well as the down stream
consumers in HVJ network. Hazira Compressor Station is situated close to banks of river
Tapi on Ichchapore - Magdalla Road. Approximate distance from main river course is
around 1 km on southern side and branch course of river is just backside of the Plant.
The plant is highly prone to flood water and affected during the flood in 1994, 1998 and
2006. The situation is aggravated in the year 2006 due to silt deposited on the river bed
over the years of time. As stated from Govt. records, the capacity of river was reduced
from 10 -12 Lac cusec to around 5-6 Lac cusec now. In order to address this problem,
GAIL wishes to hire a consultant to address the remedial measures.

SCOPE OF WORK

The work entails detailed techno-economical feasibility study, submitting


alternative measures including macro planning considering the flood prone zone
and seismic zone. The consultant will submit various alternatives with Techno-
Commercial feasibility report (preliminary basic drawings & estimate) for flood
mitigation plans, revamping & modernization of existing systems.
The scope of work described herein is exhaustive but not limited to the works
mentioned in this document.
General guidelines:
The consultant shall carry out the Residual Life Assessment of Plant and
machineries (e.g. switchgears, instrumentation control systems, compressed air
system, back up power supplies, HVAC etc.). The plant and machinery has been
installed in the year 1987 and faced major earth quake in 2001 & three times
flood in 1994, 1998 and 2006. While addressing the technological obsolescence,
the consultant shall also keep the view on flood mitigation/ earth quake
measures.
1. Industrial practices: To study the industrial practices on the plants
situated in flood prone/ low lying area to minimize the risk of damages
due to flood keeping in view the geo-technical data of the presently
situated plant (Post flood and re-classification of seismic zone).
2. Assessment of GAIL installation: To study the existing systems/ sub-
systems installed at GAIL, Hazira to assess their suitability as per the new
standards/ guidelines for industrial installations in such type of
geographical areas.

3. Gap identification and mitigation plan: Based on the studies on above,


the consultant shall identify the gap in the existing infrastructure and
submit the plan for complying with the industrial norms.
Generally during the natural calamity, the electrical and instrumentation
systems are badly affected. Even the moisture ingress leads to
consequential failure in future. Keeping in view, the consultant shall
study the civil structure, electrical power distribution system including
switchgear, utilities such as compressed air, emergency power, fire
water, raw water system, back up power system i.e. UPS, DC systems,
emergency lighting.
The plan shall be prepared keeping in view the latest guidelines and at
the same time address the problem of flood and earth quake to a greater
extent.
4. Collect geological and hydrological data for the compressor Station area.
5. The consultant shall carry out impact analysis for like future flood
scenario and restoration strategy to reduce the downtime.
6. The consultant shall work out the options proposed keeping in view the
compatibility with existing system in order to ensure the compatibility;
the following basic design and engineering of the existing system are to be
studied by the consultant.
7 Study of present electrical & instrumentation systems for GTG, GTC,
HVAC, fire fighting and other utilities, power distribution, electrical load
analysis.
8 Comparative study of alternative options.
9 The consultant will give the presentation on the conceptual aspects of his
design to a panel of GAIL executives. The input received from GAIL will be
incorporated in the final report submitted by the consultant.

SPECIAL TERMS AND CONDITIONS

1 SECURITY DEPOSIT
Security Deposit from the bidders’ professional fee @5% of each R.A. bill
will be deducted subject to a maximum of 5% the total fee payable and
the same will be refunded after acceptance of final report by GAIL (India)
Ltd. in all respect.

2 FEE FOR VISITS


No separate fee will be payable for visit at site for the purpose of study,
collecting data, and preparation of Detailed feasibility report. The cost
towards site visit deemed to be inclusive in the professional fee.
However the GAIL will reimburse the cost of lodging, boarding and travel
expenses and institutional charges for outstation visits (other than GAIL,
Hazira) on submission of necessary documentary proof. GAIL may arrange
lodging and boarding at own Guest House on chargeable basis depending
on the availability. The travel plan and constitution of team will be
finalized in consultation GAIL. Decision of Engineer In charge will be final
and binding.
To attend meetings related with the work including presentations after
award of work, Consultant and or his authorized representative may be
required to visit GAIL Office at New Delhi/ Noida/ Vijaipur/ Hazira or any
other place from time-to-time. The cost of all such visits will be
reimbursed by GAIL to the consultant as under:
The reimbursement bills for travel for visits along with tickets and other
details etc. shall be submitted to GAIL within 60 days from the date of
visit except when there is a valid reason of delay to be mentioned by the
Consultant and duly recommended by the EIC.

3 QUOTED FEE
The quoted fee shall be inclusive of charges for visit to site, local
transportation, boarding and lodging expenses and all types of present
and future taxes and duties but exclusive of service tax.

4 COMPENSATION FOR DELAY


Time shall be the essence of the contract and failure to perform or supply
the drawings/ details/ documents as per agreed time schedule will render
the Consultant liable to pay compensation at the rate of 0.5% (Half
percent) of the estimated/ awarded fees or such sum determined by GAIL
for every week’s delay or part thereof in their performance at the various
stages given above subject to a maximum of 5% of the total fee payable.
Should the consultant fail to provide drawings/ other details within the
time schedule or within such other extended time as may be approved by
GAIL, and then notwithstanding the above, GAIL shall be at liberty to get

the remaining work done through some other agency at the risk and cost
of the consultant. The decision of the Engineer-In-Charge in this regard
and/ or for amount of compensation on this account shall be final and
binding.

5 AGREEMENT
The consultant shall enter into an Agreement with GAIL. The proforma for
agreement is enclosed. This will be on a non-judicial stamp paper of
appropriate value the cost of which will be borne by Consultant.

6 DEVIATION
Tender must be submitted without making any additions/ alterations. The
bidder shall submit quotation based strictly on terms and conditions and
specifications contained in the Tender Document and not to stipulate any
deviations. Deviations in any manner against any clauses of this tender
document are not allowed and any such deviation if indicated any
where will render the offer non-responsive and shall liable to be
rejected .
NOTE: The right to accept the offer will rest with GAIL. GAIL, however,
does not bind them to accept the lowest offer and reserves to
itself the authority to reject any/ all the offers received without
assigning any reason whatsoever.

7 TIME SCHEDULE
The following time schedule will be applicable for the tender package:
Submission of draft
Within 10 weeks from the date of award of work
report
Submission of final Within 3 weeks after receiving the inputs/ comments
report from GAIL.

8 OTHER SERVICES AND TERMS & CONDITIONS


8.1 If due to any reason on the part of GAIL, the work is abandoned the
consultant shall be paid for the work done as per mode of payment
stages specified in payment schedule. For any incomplete stage,
suitable payment based on pro-rata efforts put in by the consultant
shall be payable. The decision of the Engineer-in-Charge in this
matter shall be final and binding.
8.2 The consultant shall be fully responsible to GAIL with regard to the
design and report submitted by them.
8.3 If at any time during the currency of this Agreement, the
performance in whole or part by the consultant, or any obligation
under this agreement is prevented or delayed by reasons of any
destructive acts of country’s enemy, Civil commotion, sabotage,
fires, floods, explosion, epidemic or acts of God and provided

notices of the happening or any such event are given to GAIL by the
consultant within 21 days from the date of occurrence thereof, the
consultant shall not be held responsible for delay occurring due to
the above mentioned events.
8.4 If GAIL deviates substantially from the approved scheme which
involves for its proper execution then extra services, expenses and
extra labor/ efforts on the part of the consultant for making
changes and additions to the drawings, specifications or other
documents, the consultants shall be reasonably compensated on
the basis of man-hour or man-days spent by the consultants. The
decision of the engineer-in-charge in finalizing such payments shall
be final and binding.

9. MODE OF PAYMENT OF REMUNERATION


9.1 The professional fee to the consultant will be paid in stages as
follows:

2 On submission of final of report 40%
3 On submission of acceptance of report 10%

9.2 Service Tax:


a. The quoted rates in accordance to schedule of rates and shall be
exclusive Service Tax and Education Cess thereon. Service tax and
education cess thereon if applicable shall be paid extra. The bidder
shall indicate in its bid the Service Tax Registration No. and in
case, the Service Tax Registration No. is not available, and the
bidder will give confirmation for obtaining registration with a copy
application for registration.
b. The bidder is liable to pay service tax for the work/ service
rendered to GAIL, shall specifically mention the Service Tax
Registration No. in their Invoice (s). Further amount and the rate
of service tax shall be separately and distinctly specified in the
Invoice(s).
For payment of Service Tax, serially numbered invoice bill shall be
issued by the service provider and should also specify the
following.
1. The name, address and registration no. of the service
provider.
2. The name, address of the recipient of the taxable service.
3. Description, classification and value of taxable service
provided and the service tax payable on such services.

The above details are required to enable GAIL to avail CENVAT
credit for the service tax payment.

10 LIABILITIES
The consultant shall be responsible for any discrepancies, errors or
omissions in the detailed reports and drawings prepared and supplied by
them whether the same shall have been approved by GAIL or not. Upon
the request of GAIL, consultant shall promptly rectify the deficiency by
amending/ replacing/ supplementing the deficient drawings/ documents
as appropriate at their own expense.
Further the consultant must ensure to comply all statutory and legal
compliance as in force time to time and shall indemnify GAIL for any
action initiated by authorities arising due to non-compliance of statutory
requirement by the consultant.

11 TERMINATION OF AGREEMENT
The Agreement with Consultant may be terminated at any time on one
month’s notice by GAIL without assigning any reason, therefore, such
termination notwithstanding, the consultant shall be entitled to
remuneration in accordance with Clause No. 5 for works actually done by
them prior to such termination and shall be liable to pay to the GAIL all
damages which, GAIL may have become entitled to for omission or
commission on their part upon termination of the Agreement subject to
maximum of 10% of the total fee payable.

12 INDEMNITY BOND:
The consultant shall submit Indemnity Bond at the time of closing of
contract and indemnify GAIL for any dispute between the consultant and
the other parties regarding this work, payment etc.

13 ARBITRATION
Except where otherwise provided in the contract all disputes or
differences whatsoever arising between the parties out of the issues
relating to the construction, meaning and operation or effect of this
contract or the breach thereof shall be settled by arbitration in
accordance with rules of arbitration of the Indian Council of Arbitration
and the award made in pursuance thereof shall be binding on the parties.
Subject to the aforesaid, the provisions of the Arbitration and Conciliation
Act, 1996 or any Statutory Modification or Re-enactment thereof and the
rules made there under and for the time being in force shall apply to
arbitration proceeding under this clause. However, the venue of the
arbitration shall be at New Delhi.
