AFFIDAVIT OF WITNESS

I, MATTHEW JOHN ALMOGINO, single, of legal age, Filipino after having been sworn to in
accordance with law, do hereby depose and state that:

1. I personally know accused Michael A. Gatchalian as he was a neighbor and a childhood

friend;

2. I saw the accused went out of the Vizconde residence in the morning of 30 June 1991
while I was walking my dog along Vinzons St., Pitong Daan Subdivision, BF
Homes, Parañaque City;

3. I had a short conversation with the accused in the same hour;

4. After a few minutes, I walked my dog back in the same route where I met the accused. He
asked me to take a picture of him and his friends whom I met for the first time;

5. He thanked me for taking their group picture and they all went back inside the Vizconde
household;

6. I have not seen the accused anymore on that same day;

7. It is not within my personal knowledge if Gatchalian, Webb, Fernandez, and Lejano

belong to the same peer group;
 8. I am executing this affidavit to attest the truth of the forgoing facts and for whatever
purposes this may serve.
