I, ALVY FAITH B. PEL-EY, of legal age, and a resident of 85 Santa Escolastica, Baguio
City, depose and say:
1. That aside from the unjust vexation that I filed on April 8, 2019, I am filing an additional
case of ALARMS AND SCANDALS against ELVIE CARBONEL and other boarders
involved living in first floor (first room) according to Art. 155 of the Revised Code
states that:

“3. Any person who, while wandering about at night or while engaged in any other
nocturnal amusements, shall disturb the public peace; or

4. Any person who, while intoxicated or otherwise, shall cause any disturbance or
scandal in public places, provided that the circumstances of the case shall not make the
provisions of Article 153 applicable.

2. That ALARMS AND SCANDALS are crimes of disturbance. It has to do with bringing
disturbance to public peace. Scandalous acts deemed offensive to good customs,
morals and public policy are considered as crimes of disturbance;

3. That I am also filing a case of Grave Oral Defamation under Article 358 of the RPC
defines and penalizes the crimes of Serious Oral Defamation and Slight Oral. Oral
Defamation or Slander is libel committed by oral (spoken) means, instead of in writing. It
is defined as "the speaking of base and defamatory words which tend to prejudice
another in his reputation, office, trade, business or means of livelihood;

4. In addition, I am requesting KGWD. FREDDIE FERNANDEZ to inhibit during barangay

hearing as he was supposed to be a witness to one of the incident that happened before
for violation of the Silent Night Law of Baguio City.
