Draft Constitution and By-Laws

of the
Parents-Teachers Association of Sinipsip National High School-Main

PREAMBLE

WE, the Parents and Teachers of Sinipsip National High School-Main, feeling the necessity of
a unified individuals for the purpose of enhancing cooperation for the welfare of our schoolchildren of
this school with the guidance of the mandate of the Department of Education of the Republic of the
Philippines and by our intelligent participation in every Parents-Teachers Association activity, and to
other fruitful endeavours and for other legal purposes for the welfare and unity of this association in
general, do hereby adopt this constitution and by-laws this third day of December , Two Thousand
Seventeen.

The CONSTITUTION

Article I - Name and Composition

Sec. 1. The Name and composition of the association shall be the "Parents-Teachers
Association of Sinipsip National High School-Main”, and shall be composed by either parent of a duly
enrolled student of Sinipsip National High School-Main, legitimate or illegitimate, or the recognized
guardian, and the teachers and all employees of Sinipsip National High School-Main and to be
governed by the following: Board of Directors through its executive officers – the President, Vice
President, Secretaries (1 from teachers, 1 from parents), Auditor, Public Information Officer, four (4)
Business Managers.

Sec. 2. The office of the Association shall be located at Sinipsip National High School-
Main, Amgleyguey, Buguias, Benguet.

Article II - Objectives and Definition of Terms

Sec. 1. Objectives – The Parents-Techers Association of Sinipsip National High School shall
aim:
a. to provide a forum for discussing relevant issues and their solutions and to unify the parents
and teachers for cooperation in the efficient implementation of Department of Education programs
and to provide mechanisms for coordination with the community and agencies for the benefit of the
students,
b. To collectively approve and individually contribute reasonable resource for any DepEd-
sanctioned activities of the students of SNHS-Main and programs of the same,
d. To help and protect its members legally, financially and socially.
f. To establish the Sinipsip National High School-Main Parents-Teachers Association as a
juridical entity for the purpose of transaction with government and non-government agencies and
individuals and other legal purposes.

Sec. 2. Definition of Terms. This Constitution and by-laws define the terms as follows:
a. DepEd – Acronym hereto referring to the Department of Education.
b. DO – Department order issued by the Secretary of Education defining policies and mandate
of the department.

Article III – Membership, Fees and Contributions


Sec. 1. The following shall be automatic members of the association:
a. Either of the parents or recognized guardian of a duly-enrolled student of Sinipsip
National High School-Main and members of the Faculty of Sinipsip National High School-Main and all
support staff duly employed. The school head cannot be member of this association but shall serve
as an ex-officio adviser of the association.

Sec. 2. Every registered member shall pay a reasonable amount but shall not exceed one
hundred pesos (Php100.00) as provided by DO 54 s. 2009 and DO 41 s. 2012 as annual PTA fee
payable to the treasurer of the Association. Before the annual collection of such fees, the Board shall
determine the reasonability of the amount to be collected.

Sec. 3. The annual PTA Fee shall be the fund of the association and shall only be upon the
disposal of the association subject to acceptable disbursement procedures. Should the association
conduct any fund raising activity, the same shall be considered association fund.

Sec. 4. Subject to DepEd Policies, Orders and pertinent laws and subject to the approval of
the Board of Directors, the association may individually contribute to finance DepEd- sanctioned
activities or programs, provided an annual budget is presented by concerned teacher-adviser of any
program or activity, such as but not limited to sports and MAPEH activities, school paper, academic
contests and other similar activities.

Sec. 5. The school head, teachers nor any DepED personnel are not allowed to collect fees
nor “safe-keep” any PTA fund pursuant to RA 7836.

ARTICLE IV. OFFICERS AND THEIR RESPECTIVE DUTIES

Section 1. The following are the officers of the association:


a. Board of Directors - , composed by not more than fifteen(15) members, elected from the
presidents and teacher-advisers of all homerooms with a ratio of two-thirds parents and one-third
teachers and presided by the president shall function as legislative body of the association.
Particular duties shall be:
i. to plan and approve programs or activities for the realization of the objectives of
the association.
ii. to authorize the PTA president to sign and disburse finances of the association.
iii. to authorize the PTA president to negotiate, enter into, and sign contracts with
other entities.
iv. to create working committees to implement approved programs and activities.
v. to solicit or accept monies for the association.
vi. to initiate, approve and implement long or short term venture that may benefit the
association and/or the schoolchildren.
vii. to promote the general wellbeing of association.
viii. to enact policies or regulations to be incorporated in the By-laws.

b. President - duly nominated and elected by his/her peers – all presidents of the
homeroom officers. The duties and functions of the president shall be:
i. to implement or coordinate and supervise the efficient realization of all approved
programs and activities of the association.
ii. to call and preside over the sessions of the of the board of directors or PTA
Officers and the general assembly, and vote only to break a tie.
iii. to negotiate, enter into, and sign contracts for and in behalf of the association
upon authorization of the board of directors.
iv. to approve the disbursement of funds of the association upon the concurrence of
the board of directors.
v. to promote the general welfare and the objectives of the association and other
stakeholders.
vi. to perform other duties and functions as may be authorized by the Board of
Directors.

c. Vice-President –
i. act in behalf of the president when circumstances arise upon the concurrence of
the board of directors.

d. The Secretary – Duties and function:


The Secretary shall:
i. Keep custody of all records of the association meetings and assemblies and
prepare and keep minutes of all the meetings and assemblies of the association.
ii. Assist in the preparation of needed documents or forms of the working
committees.
iii. Keep an updated record of the members arranged alphabetically.
iv. Exercise such other functions and duties as may be assigned by the board of
directors.

d. The Treasurer - The Treasurer shall


i. Keep custody of association funds and properties.
ii. Collect approved fees and contributions from members.
iii. Render a written accounting report of all association funds and properties under
his/her custody and ensure that such report shall be made available during meetings and assemblies.
iv. Disburse funds in accordance with financial procedures.
v. Exercise such other functions and duties as may be assigned by the Board of
Directors.

e. The Auditor, duties and functions


The auditor shall –
i. Evaluate records of the treasurer and issue statement duly signed of whatever
interpretations and impressions of the evaluation to the association during regular or special
meetings.

f. (business managers, etc.)

Article V – Election and term of office

Sec. 1. The election of PTA officers shall be conducted at least fifteen (15) days after the
start of classes of the school year. The election of the PTA Board of Directors and its execute officers
shall pursue after the election of homeroom officers. The homeroom presidents and teacher-advisers
shall elect among themselves the fifteen members Board of Directors (2/3 parents, 1/3 teachers) and
the Board shall elect among themselves the executive officers namely the president, the vice-
president, 2 secretaries (1 from the parents, 1 from the teachers), the treasurer and assistant
treasurers, the auditors, the PIO, 4 Business Managers.

Sec. 2 The term of office of all officers shall be one year and shall end only on the turn-
over ceremony. In no case shall a Board Director serve for more than two (2) terms.

Sec. 2. In case of a tie in votes for two or more nominee of the same office, a lot shall be
drawn to determine the winner.
Sec. 3. In case of vacancy by resignation, expulsion, disability or death, the Board of
Directors shall elect by majority votes from the homeroom PTA presidents to assume the unexpired
term in a special meeting called for such purpose.
Sec. 4. Teacher-members of the association cannot hold or be voted into any office in the
association except as member of the Board or secretary. Likewise, the school head shall serve only
as adviser to the association.

BY-LAWS

Article I – General Assembly, Meetings and Social Activities

Sec. 1. The association shall have two regular general assemblies to be convened immediately
after the PTA of the current year is organized and be called by the Board. Should there is an
immediate need, an assembly may be called at the determination of the Board.

Sec. 2. The Board of Directors shall have 4 regular meetings. Two (2) days before each
meeting, the president shall notify concerned parties through written notice stating the date, time and
venue of the meeting.

Sec. 3. The Board of Directors may have special meetings and shall be called by the president
when there are things of vital importance to be considered or as the need arises.

Sec. 3. The association shall observe a quorum of at least one-half plus one and penalty for
late and absent attendees. Ten minutes after the call to order shall be considered late and thirty
minutes after call to order shall be considered absent. Penalties are to be approved by the board of
directors and be accrued to the association funds.

Sec. 4. The association shall not allow minor proxies of absent members.

Sec. 5. The order of the business as far as practicable be as follows:


Call to order
Reading (Review) and approval of previous minutes of meeting
New business
Announcement
Adjournment

Sec. 6. The association recognizes information dissemination, trainings, symposia, and any
DepEd-sponsored activities for parenting, crisis management and any other activities are vital and
shall impose upon members of the association as responsibility to participate and may impose
penalties for non-attendance.

Article II – General Provisions

Sec. 1. The association is a non-sectarian and an apolitical entity.

Sec. 2. The association operates within the jurisdiction of the Department of Education and all
Department Orders, Department Memoranda shall at all times the standard of its decision-making
and to its activities.

Sec. 3. Any member whose actuations are against the general welfare and objectives of the
association and the students shall be subject to disciplinary actions depending on the culpability of
the person. The Board shall impose such penalty upon the recommendation of the grievance
committee.

Article III - Amendments

Sec. 1. This Constitution and By-Laws may be amended, altered, or repealed wholly or in part
by a two-thirds majority vote of all the registered members present at any regular or activity meeting
upon proposal of the Board of Directors, provided however, that such proposed amendment shall be
submitted to the secretary of the association prior to the start of the meeting. After its approval and
being signed by the Board of Directors, the same will become a part of the Constitution and By-Laws
and effect only on the following school-year.

Article IV - Date of Effectivity

Sec. 1. This Constitution and By-Laws of the Sinipsip National High School-Main Parents-
Teachers Association shall take effect on the date of its approval.

Approved, this sixteenth day of December, 2017 at Sinipsip National High School-Main,
Sinipsip, Amgaleyguey, Buguias, Benguet Philippines. The Officers who signed their approval are the
