SUBJECT : Investigation Report: Alleged violation of Republic Act No. 9262


(Anti-Violence Against Women and Children) against PO1 Lino S.
Binarao of Las Pinas City Police Station, NCRPO

I. AUTHORITY:

II. MATTERS TO BE INVESTIGATED:

1.To determine the facts and circumstances surrounding the complaint of Mrs.
Anna Jane Binarao (Mrs Binarao) against of PO1 Lino Z. Binarao (PO1 Binarao) for
violation of R.A. No. 9262.

III. FACTS OF THE CASE:

2. It appears that PO1 Binarao and Mrs. Binarao are legally married. Mrs. Binarao
is a public School Teacher in Pasay while PO1 Binarao is policeman assigned in Las
Pinas City Police Station. Like other marriages, their relation commences with full of
happiness that even the nights becomes day glowing with hugs and kisses. But as the
days go by, their once happy family went awry. Their conjugal abode they called home
turned into a mixed martial-arts arena. A sweet melodious exchanging of words turned
into rap battle of humiliating invective words.

3. On October 14, 2015, Mrs. Binarao personally went to this office seeking both
legal and spiritual intervention of this office regarding their marriage. During the
mediation on October 27, 2015 before this office, both parties appeared presided by
PSINSP JOSEPH LEGAL AMOYO. They were given ample time to express respective
sides. Tears then begun to fall from Mrs. Binarao showing willingness to save their
marriage. PO1 Binarao held himself but later burst-out into tears also. Thus, this office
referred this case to the Chaplain Service for marriage counseling (See attached
memorandum marked as Annex “A”).

4. On March 1, 2016, the PNP Chaplain Service sent a feedback memorandum to


this office regarding the marriage counseling. Accordingly, the couple underwent a
marital counseling facilitated by NUP Salve Regina A. Vidal – Guidance Services
Specialist II. Furthermore, NUP Vidal suggested that the couple may continue to
undergo counseling at the Chaplain Service should they wish to (See attached memo
from Chaplain Service for AIG, IAS dated March 1, 2016).

IV. DISCUSSION:

5. The Philippine is the only Christian nation in South-East Asia. Our moral
standard is primarily anchored on our Christian belief. In a Christian nation, the family is
considered as the basic institution. Matthew 19:6: “So then, they are no longer two
but one flesh. Therefore what God has joined together, let not man
separate". Thus, in lieu of the Christian teaching, we submit every couple where their
marriage is on the verge of havoc for mediation in an attempt to save a family.

6. The parties involved having submitted themselves for mediation and marriage
counseling before the PNP Chaplain Service, this office finds it proper that this
investigation of this case be set-aside. After all, family’s welfare the paramount
consideration.

V. CONCLUSION:

7. With the advent of the mediation and result of marriage counseling, the
culpability of the PNP personnel involved no longer matters. Thus, this office has no
other recourse but to set aside the case without prejudice to the filing of the same in
the future should compelling circumstance warrant.

VI. RECOMMENDATION:

8. Whereas, it is respectfully recommended that this complaint against PO1 Lino


Z. Binarao be terminated.

9. Request approval of paragraph 8.
