ORDER

WHEREAS, on __, the ___ apprehended __ having a total volume of __ board

feet and an estimated value of __ at __;

WHEREAS, said forest products were apprehended on the ground that the
they were cut without the requisite authorization and/or supporting
documentation from the DENR. Thereafter, the forest products were deposited at
__for safekeeping under the custody of __. Seizure Order was duly issued on __;

WHEREAS, despite the notices of hearing duly posted, no claimant

appeared during the Administrative Confiscation Proceedings held on __.
Accordingly, the Administrative Adjudication Committee recommends the
issuance of confiscation order for the seized forest products as they were
presumed to be cut, harvested and gathered without a permit or clearance from
the DENR as required by P.D. 705 (Forestry Code of the Philippines).

WHEREAS, this Office sustains such recommendation. DENR Administrative

Order 97-32 provides that should the owner, claimant or other interested party fail
to appear at the Proceedings, such failure shall be deemed a waiver of the right
to appear. Consequently, the forest products shall now be considered
abandoned and confiscated in favor of the government.

WHEREFORE, premises considered, the seized __, now deposited at __, are
hereby CONFISCATED in favor of the government, to be disposed of in
accordance with existing rules and regulations on the matter. The same shall be
entered in the Books of Account following COA rules and regulations.
