Protestant

1. Based on the Statement of Votes by precint handed down by the BBOC of Brgy, 54,
Tacloban City, the protestant Bobby Martinez actually garnered a total number of 180
votes- Denied in so far as Morabe is concerned; In so far as Hinacay is concerned, while it
is true that the number of votes supposed to be garnered by protestant is 180, the same
is based on wrong tabulation of votes garnered by him, particularly in precinct 145-A
2. Despite such number of votes obtained by the protestant, the Brgy. Board of canvassers
through fraudulent manipulations still proceeded to proclaim protestees Erlinda Moralde
and Ashley Hinacay on May 14, 2018 as among the duly elected Sangguning Barangay
Mebers or Kagawad in the aforesaid Brgy. Taking the number 6th and 7th spot respectively-
Denied In so far as Moralde is concerned; In so far as Hinacay is concerned, we admit with
qualificatuion that it was based on the actual votes that was garnered by the candidates
and that there was no fraud.
3. That the 180 votes in the statement of votes by precinct correctly and properly counted
in favor of protestant were deliberately misread and/ or omitted and not credited to him
by the same BBOC in the Certificate of Canvass of VGotes and Proclamation- Denied
4. With respect to protestee Ashley Hinacay, at least 15 ballots in precint number 145A that
do not contain the name of protestee Ashley Hinacay were unlawfully and deliberately
read and counted in favor of the said protestee- Denied
5. That protestant garnered total votes of 70 in precinct 145A per Election Return and
Statement f Votes by Precinct- Denied
6. That protestee Ashley Hinacay only obtained a total of 165 votes per Certificate of
Canvass and Proclamation- Admitted.
