GENERAL AGREEMENT

2. FINAL PAYMENT
Final Payment is due and demandable at least three days before the event. Failure to settle the payment within
the agreed period shall subject the remaining balance to 1% interest per day.
3. COST
Due to the fluctuating cost of food items, menu prices are subject to change within thirty (30) days of the event.
When a drastic change in the menu ingredient cost occurs, CLIENT has two options:
3.1. CLIENT will pay the additional cost based on the current adjusted price, or
3.2. Substitute other menu items to maintain the agreed upon per person/platter menu.
4. PAYMENT METHOD
All prices quoted are based on cash payments.

4.1 Check payments are due three (3) banking days before the due date.
6. GUEST COUNT
6.1 Final Guest Count, not subject to reduction, is due fourteen (14) days prior to the event date. Any additional
guest(s) after the stated period is subject to extra charges as may be imposed by the CATERER.
6.2 CLIENT will only be charged for the final number of guests stated. In the event that the number of attendees
exceeded, the CATERER shall charge the CLIENT accordingly (Package Price + 15% surcharge/head).
7. FOOD QUANTITY
CATERER will prepare ten percent (10%), not exceeding 10pax, overage based on the final number of guest count
registered by CLIENT in case of unregistered attendees. CLIENT will not be charged for this unless it has to be served.
8. LEFTOVERS
In accordance with appropriate Health Codes, CATERER reserves the right to discard any leftover food items, after the
agreed upon event timetable, where there is a reasonable risk for food borne illness to occur. Should the CLIENT insists
on taking home leftovers, the CATERER shall not be held liable for any result that may occur after the event.
9. TIME
CLIENT will be billed for additional staff hours (Php150/staff/hour) for any time extension beyond the prior agreed
upon time. A special rate of P300/staff/hour shall apply for extensions beyond 12midnight.
11. ASSIGNABILITY
This contract is not assignable without the prior written consent from the CATERER.
12. CHANGE OF DATE AND CANCELLATION BY: CLIENT / VENUE / ACTS OF GOD
All deposits, except non-refundable booking fee, shall be returned in full if the event is cancelled by CLIENT, the
venue or by an act of God, 60 days or more, from the event date.
12.1. If the event is cancelled between forty (40) days and fifty nine (59) days from the event date, fifty
percent (50%) of deposits shall be returned to CLIENT.
12.2. If the event is cancelled, within thirty nine (39) days from the event date, all deposits and prepayments

are forfeited in full.
12.3. If CATERER is able to re-book the date with a similar event, all prepayments and deposits are returned
in full except for the non-refundable booking fee.
12.4. If the CLIENT requires event date to be moved, the CLIENT may do so with at least seven (7) days
notice. Failure to do so will incur rebooking fee of P500 to be deducted from the Security Bond.
12.5. CATERER reserves the right to approve Change of Date depending on the availability of the date.
13. DAMAGE
13.1. CATERER assumes no responsibility for ANY damage or loss of merchandise, equipment, furniture,
or other valuables prior to, during or after the event. CATERER will do everything possible to ensure that
CLIENT’s supplies, rentals and equipment are cared for and maintained in good working condition.
13.2. When providing the location for the event/function, the CLIENT, understands that accidents/breakage/
damage may sometimes occur. CATERER will not be liable for any damage or loss, unless specifically caused
by the willful negligent actions or conduct of CATERER or its employees.
13.2. The Booking Fee worth Five Thousand Pesos (Php5,000) also serves as a Security Bond wherein cost of
Breakages and Losses will be deducted.
