MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THIS PRESENTS:

This instrument entitled Memorandum of Agreement is entered


into this _____________, by and between:

Sta. Teresita Village Homeowners Association


Inc., with office address at Yumang St., Brgy. San Isidro,
General Santos City, represented by its President,
JOFFEL T. REMUDARO, hereinafter referred to as the
FIRST PARTY;

-and-

JONAS AMPER, with Filipino, of legal age, and a


resident of Sta. Teresita Village, Yumang St., Brgy San
Isidro, General Santos City, hereinafter referred to as the
SECOND PARTY.

WITNESSETH:

WHEREAS, the First Party is the owner of a parcel of land with transfer
Certificate Title No.147-2017019828 and 147-2017019830 located at
Yumang Street, Barangay San Isidro, General Santos City.

WHEREAS, the Second Party is a homeowner and a member of Sta.


Teresita Village Homeowners Association Inc.

WHEREAS, the First Party transferred and conveyed to the Second


Party a lot known as Lot No.10,Block No.4 and Lot no.12,Block No.4,
Sta. Teresita, Yumang St. Brgy. San Isidro, General Santos City.

WHEREAS, the First Party needs the continued support of its


homeowners/members, through their monthly due payments, for the
proper maintenance, record keeping and similar activities of the
Association.

NOW, THEREFORE, with these mutual presents and covenants, the


parties agree to do, perform, accomplish and abide by the following
conditions:

1. The First Party allows to have the portion of its land occupied by
the Second Party titled in his/her name.

2. The Second Party shall continue to be a member of good


standing of the Association.
3. The Second Party shall faithfully comply with his/her obligations
and duties to the Association.

4. The Second Party pledges his/her continued support to the


Association through the religious payment of the monthly
association fee.

5. The Second Party shall secure a written approval from the First
Party prior to his/her renovation, construction, or improvement
which structure should not be in excess of five (5) meters in
height.

6. The Second Party shall allot a parking space within the premises
of his/her lot for his/her vehicle of any kind and is prohibited from
parking the said vehicle on the road or any space considered as
easement for right of way.

7. The Second Party shall not lease, waive, sell, convey, encumber,
mortgage, dispose or transfer his/her right of possession to any
person without the written authority of the First Party. In case of
transfer of possession or title, the First Party is entitled to Ten
(10) percent share from the proceeds of the transaction.

8. In case the Second Party ceases to be a member of the


Association or. Fails to comply with any provisions or
agreements, the lot and improvements shall be reverted to the
First Party.

9. Non-payment of the dues, fees, assessment, charges and any


liability in favor of the Association shall constitute as a lien over
the property hereby appointing the First Party as his her
Attorney-in Fact for purposes of Act 3135, Extrajudicial
Foreclosure.

10. And the Parties hereby agree that this agreement shall
bind the heirs or successors-in-interest subject to the terms and
conditions stipulated herein.

IN WITNESS WHEREOF, the parties have hereunto set their


hands on the date and place first above written.

foregoing Memorandum of Agreement consisting of 2 pages, including

The parties acknowledged to me that the same is their free and


voluntary act and deed.
