Due Diligence & Title Report in respect of the land totally admeasuring 800
Sq.yards (400 Sq.Yards each), bearing Plot Nos. 21 & 22 in Survey Nos. 551, 552
and 559, situated at Pakalakunta Hamlet of Alwal Village, Alwal Municipality,
Malkajgiri Mandal, Ranga Reddy District.

A. Description of the Property

All that the land admeasuring 400 Sq.Yards, bearing Plot No. 21 in Survey Nos.
551, 552 and 559, situated at Pakalakunta Hamlet of Alwal Village, Alwal
Municipality, Malkajgiri Mandal, Ranga Reddy District and bounded by:

Flow of Title

So far as tracing of title to the Item Nos. 1 and 2 of the Schedule Property is
concerned, originally, 1) Mohd. Moinuddin Hasan, 2) Ms. Noor Jehan Begum, 3)
Sri M.A. Subhan, 4) Sri M.A. Abbas, 5) Sri M.A. Kayum, 6) Sri Mohd. Arif, 7) Sri
Mohd. Younus, 8) Sri Mohd Ayub and 9) Sri Mohd Ibrahim, sold land totally
admeasuring Ac. 5.00 Guntas, in Survey Nos. 552/Part, 553 Part, 554/Part,
556/Part, 557/Part, 558/Part, 561/Part and 570/Part, situated at Alwal village,
Alwal Municipality, Malkajgiri Mandal, Ranga Reddy District, to M/s.
Navabharath Co-operative Housing Society, Rep., by its President Sri Narsing
Rao, through registered Sale Deed bearing No. 3186 of 1998 dated 09.11.1998,
registered with the Office of Sub-Registrar, Vallabhnagar.

As seen from the recitals of the above said document, it is recited that 1) Mohd.
Moinuddin Hasan, 2) Ms. Noor Jehan Begum, 3) Sri M.A. Subhan, 4) Sri M.A.
Abbas, 5) Sri M.A. Kayum, 6) Sri Mohd. Arif, 7) Sri Mohd. Younus, 8) Sri Mohd
Ayub and 9) Sri Mohd Ibrahim, are the Inamdars and Pattadars of the above said
property and that they have applied to the Revenue Divisional Officer, Chevella to
issue a Patta Certificate and the RDO after conducting enquiry issued Patta
Certificates in their favour in File Nos. 1/2542/1975 dated 04.03.1983 in
accordance with the provisions of the A.P. (Telangana Area) Abolition of Inams
Act, 1954. Further it is also recited that the above said order was implemented by

Mandal Revenue Officer, Malkajgiri in revenue records through ORC No.
L/2543/1975 dated 03.03.1983, followed by the Proceedings of MRO Malkajgiri
regarding the surrender of rights by Protected Tenants (P.T.s) and their successors
through Letter No. B1/2002/98 dated 30.06.1998.

Thereafter, the Nava Bharath Co-operative Housing Society Limited, Rep., by its
President Sri V. Narsinga Rao, sold the land admeasuring 400 Sq.Yards, bearing
Plot No. 21 in Survey Nos. 551, 552 and 559, situated at Pakalakunta Hamlet of
Alwal Village, Alwal Municipality, Malkajgiri Mandal, Ranga Reddy District,
(Item No.1 of Description of Property), to Sri. Yellina Subba Rao, through
registered Sale Deed bearing No. 1701/1998, dated 06.07.1998 registered with the
Office of Sub-Registrar, Vallabhnagar.

Further, Nava Bharath Co-operative Housing Society Limited, Rep., by its


President Sri V. Narsinga Rao, also sold the land admeasuring 400 Sq.Yards,
bearing Plot No. 22 in Survey Nos. 551, 552 and 559, situated at Pakalakunta
Hamlet of Alwal Village, Alwal Municipality, Malkajgiri Mandal, Ranga Reddy
District, (Item No.2 of Description of Property), to Sri Addepalli Naga Laxmana
Raja, through registered Sale Deed bearing No. 1704/1998, dated 06.07.1998
registered with the Office of Sub-Registrar, Vallabhnagar.

As seen from the recitals of the above said Sale Deeds bearing Nos. 1701/1998
and 1704/1998, it is recited that Nava Bharath Co-operative Housing Society
Limited had purchased the land in Survey Nos. 13, 547 to 552, 559, 563, 564, 565,
567 to 570, 572 to 574, 576 to 580 and 585 of Pakalakunta, Hamlet of Alwal
Village, Ranga Reddy District, totally admeasuring Ac. 121.07 Guntas from the
pattadars Gulam Mohinuddin and 19 Others by an Agreement of Sale dated
07.06.1973. It is also recited that the Society could not get the land transferred
from the pattadars due to the delay in subsequent proceedings before the RDO
Chevella for giving Occupancy Certificate in favour of the pattadars and in
between the UCL Act has come into force which required filing of declarations
before the authorities and obtained Clearance vide Nos. G1/13087/76,
G1/13089/76 to G1/13092/76, G1/8931 to G1/8938/76, G1/8920/76, 8927, 8928,
8945, 8924 and 8927/76 dated 30.01.1996, and after issuance of orders under
Section 5-A of the A.P. Record of Rights Act, the Society perused with the
concerned revenue authorities and mutated its name vide Proceedings No.
ROR/3258/89 dated 08.01.1996 issued by MRO, Malkajgiri.

As seen from the Endorsement bearing No. G1/8920/76 (Application No.


G1/747/767/08) dated 22.11.2011, issued by Special Officer & Competent
Authority, Urban Land Ceiling, Hyderabad, it is evident that the land admeasuring
334.44 Sq.Mts., on Plot No. 21 in Survey Nos. 551, 552 & 559, situated at

Pakalakunta Hamlet of Alwal Village, Alwal Municipality, Malkajgiri Mandal,
Ranga Reddy District, was allotted to Sri. Yellina Subba Rao.

As seen from the Endorsement bearing No. G1/8920/76 (Application No.


G1/747/101/08) dated 22.11.2011, issued by Special Officer & Competent
Authority, Urban Land Ceiling, Hyderabad, it is evident that the land admeasuring
334.44 Sq.Mts., on Plot No. 22 in Survey Nos. 551, 552 & 559, situated at
Pakalakunta Hamlet of Alwal Village, Alwal Municipality, Malkajgiri Mandal,
Ranga Reddy District, was allotted to Sri Addepalli Naga Laxmana Raja.

It is pertinent to mention here that in the above said Endorsements, it is clearly


captured at Para 5 “that the allotment made by the Government shall be conclusive
proof of the title of the occupant over such excess land allotted.”

Therefore, the above said allotments made by the Government shall be conclusive
proof of title of the above said owners over such excess lands allotted and by
virtue of the said allotments 1) Sri. Yellina Subba Rao is the absolute owner and
possessor of Item No.1 of Description of Property and Sri Addepalli Naga
Laxmana Raja is the absolute owner and possessor of Item No.2 of Description of
Property.

As seen from the LRS Proceedings bearing No. LRS/164/C-16/NZ/GHMC/2013


dated 19.11.2013 along with plan, issued by Commissioner, GHMC, GHMC, it is
evident that Sri. Yellina Subba Rao got regularized the unapproved layout/Plot No.
21, admeasuring 334 Sq.Mts, in Sy.Nos. 551, 552 and 559, situated at Pakalakunta
Hamlet of Alwal Village, Alwal Municipality, Malkajgiri Mandal, Ranga Reddy
District, (Item No.1 of Schedule Property).

As seen from the LRS Proceedings bearing No. LRS10022017110306 dated


10.02.2017 along with plan, issued by Zonal Commissioner, North Zone, GHMC,
it is evident that Sri Addepalli Naga Laxmana Raja got regularized the unapproved
layout/Plot No. 22, admeasuring 334 Sq.Mts, in Sy.Nos. 551, 552 and 559,
situated at Pakalakunta Hamlet of Alwal Village, Alwal Municipality, Malkajgiri
Mandal, Ranga Reddy District, (Item No.2 of Schedule Property).

Part IV
Observations

To ascertain more clarity on title, it is advised to obtain and verify the below
mentioned documents:

a) Patta Certificates in favour of the Vendors under Sale Deed No. Sale Deed
bearing No. 3186 of 1998 dated 09.11.1998 in File Nos. 1/2542/1975 dated

04.03.1983 in accordance with the provisions of the A.P. (Telangana Area)
Abolition of Inams Act, 1954.
b) ORC No. L/2543/1975 dated 03.03.1983
c) Proceedings of MRO Malkajgiri regarding the surrender of rights by
Protected Tenants (P.T.s) and their successors through Letter No.
B1/2002/98 dated 30.06.1998.
d) Proceedings No. ROR/3258/89 dated 08.01.1996 issued by MRO,
Malkajgiri, in favour of Nava Bharath Co-operative Housing Society
Limited.
e) Land Use Information.
f) Latest Encumbrance Certificate.

Part-V
Opinion

Therefore, in view of all the above, subject to compliance of the above


observations, Sri. Yellina Subba Rao is the absolute owner of Item No.1 of
Description of Property and Sri Addepalli Naga Laxmana Raja is the absolute
owner of Item No.2 of Description of Property.
