    This Grievance of the Parties is filed by AFGE Council 238 under Article 38 of the MCBA between AFGE Council 238 and EPA. On June 17, 2019 the union learned, among other things, that the agency did not intend to follow the 2013 MOU Ground Rules for Negotiations and Addendum to the Ground Rules and wants to increase the number of articles to be reopened.     Dear Ms. Corbett:

    This Grievance of the Parties is filed by AFGE Council 238 under Article 38 of the MCBA
    between AFGE Council 238 and EPA. On June 17, 2019 the union learned, among other things,
    that the agency did not intend to follow the 2013 MOU Ground Rules for Negotiations and
    Addendum to the Ground Rules and wants to increase the number of articles to be reopened.

    This is a violation of the parties Ground Rules MOU and Addendum to the Ground Rules
    thereto.

    As a remedy the union is seeking the following:


    • That the agency ceases and desist all actions attempting to re-open articles not previously
    agreed to.
    • That the agency begins negotiations as soon as possible on previously agreed articles to
    be reopened.
    • That the comply with the 2013 MOU Ground Rules for Negotiations and Addendum to
    the Ground Rules.
