This CONTRACT OF LEASE (“Contract”) is made and entered into between:

WITNESSETH

WHEREAS, the LESSOR is the legal and absolute owner of a 2 Bedroom with balcony
condominium unit designated as Unit ____ at the ______, hereinafter referred to as the “LEASED
PREMISES” located at _______ with an area of ____ square meters as well as the furnishing listed in the
schedule attached hereto as Annex “A” (the “Furnishings”)

WHEREAS, the LESSEE desires to lease the LEASED PREMISES and the LESSOR is willing to
lease the same unto the LESSEE subject to the terms and conditions hereinafter specified:

NOW, THEREFORE, for and in consideration of the forgoing and the mutual covenants
hereinafter contained, the LESSOR has let and by these presents does hereby let and lease unto the
LESSEE the LEASED PREMISES, together with the Furnishings and the LESSEE hereby accepts the
same by way of lease, subject to the following terms and conditions:

1.TERM – This Contract shall be for a period of 12 Months (1 year) commencing on _____to _____
renewable upon mutual agreement of the parties, provided the LESSEE serves written notice to the
LESSOR of his intention to renew at least thirty (30 days) before the expiration of this Contract, provided
further that, the LESSEE shall have faithfully complied with all the terms and conditions of this Contract. If
the LESSEE terminates this Contract ahead of the aforementioned period, full deposit will be taken from
the LESSEE.

2. RENTAL RATE AND PAYMENTS – The parties herein agree that the monthly rental for the LEASED
PREMISES shall be Philippine Pesos: _______ PESOS (PHP_______) INCLUSIVE of association dues
(P___) but EXCLUSIVE of utilities expense (water & electricity)

3. The lessee needs to pay to the lessor thru Post Dated Cheques on or before every ___ of the month

 Condo dues & cable connection payment shall be c/o of LESSOR
 Water charges shall be paid by LESSEE thru the condo administration office regularly, on
a monthly basis, prior to deadline. Billing/Statement of Account (SOA) shall be picked up
by tenant at the condo tenant mailbox (located at the lobby area) on a monthly basis.
SOA is released every ______of the month. Due date is every ______ of the following
month
 Meralco electricity charges shall be paid by tenant thru any authorized payment center
(e.g. BDO bills payment) prior to deadline on a monthly basis. Billing/Statement of
Account (SOA) shall be picked up by tenant at condo tenant mailbox on a monthly basis.
SOA is released every ______of the month.

 Copies of the water & Meralco payment receipt must be kept by tenant for reference (in case of
dispute).

4.DEPOSIT: That the LESSEE shall deposit to the LESSOR upon signing of this contract and prior to
move-in an amount equivalent to the rent for THREE (3) MONTHS (1st month payment, 2 months
security deposit) or the sum of PESOS: ______ (______), Philippine Currency less P______
reservation fee initially paid last ______.

Wherein the two (2) months security deposit shall answer partially for damages and any other obligations,
for utilities such as water, electricity or resulting from violation(s) of any of the provision of this contract.
Payment for such obligations shall be deducted from the security deposit and the balance, if any, shall be
refunded to the LESSEE not later than sixty (60) days from termination of this Lease, after proper
settlement of accounts noted herein.

5. WATER, ELECTRICITY, AND OTHER UTILITIES – All utility charges due on the LEASED PREMISES
such as water, electricity, etc. shall be for the exclusive account of the LESSEE. The cost of the routine
cleaning and maintenance of the air-conditioning units & grease trap shall likewise be for the LESSEE’s
exclusive account.

The reading meter of water and electricity will be executed upon the day of turnover of the unit. Payment
due for the said utilities will be paid by the LESSOR or the authorized representative before LESSEE
moves in.

6. TERMINATION – The LESSOR has the option to terminate or cancel this contract of and when said
premises are used for purposes other than what is stipulated and agreed upon without the prior written
consent of the LESSOR.

7. PRE-TERMINATION – In the event of the Lessee terminates this contract prior to its expiration,
it is expressly understood and agreed that the rental payments paid in advance but unused shall
be forfeited by the LESSEE in favor of the LESSOR.

8. ASSIGNMENT AND SUBLETTING – Lessee shall not assign this agreement or sublet any portion of
the premises without prior written consent of the LESSOR.

9. REPAIRS, ALTERATION, ADDITIONS, ETC. The LESSEE shall not make alteration, additions, or
improvements without the prior written consent of the LESSOR. All alterations, additions or improvements
made to the premises with the written consent of the LESSOR shall become the property of the LESSOR
and shall remain upon and be surrendered with the premises.

10. ORDINANCE AND STATUTES – The LESSEE shall comply with all statutes, ordinances and
requirements of ____ Residences Condominium Corporation and all Municipal, state and national
authorities now in force, or which may hereafter be in force, pertaining to the use of the LEASED
PREMISES.

11. SIGN, ADVERTISEMENT, ETC. – The LESSEE shall not affix, inscribe or pain any notice, sign or
other advertisement medium on any part of the inside or outside of the building except on prior written
permission from the LESSOR, and then only of such size, color, style as the latter may determine.

12. PROHIBITIONS – The LESSEE shall not bring into or store in the LEASED PREMISES anything
obnoxious or of highly inflammable nature or explosive materials, not install therein any apparatus,
machinery or equipment which may cause tremors or noise or expose the leased premises to fire and
increase the fire hazard of the building.
 LESSEE and his companions are not allowed to smoke inside the unit and other enclosed areas
in the condominium building. They may do so at the balcony area and other allowed open
spaces. (Please refer to _____ Residences House Rules for other important guidelines.)

13. LIABILITY FROM SUITS, ETC. – the LESSEE shall indemnify and hold harmless the said LESSOR
against all actions, suits, damage and claims by whomsoever that maybe brought or made by reason of
the non-observance or non-performance of the said rules, regulations, ordinance or laws or of any of the
covenants of this section, without prejudice to the right of the LESSOR to cancel

14. THE LESSOR SHALL NOT BE LIABLE NOR RESPONSIBLE

A. For the presence of bugs, vermin, ants, termites, insects if any in the LEASED PREMISES
B. For the failure of water supply and/or electrical current, grease trap, & air conditioning unit
C. For the injury, loss or damage which the LESSEE, his agents or employees might sustain in
the LEASED PREMISES due to any cause of whatsoever;
D. For any damage done or occasioned by, or arising from plumbing, has, water, and/or other
pipes nor for any damage arising from negligence of the LESSEE or its agents, employees,
representatives or any and all other persons; and
E. For any damage which may be caused to the person or property of third persons while
remaining either casually or on business in any part of the LEASED PREMISES to the
LESSEE, and the LESSEE further binds itself to hold the LESSOR free harmless for any
such claim for injury or damage

15. FIRE – In case of damage to the LEASED PREMISES or its appurtenances by fire, earthquake or any
other unforeseen cause, the LESSEE shall give immediate notice to the LESSOR. Should the leased
premises be damaged by fire or other cause without the fault or negligence of the LESSEE, or its agents,
clerks or visitors, the damage shall be repaired at the expense of the LESSOR, as speedily as possible,
after such notice, but in the building or the leased premises be so nearly destroyed as to make it
untenable without the neglect of the LESSEE, either party may demand the rescission of this contract. No
compensation of claim shall be allowed against the LESSOR by reason of inconvenience, annoyance or
injury to the business arising out of the necessity of repairing any portion of the building whenever the
necessity may arise

16. INSPECTION OF PREMISES. On an appropriate agreement with the LESSEE, the LESSOR or its
authorized agent shall have the right to enter the leased premises during business hours to examine the
same or make alterations or repairs or for any purpose, which may deem necessary for the operation or
maintenance of the building or its installations and during the last three months of the terms of the lease
to exhibit the leased premises to prospective tenants.

17. TERMINATION OF LEASE. The LESSEE agrees to return and surrender the LEASED PREMISES at
the expiration of the term of this Contract in as good condition as reasonable wear and tear will permit,
and without any delay whatsoever, devoid of all occupants, furniture, articles and effects of any kind other
than such alterations, additions or improvements which the LESSOR may elect to take.

18. MISCELLANEOUS PROVISION. The LESSEE further agrees and undertakes that he shall abide by
the additional rules of the Jazz Residences Condominium Corporation.
