Adoption of DAO No. 2016-08 as the New Effluent
Standards for the Continuous Implementation of the
EUFs and the WQ Guidelines for Surface Waters within
the LDBR and for other purposes

Background

 The DENR adopts and promulgated DENR Administrative


Order No
No.. 2016
2016--08 pursuant to Republic Act No No.. 9275
otherwise known as the Philippine Clean Water Act of 2004

 Covers both Water Quality Guidelines (WQG) and General
Effluent Standards (GES)

 New parameters have been added and some parameters
are more stringent than the previous DAO

Introduction

 WQG refer to level or numerical values of physical,


chemical, biological, and bacteriological/ radiological
parameters which are used to classify water resources and
their use, which do not result in significant health risk.
 GES is any legal restriction or limitation on quantities, rates,
and/or concentrations or any combination thereof, of
physical, chemical, biological, and bacteriological
parameters of effluent which a person or point source is
allowed to discharge into a body of water or land; that is
applicable to all industries category.

Water Quality Guidelines
(WQG)
 Under the new DAO, water quality guidelines are set for
each type of water body (fresh, marine and ground water)

 For instance, a river classified as Class A, intended for a
public water supply, must have a BOD of 3 mg/L and a
minimum dissolved oxygen level of 5 mg/L, among other
parameters..

General Effluent Standards
(GES)

For effluent standards (treated wastewater discharge into


bodies of water), there is now a major change in policy.

 Under the old guidelines in DAO 35, general standards for


all type of effluents are the same.

 In the new guidelines, significant effluent quality


parameters for each industry type are specified. They are
based on the most probable pollutant that a type of industry
will discharge into the environment.
General Effluent Standards

 The DAO provides a list of significant effluent quality


parameters per sector (Note: parameters that are not on
the list but are deemed significant should still be included in
its monitoring).
 Conversely, parameters that are not expected in a
company’s material or waste streams may request for
exclusion. The new DAO provides the process for such
request.
 The GES applies to all point sources of pollution, regardless
of volume, that discharge to receiving body of water or
land, and shall be used regardless of industry category.
General Effluent Standards
Examples of GES for certain industry groups:
 Paper and paperboard milling (PSIC Code #17013) -
Color, Temperature, pH, COD, TSS, Nitrate, Phosphate,
Ammonia, Barium, Boron, Chloride, Arsenic, Cadmium,
Chromium, Copper, Lead, Mercury and Zinc.
 Hotels, motels, resorts, dormitories and other
accommodation services (PSIC Code #55) will be
monitored for BOD, Fecal Coliform, Ammonia, Nitrate,
Phosphate, Oil & Grease, and surfactants.
These significant parameters however can still be modified
through an appeal to the DENR Secretary. The EMB will
determine if such request is valid.

 For establishments with influent BOD equal to or greater
than 3,000 mg/L and receiving water body is Class C, D, SC,
or SD, the applicable effluent standards in Table 10 shall at
all times be enforced and complied with

Grace Period

 The DAO has provision for a 5-year grace period to be able


to fully comply with the GES

a) Values for the GES have become stringent compared to
the values in DAO 1990

Grace Period
 Within said period, a moratorium is in effect which
includes issuance of cease and desist and/or closure
order, fines, and other penalties against
establishment’s operations.
 The establishment shall need to submit Compliance
Action Plan and periodic status of implementation to
the DENR on the steps taken for the establishment’s
compliance schedule within the prescribed grace
period.
 Note however, that DAO 35 remain in effect for
parameters that have more stringent requirements
in the new GES.
Fines, Damages and Penalties

 Any person, both natural or juridical, found violating or


failing to comply with any Order or Decision of the
Department and/or Pollution Adjudication Board or any
provision of this Order, shall be liable under Section 28 of
RA 9275, in the amount of:
 PHP 10,000 per day of violation (minimum)
 PHP 200,000 per day of violation (maximum)
 The fines herein prescribed shall be increased by 10% every
two (2) years to compensate for inflation and to maintain
the deterrent function of such fines.
GES implementation within the
Laguna de Bay Region
 RA 4850, as amended, empowers the LLDA to issue rules
and regulations as may be necessary to effectively carry out
its mandates;
 The LLDA Board of Directors has the power to formulate,
amend and repeal rules and regulations to govern the
conduct of business of the Authority.
 THEREFORE, the adoption of DENR DAO
2016-08 for implementation within the
Laguna de Bay Region has to be approved
first by the LLDA Board of Directors.
