JUDICIAL AFFIDAVIT

This judicial affidavit of Loida M. Paczon, Filipino, of legal age and

with postal address at 32 Alexandria St., Queensland Subd., Brgy.
Nagkaisang Nayon, Novaliches, Quezon City, is executed to constitute her
direct testimony in the instant petition.

This Judicial Affidavit is being offered to prove:

A. That witness-affiant being the petitioner herself is competent to

testify on the facts and documents involved or related to the
issues raised in the Petition;

B. The material allegations contained in the Petition, and to

identify the documentary evidences appended hereto;

C. All other related matters, facts, circumstances, documents

relevant and material to the issues raised in the Petition.

This Judicial Affidavit was taken at the office of the counsel-located

Unit 200 ACRE Building, 137 Malakas St., Diliman Barangay Central 1100,
Quezon City;

The questions are prepared by Atty. Rosalinda A. Montenegro,

numbered consecutively and followed by the answers thereto by the
witness-affiant, thus:

Q1 Do you swear to tell the truth, the whole truth and nothing but the
truth in these proceedings?
A1 Yes, Sir.
Q2 Are you aware that you are under oath and that you may be held
criminally liable for false testimony you may give in these
proceedings?
A2 Yes, Sir.

Q3 Are you the same Loida M. Paczon, the Petitioner in the instant
Petition docketed as LRC CASE NO. 8843-2018-07?
A3 Yes, Sir.

Q4 Can you tell the Honorable Court the reason why you filed the
Petition?

A4 Yes, Sir. I filed the Petition so that I could obtain a new owner’s
duplicate original certificate of title on the subject property under
my name, Sir.

Q5 What right you have on the lot in question that would justify the
issuance of new owner’s duplicate original certificate of title
thereof in your name, if any?

A5 I am the lawful owner of both lots described in the certificate of

title, Sir.

Q6 What proof do you have that you are the registered owner of the
subject properties?

A6 I have a Deed of absolute Sale over the two (2) properties and
after which I caused its registration at the Registry of Deeds of
the province OF Cavite. Then Transfer Certificate of Title No. T-
461439 and T-461440 were issued under my name Sir.

Q7 I’m showing you copy of Deed of Absolute sale executed by one

Loida M. Paczon, What relation this copy of the Deed of Absolute
Sale has to the one you are referring to if any?

NOTE: This is the same Deed of Absolute Sale that I am referring to, Sir.
The Deed of Absolute Sale is hereto attached as Annex “C”

Q8 What other competent evidences that you have to prove

ownership?

A8 I secured a certified copy of Tax Declaration of Real Property

from the Office of the City Assessor of Quezon City, Sir.

Q9 I show you a certified copy of Tax Declaration of Real Property.

What relation this certified copy of Tax Declaration, to the certified
copy you mentioned, if any?

A9 This is the same certified copy of Tax Declaration of Real

Property I am referring to, Sir.
Note: The certified copy of Tax Declaration of Real Property is hereto
attached as Annex D.

Q10 Did you pay the property taxes of the subject lot for the current
year?

A10 Yes, Sir.

Q11 What is your proof, if any, that would show that the real property
taxes of subject lot has been paid for the current year?

A11 A certification from the City Treasurer’s Office of Bacoor City was
issued showing that the real property taxes on subject lot was
paid up to the period 2017, Sir.

Q12 I show you a certified copy of the Certification issued by the City
Treasurer’s Office of Bacoor City dated December 6, 2017. What
relation this certified copy of Certification, to the certification you
mentioned, if any?

A12 This is the same Certification I am referring to, Sir.

NOTE: The certified copy of Certification issued by the City Treasurer’s

Office of Bacoor City dated December 6, 2017 is hereto attached
as Annex “G”

Q13 What did you do upon learning that the copy of your owner’s
duplicate original Transfer Certificate of Title No. T-461439 and
T-461440 in your custody was missing, if any?

A13 I consulted a lawyer on what to do and she advised me to execute

and affidavit of loss and have it annotated at the back of the title.

Note: An Affidavit of Loss is hereto attached as Annex “H”

Q14 What else happen if any?

A14 I requested a certification from the barangay to certify that the

typhoon Ondoy washed all my documents.

Note: A copy of the Certification from the barangay is hereto attached

as Annex “I”

Q14 At the back of the title there is an annotation of mortgage, what

can you say about that?

A14 The mortgage was already Discharged as evidence by Annex “J”

 The Discharge of Mortgage. The property is now a clean title and
is not encumbered, sold or transferred to any third person.

Note: The discharged of Mortgage is hereto attached as Annex “J”

Q15 Do you have anything more to add?

A15 No more for now.

ATTESTATION

I Atty. Rosalinda A. Motenegro, Filipino, of legal age, with

residence at Unit 200 ACRE Building, 137 Malakas St., Barangay Central,
1100, Quezon City, under oath declare:
That I faithfully recorded the questions ask to and the corresponding
answers thereto by the above named witness;
That neither I nor any other persons present during the examination
coached the witness in answering the questions.
