APPROVAL OF SALE OR MORTGAGE OF PATENTED LANDS

(Section 121 and 122, C.A. No. 141, as amended, implemented by


DENR Circular No. 01 dated October 5, 1994)

Checklist of Requirements:

1. Letter-request for approval of sale/mortgage address to CENRO concerned


2. Certified true copy of the Certificate of Title (OCT or TCT) by the Register of Deeds
3. Affidavits
a) To be executed by the vendor that the land covered thereby is free from any
liens or encumbrances;
b) To be executed by the vendor stating that the land is free from claims and
conflicts;
c) To be executed by the vendor that the land is not tenanted and if tenanted, the
extent of the land tenancy; and
d) To be executed by the vendor declaring how he/she acquired ownership of the
land sold and in case of purchase, previous approval must be attached to the
records;
e) To be executed by the vendee declaring the extent of her/his landholdings and
the landholdings of the spouse either jointly or singly including the land subject
of the sale;
4. Deed of Absolute Sale/Mortgage
5. Three (3) copies of tax declaration duly certified by the Assessor’s Office concerned
6. Certification of CENRO Records Officer indicating the name of the original patentee,
kind of patent issued, identity, area and location
7. Additional requirements if vendee is a corporation:
a) Three (3) copies of Articles of Incorporation duly certified by concerned official;
b) Three (3) copies of SEC registration certificate duly certified by SEC;
c) Affidavit of specific purpose for which the land subject of the sale will be used;
d) Feasibility studies and development plan of the land;
e) Environmental Compliance Certification;
8. Proof of payment of approval fee per DAO 20, series of 1993
a) P 10.00 per ha. for assignment of rights to agricultural lands covered by free
patent application but in no case less than P 100.00 per application;
b) P 20.00 per ha. applied for agricultural, educational, religious or charitable
purposes, but in no case less than P 150.00 nor more than P 2,500.00 per
application;
c) P 200.00 per application for the first 1,000 sq. m. or fraction thereof of lands
applied for residential, commercial, industrial or similar purposes plus P 20.00
per 100 sq. m. fraction thereof in excess of 1,000 sq. m. but in no case more
than P 2,000 per application
MANDATORY REQUIREMENTS FOR THE APPROVAL OF SALE OR
MORTGAGE OF PATENTED LANDS

A. Mandatory Requirements

1. Letter Request for approval of sale or mortgage addressed to


CENRO/PENRO/RED
2. Three (3) copies of Affidavit of Non-Tenancy and Non-Claims and Conflicts of the
land; also stating that it is free from any liens and encumbrances
3. Three (3) copies of the Deed of Sale/Mortgage
4. Three (3) copies of owner’s duplicate copy of OCT/TCT duly certified by the
Register of Deeds
5. Three (3) copies of the Tax Declaration duly certified by the Assessor’s Office
concerned
6. Three (3) copies of the Affidavit of Vendee declaring the extent of his/her
landholdings and the landholdings of the spouse either jointly or singly including
the land subject of the sale which should not exceed five (5) hectares as
prescribed by R. A. 6657 (CARP Law)
7. Certification from the CENRO Records Officer indicating the name of the original
patentee, the kind of patent issued, its identity, area and location

B. Additional requirements if vendee is a Corporation

1. Three (3) copies of duly certified Articles of Incorporation


2. Three (3) copies of duly certified Securities and Exchange Commission (SEC)
3. Affidavit of Specific Purpose for the land subject of the sale will be used
4. Feasibility Studies and Development Plan of the land
5. Environmental Compliance Certificate
