THESIS PROPOSAL

Title : An Assessment on the Effect of Road Right-of-Way (RROW) in the


Implementation of National Government Infrastructure Projects

Problem Statement:

Road Right-of-Way (RROW) issues and concerns is a rampant problem in every National
Government Infrastructure Projects in the country whether it is a road opening specifically a
Bypass, Diversion, Missing Links or road widening projects. Project implementation and
completion was stalled due to unresolved Right-of-Way (ROW) problems. It is one of the major
reasons for time suspension which delayed the physical accomplishent of the project. However,
it is very clear on various Laws and Department Orders issued that Right-of-Way (ROW) must
secure prior to the implementation of project. All private properties shall be compensated prior
to the implementation of project. Hence, Right-of-Way (ROW) issues and concers must not
hamper nor cause the delay of projects to be implemented.

For widening projects, Right-of-Way (ROW) issues and concerns also arises during project
impelentation eventhough Right-of-Way (ROW) of existing National Roads were already
stablished. Structures/Improvements within the Right-of-Way (ROW) limit have secured
Building Permit which is prohibited under the law. Many lots within the Right-of-Way (ROW) are
titled private property.

The pipeline of water service providers and the presence of obstructive poles of electric service
providers give post danger to the motorist and add to the issues and concerns on Right-of-Way
which also affects the implementation of projects.

Research Objectives:

This study also sought to determine and assess the following:

1. Provide a comprehensive study for one of the major problems encountered in the
implementation of road opening and road widening projects.

2. Analyse the statistical association between Right-of-Way issues and concerns and the
delayed completion of road projects.

3. Determine how the Project Engineer, Field Engineer, Project Engineer and Resident
Egineer deal and manage in settling Right-of-Way issues and concerns that they
encountered prior and/or during the implementation of projects.

4. Provide precautionary measures how to lessen the effect of Right-of-Way issues and
concerns in the implementation of projects.
Sub Objectives:

This study also sought to determine and assess the following:

1. Determine the factor that causes the delayed compensation in Right-of-Way acquisition
in terms of Legal Documentation for:
a. Lot
b. Structures/Improvements
c. Trees and Crops

2. Provide possible solution to fast track the acquisition of all private properties that will be
affected by road opening projects (Bypass, Diversion, Missing Link Roads, etc.).

3. Determine the compensability of outstanding claims that arises during widening of


existing national roads.

4. Determine how Building Official issued Building Permit for structures/improvements such
as residential houses, business establishments, etc. that are within the Road Right-of-
Way limit.

5. Assess the effects of obstructive poles and pipelines of electric and water service
providers in the implementation of projects.
