LEASE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This agreement, dated May 1, 2019, is between PAULINO E. MENDOZA JR. and
WYETH PAUL E. MENDOZA residents of 058 MAGAT SALAMAT EAST, LAOAG
CITY, 2900 PHILIPPINES and _____________________________, owner and/or
managing partners of BROOKSIDE LAOAG BED AND BREAKFAST at MAGAT
SALAMAT EAST, LAOAG CITY, 2900 PHILIPPINES:

1. LANDLORD:
The Landlords will be referred to this agreement as “Landlord”
PAULINO E. MENDOZA JR. (Landlord)
WYETH PAUL E. MENDOZA (Landlord)

2. TENANT:
The Tenant(s) is/are:

who are the owner(s) and or managing partner(s) of Brookside Laoag Bed and
Breakfast and will be referred to in this agreement as “Tenant.”

3. RENTAL PROPERTY:
The Landlord agrees to rent to the Tenant the empty lot property located at
MAGAT SALAMAT EAST, LAOAG CITY, 2900 PHILIPPINES bound by lot #
23515-B-2, which will be referred to in this agreement as “Leased Premised.”

4. TERM OF LEASE AGREEMENT:


The term of this agreement will begin on May 1, 2019, and will end on April 30,
2022.

5. USE & OCCUPANCY OF PROPERTY:


● The Tenant will undertake only activities that abide by the laws and
regulations of the Philippines.
● There are no permanent structures that will be erected by the Tenant
within the Leased Premises.
● The Tenant cannot transfer rights of use as stipulated on this agreement to
any other person or entity.
● Any temporary structure that has been erected in the premises will be
removed by the tenant at their own expense within the 30-day contract
termination grace period.

6. AMOUNT OF RENT:
The amount of rent will be PHP2,000 per month. The said amount will be
deposited by the Tenant to the Landlord’s BDO Savings Account -
000840395507, under Wyeth Paul Mendoza.

7. DATE RENT IS DUE:


The rent is due in advance on or before the day of each month. The rent due date
is the date the Landlord must receive the Tenant’s payment.

8. LATE FEE:
If the rent or any other charges are not received by the Landlord on or before 5
days after the rent due date, Tenant must pay a late fee of PHP 100 in addition to
the rent. 3 consecutive months of missed payments constitute a breach of contract
therefore gives the Landlord the right to evict the Tenant, at the Tenant’s expense.

9. RETURNED PAYMENTS
There are PHP 0 returned payment fees, however, any personal check will not be
accepted as payment to replace a returned payment
10. SECURITY DEPOSIT
There are no security deposits paid to the Landlord to cover the cost of damages.
Therefore, Tenant will be required to fix any damage to the property or cleaning
required at the end of this agreement.

11. UTILITIES & SERVICES:


A. The Tenant is solely responsible for electricity or any other utility that will
be used within the Leased Premises.
B. The Tenant is solely responsible for any services rendered on the Leased
Premises during the term of this agreement.

12. MAINTENANCE AND REPAIRS:


Tenant will be solely responsible for maintenance and repairs of any and all issues
that may arise with the use of the Leased Premises during the term of this
agreement.

13. CONDITION OF PROPERTY


The Tenant acknowledges that the Leased Property is in good condition upon
commencement of this Agreement. The Tenant agrees to return Premises to
Landlord at the end of the Agreement in the same condition it was at the
beginning of the Agreement.

14. ENDING OR RENEWING THE LEASE AGREEMENT


At the end of this Agreement, if and when the Landlord or the Tenant does not
give any written notice to the other party to end this Agreement, it will
automatically continue on a month-to-month basis. To terminate this Agreement
at the end of the lease term or any renewal thereof, the Landlord or the Tenant
must give to the other party at least 30 days prior written notice before the last day
of the lease term or any renewal thereof.

15. GOVERNING LAW


This Agreement shall be governed, construed and interpreted by, through and
under the Laws of the Republic of the Philippines.

16. ENTIRE AGREEMENT:


NOTICE: This is an important LEGAL document.
● You are giving up certain important rights.
● You may have an attorney review the Lease Agreement prior to signing it.

By signing this Lease Agreement, the Tenant certifies that they have read, understood
and agrees to comply with all of the terms, conditions, Rules, and Regulations of this
Lease.
