Facts:
While in the auditorium of the school, Alfredo Amadora was mortally hit by a gun fired by
Pablito Daffon ending his life. Daffon was convicted. The victim's parents filed a civil action for
damages under Article 2180 against the school, its rector, principa;, the dean of boys and the Physics
teacher with Daffon and two other students, through their respective parents. The complaint against the
student was later dropped. The Court of First Instance held the remaining defendants liable. On appeal,
the decision was reversed and all the defendants were absolved.

Issue:
Whether or not Article 2180 covers even establishments which are not technically schools of
arts and trades

Held:
The school cannot be held directly liable because only the teacher or the head of the school of
arts and trade is made responsible for the damage caused by the student or apprentice. Neither can it be
held to answer for the tot committd by any of the other private respondents for none of them has been
found to have been charged with the costudy of the offending student or has been remiss in the
discharge of his duties in connection with such custody
