COMPLAINT-AFFIDAVIT

I, AMELIA J. MARIANO, of legal age, married, housewife, and a resident of

Malalinta, San Manuel, Isabela after having been sworn to in accordance with law do
hereby depose and state that:

1. I am a member of Pantawid Pamilyang Pilipino Program (4P’s).

2. There are several livelihood programs provided for by us by the

Department of Social Welfare and Development. One of which is Villa
Cayaban Farmers Sustainable Livelihood Program Association
(hereinafter referred to as VCF - SLPA) where it is for the benefit of
farmers.

3. I am the elected and incumbent president of Villa Cayaban Farmers

SLPA. I am executing this complaint affidavit in behalf of all the
members of the association.

4. In the said program, government funds are being deposited in the

account of Villa Cayaban Farmers SLPA which would be distributed to
the all the members who would in turn use the said fund in line with the
livelihood program of Villa Cayaban Farmers SLPA. Then, each
member would be obligated to pay back to Villa Cayaban Farmers
SLPA the same amount of fund handed to him/her for the sustainability
of the program.

5. Villa Cayaban Farmers SLPA has a bank account with Rural Bank of
San Mateo (Isabela), Inc. where the funds are being deposited.

6. In August 2017, Ms. Gypsy B. Egipto was employed as the Project

Development Officer II assigned in San Manuel, Isabela.

7. From October 2017 to December 2017, while Ms. Egipto was still the
Project Development Officer II in DSWD – San Manuel, Isabela, we
remitted to her from all the members of VCF-SLPA totalling FIFTY
THOUSAND FIVE HUNDRED PESOS (PHP 50, 500.00). She
promised to deposit the said amount to the bank account of VCF-SLPA
with the Rural Bank of San Mateo.

8. When we asked for acknowledgement receipt from her, she told us to

just wait for her to deposit the amount in the bank anyway it is just near
her office.

9. We entrusted to Ms. Egipto the above-mentioned amount because of

the trust and confidence we reposed on her. Because of the position
she held, we relied on her promise / undertaking that she would
deposit the amount in the bank account of our association.

10. However, recently, we learned that the money entrusted by VCF-SLPA

to Ms. Egipto was not deposited by her in the bank account of the
 association. It was found out that no deposits were made by Ms.
Egipto. To prove this are hereto attached statement of account marked
as Annex A.

11. Ms. Egipto clearly misappropriated the amount entrusted to her by Villa
Cayaban Farmers SLPA and used it for her personal benefit to the
prejudice of all the members of the association.

12. Demands were made to Ms. Egipto to pay the amount during the
several confrontations with her where she promised to pay the amount
in installment basis. However, to this date, she failed to comply with
her obligation.

13. In fact, in order to prevent the filing of this complaint, some employees
of the Department of Social Welfare and Development- Field Office II
assisted us in series of dialogues and meetings to resolve the issue
and a Compromise Agreement was prepared and signed by the
beneficiaries of the program. A copy of the minutes of meetings is
hereto attached as Annex B.

14. In the Compromise Agreement and by virtue of the extrajudicial

admissions made by Ms. Egipto, she was given one year to settle her
obligation. However, when requested to sign it, she refuse to affix her
signature. A copy of the said Compromise Agreement is hereto
attached as Annex C.

15. The matter was reported to the police due to her adamant refusal to
comply with her promise to pay the said amount. A copy of the
certification of the excerpt of police blotter is hereto attached and
marked as Annex D.

16. I am executing this affidavit to arrest to truth of the foregoing and to file
criminal charges against MS. GYPSY EGIPTO y BABARAN, who is of
legal age, married, and a resident of Purok 3, District II, Benito Soliven,
Isabela for ESTAFA and MALVERSATION of PUBLIC FUNDS.
