BY THE COURT:
Learned counsel for the respondent/s submits that appeal against the order of Payment of Wages
Authority is maintainable under Section 17 of the Payment of Wages Authority Act. Without availing
the statutory remedy, this writ petition has been filed, hence, it may be dismissed.
Learned counsel for the petitioner is fair enough to state that statutory remedy under Section 17 of
the Payment of Wages Act has not been availed by the petitioner. Accordingly, prayer is made to
allow withdrawal of the writ petition with liberty to maintain appeal before the District Judge
concerned. A further prayer is made to continue the interim order for a period of four weeks and for
condonation of delay to maintain appeal.
In view of prayer made, the writ petition is dismissed as withdrawn with liberty to maintain an
appeal under Section 17 of the Payment of Wages Act.
Since interim order exists in favour of the petitioner and was continuing for last 8 years, thus for a
period of four weeks, it would be continued.
