JOINT AFFIDAVIT OF UNDERTAKING

We ATTY. ARIEL A. ABIS, Filipino, of legal age, married and a resident of


Blk 7 Lot2, DJD Village, San Manuel, Puerto Princesa City, BRYAN JOSEPH
ESGUERRA JAMANTOC, of legal age, single, and a resident of 89 Malolos Ave.,
Bagong Barrio, Caloocan City, CLETO BALAGAS, JR., of legal age, married and
a resident of 125 Cotabato St., Bago Bantay, Quezon City and ADOLFO ACOSTA
MADARCOS, of legal age, married and a resident #27 Abad Santos Ext., Brgy.
Bagong Sikat, Puerto Princesa City after having been sworn in accordance with
the law hereby depose and state that:

1. That affiants BRYAN JOSEPH ESGUERRA JAMANTOC, CLETO BALAGAS,


JR. have been issued Special Power of Attorney by Mrs. Elizabeth Esguerra
– Schmidt formerly Elizabeth Esguerra Fries to offer for sale and negotiate
the price for the sale of a parcel of land located at Barangay Port Barton
San Vicente Palawan specifically described as Original Certificate of Title
No. E-17723;

2. THAT affiant ATTY. ARIEL A. ABIS is the hired lawyer of Mrs. Elizabeth
Esguerra – Schmidt formerly Elizabeth Esguerra Fries in an Accion
Publiciana case filed before the Regional Trial Court of Palawan Branch
95;

3. That affiant ADOLFO ACOSTA MADARCOS is the sole person task by the
affiants above with the blessing of Mrs. Elizabeth Esguerra Schmidt
formerly Elizabeth Esguerra – Fries to look for a potential buyer over the
said property;

4. That affiants agree to undertake and make sure that in the dealings of the
property to any future buyer assure that Mrs. Elizabeth Esguerra Schmidt
formerly Elizabeth Esguerra – Fries receives a guaranteed amount of
SIXTY-TWO MILLION THIRTY-EIGHT THOUSAND PESOS (Php
62,038,000.00) over the sale of the property;

5. That the affiants agrees to undertake ATTY. ARIEL A. ABIS, BRYAN


JOSEPH ESGUERRA JAMANTOC and CLETO BALAGAS, JR. shall receive
EIGHT MILLION PESOS (Php 8,000,000.00) each subject to negotiation;

6. That the affiants agrees to undertake that ADOLFO ACOSTA MADARCOS


shall receive a compensable amount over the sale of the abovementioned
property subject to the negotiation thereof;

7. That the affiants executed this affidavit of undertaking to support the sale
of the abovementioned property;

8. That the affiants are executing this affidavit of undertaking to attest to the
truth of the foregoing.

IN WITNESS WHEREFORE, I have hereunto set my hands this _____ day
