ACCOUNTABILITY FOR FILIPINOS: A COMPARATIVE RESEARCH

Introduction

Merriam Webster Dictionary defines the word accountability as the state


of accepting responsibility or to account for one’s action. When we talk about accountability
with our kids, we are most concerned about ensuring that the following two things happen every
day with your child. First, how will you ensure that your child takes full responsibility for his or
her actions after the bad behavior occurs. And second, how can you get your child to think about
his or her responsibility for his or her actions before the bad behavior occur so that he or she will
not behave badly in the first place. (Devine,2019)

On legal papers the age of accountability is normally 18 years old.


Therefore when a person who is under the age of 18 is accused of committing a crime he or she
may not suffer the consequences due to being a minor. But there are some exceptions his or her
parent may act as a substitute. The parent will stay in prison until the child reaches the age of
accountability. Or in some cases the child may be taken to a government facility like the DSWD
in the Philippines. In this facility the child will undergo rehabilitation under the surveillance of
professional helpers or workers. After the rehabilitation process the child may return to their
family.

In the Netherlands, children below the age of 12 are considered too young
to be responsible for breaking the law. The United Nations Convention on the Rights of the
Child calls upon state parties worldwide to establish a minimum age below which children shall
presumed not to have the capacity to infringe the penal law. (Lourijsen and Liefaard T, 2019).

Different countries around the world have different ages of accountability.


In Brazil it is 18 in Japan it is 12 in France it is 13 in Switzerland it is 10. All of these countries
are also struggling to know if their age of accountability is appropriate for them.

There are ongoing efforts on the congress to pursue in lowering the age of
accountability it varies from 9 to 12 years old. Sadly, lowering the age of criminal responsibility
is an act of violence against children. Children in conflict with the law are already victims of
circumstances, mostly because of poverty and exploitation by adult crime syndicates. Children
who are exploited and driven by adults to commit crimes need to be protected, not further
penalized. (Lowering the age of criminal responsibility is against child rights (UNICEF, 2019)

We all know that the Philippines is a third world country. Majority of our
citizens are suffering from poverty. Poverty is one of the major factors that makes people commit
crime if children is raised and involved in this environment they will commit crimes themselves.

In our locale, cases of crimes that was done by a minor may not be that
common. But, the law of accountability will affect us in various ways. For example, by knowing
that we cannot imprison a minor. Criminal groups may use children to continue their criminal
activities. And also Children without proper guidance might see the age of accountability as a
way for them to do violent and unethical things. That is why we should have enough knowledge
about the age of accountability it will help us maintain peace.

By knowing and understanding the perspective of different people from


different generations we will have a conclusion that may give us enough information for us to
know if we should pursue on implementing the law that reduces the age of accountability in our
country.
