AFFIDAVIT OF WITNESS

I, _______________________________, married, of legal age, Filipino, and a

resident of Davao City, Philippines, after being duly sworn to in accordance
with law, do hereby depose and state:

1. I am the same person who caused the execution of this Affidavit;

2. I am executing this Affidavit to attest in good faith that I have

known VERGEL PASPAS considering that we are neighbors and
that we both reside in Apolinario Street, Barrio Kapait, Davao
City;

3. I am aware that VERGEL PASPAS is being charged of Malicious

Mischief punishable under Article 327 of the Revised Penal Code
for intentionally causing damage to a mango tree owned by
ALEXA M. JAVIER by tying an adult white female cow onto the
branch of the young mango tree, causing the same to be forcefully
uprooted from the ground;

4. In view of which, I am also executing this Affidavit to attest in

good faith that the subject adult white female cow actually
belongs to VERGEL PASPAS and that I have personal knowledge
thereof considering that VERGEL PASPAS has hired me before to
tender to the same cow for more than two (2) years;

5. I am executing this affidavit to attest the truth of the foregoing

facts for whatever legal purposes this may serve.
