AFFIDAVIT OF POSEUR BUYER

I, Eric G Damaso, of legal age, a bonafide member of the Philippine National

Police presently assigned in this station after been duly sworn to in accordance with the
law hereby stated:

THAT I am the designated poseur buyer of illegal drugs to hand for the
successful arrest of the suspect.

THAT on August 05, 2019 at about 6:00 PM, I together with the members of the
Operation team headed by our Team leader PLT DAMIAN B. MARTINEZ JR were at
the station when our TL received a phone call coming from an anonymous informant
that a suspected famous drug pusher in the person of Jhon Jay Ompad a.k.a “johny sin”
has been actively engaged in the rampant selling of illegal drugs.

THAT on the moment thereafter, our TL assigned our Intel Officer to conduct a
test buy on the suspect to validate the veracity of the information they received.

THAT on August 06, 2019 at about 6:00 AM, our Intel Officer called Bello Siga
a.k.a “boy hellmet” one of our Confidential Informants (CI’s) to meet with him and to
discuss the conduct of test buy to the suspect. When boy helmet arrived, our Intel
Officer gave One Thousand Peso Bill to him for him to buy shabu for our test buy.

THAT after an hour, boy helmet called our Intel officer and informed that he
already bought shabu from the suspect and he was advised to proceed at the usual
meeting place. Boy helmet then gave the shabu to our Intel officer afterwhich, our Intel
Officer proceeded to the office of our Chief of Police and presented to him the shabu
that was bought from the suspect. Our COP, PMAJ JAIME MANAYOD, instructed us to
bring the item to Cauayan City Crime Laboratory for examination. The laboratory
examination with the item turns positive for the presence of Methamphetamine
Hydrochloride commonly known as “shabu” a dangerous drug.

That acting on the advised of our COP, our team conducted surveillance and
casing together with boy helmet to the activities of the suspect. After days of
surveillance and casing, we found out that suspect is actively engaged in rampant
selling of dangerous drugs particularly at Emperors Park in San Fermin.
 THAT on August 10, 2019 at about 1:00 PM, our COP conducted the briefing for
the conduct of buy bust operation against John Jay Ompad y Palor. During the
briefing, I was designated by our COP to act as poseur buyer while PSMS Edwid
Bueno and PSSg Baejay Susvilla were tasked as my back-up and arresting officer. Our
COP was the one who coordinated to the PDEA RO2 while other members of the team
were tasked to coordinate with the barangay officials of San Fermin and representative
from media and DOJ.
THAT the duty investigator, PCMS John Rey Caňa recorded the one (1) piece of
One Thousand Peso Bill into the pólice blotter to be used as buy bust money. The
agreed pre-arranged signal that the transaction was already consumated was when I
will remove my cap. Later I advised boy hellmet to contact Jhon Jay Ompad and
inform him that he has a friend in need of shabu worth of P1,0000, 00. Boy hellmet
immediately called the suspect thru cellphone and after their conversation, the suspect
change his mind regarding the place of transaction, instead at Emperor’s Park, he
decided to meet at Mang Cardo’s restaurant in San Fermin. Thereafter, I immediately
called our TL regarding the change of venue.
THAT at about 3:00 PM in the afternoon of the same date, the team already in
position at the area and I and boy helmet together with PSMS Bueno and PSSg
Susvilla positioned at the center table of mang cardo’s restaurant and waited for the
arrival of Jhon Jay Ompad, while the rest of the team stragtegically positioned
themselves near outside the restaurant together with the witnesses.

After few minutes, a matte black Honda click 150i arrived and one male person
approached us and shake hands to boy helmet. Boy helmet introduced me to the
person whom he called Johny sins, as the buyer of shabu. I immediately brought out
the One Thousand Peso Bill (buy bust money) and Johny sins handed me one sachet
of shabu and in return I handed to him the buy bust money. Thereafter receiving the
item I immediately executed our pre-arranged signal by removing my cap and when
Johny sins is about to stand I immediately grabbed him and my immediate back-up
rushed towards us and restrained him. Suspect were arrested by PSMS Bueno and
PSSg Susvilla and was informed of his constitutional rights in compliance with the
Miranda Doctrine and the nature of his arrest.
 The inventory, seizing and markings and taking of photographs of the confiscated
items were done in the said place of incident, in the presence of Barangay Captain Arvin
M. Paguyo, Media Rep. Shiela Grace Cortes, and DOJ Rep.Jake Doran.

That I personally marked one (1) piece small heat-sealed transparent plastic
sachet containing white crystalline substance believed to be “shabu” as, “EGD”
10/08/19 3:50 PM with my signature that I bought from the suspect. Subsequently, I,
together with the seizing officer brought the confiscated illegal drugs of the suspect to
the PNP Cauayan City Crime Laboratory for examination.
THAT I am executing this Affidavit to attest the truthfulness of the above narrated
facts and to support our charge for violation of Art. 2, Sec. 5 of Art. 2, RA 9165 against
the above named suspect.
