SANGGUNIANG BARANGAY OF BARIQUIR

ADOPTING INTERNAL RULES OF PROCEDURE FOR THE SANGGUNIANG BARANGAY OF


BARIQUIR,NAGUILIAN, LA UNION.

WHEREAS, The Sangguniang Barangay of Bariquir, Naguilian, La Union is a legislative body duly organized
pursuant to law of enactment of ordinance and the adaptation of resolution for the government of Barangay Bariquir,
Naguilian, La Union.

WHEREAS, pursuant to the provision of the Local Government Code of 1991, local Sangguniang bodies have the
inherit right and obligation of adopting its own rules of procedure for the proper discharge of legislative functions,

WHEREAS, in the maintenance of good order in the Sangguniang deliberations, it is necessary that specific rules
to be adopted and enforced in the interest of effective legislation;

NOW THEREFORE;

BE IT RESOLVED by the Sangguniang Barangay of Bariquir, Naguilian, La Union to adopt the following Rules
of Procedure to govern its deliberations.

RULE I-MEMBERSHIP

SECTION 1. Composition. The Sangguniang Barangay of Bariquir, Naguilian, La Union shall be composed of the
Punong barangay as Presiding Officer, seven (7) members elected at large.

SECTION 2. Term of Office. The term of office of the members of the Sangguniang Barangay of Bariquir, Naguilian, La
Union shall be three (3) years which shall commence on such dates as may be provided by law.

SECTION 3. Oath of Affirmation. All the members of the Sangguniang Barangay of Bariquir, Naguilian, La Union shall
upon assumption to office, take an oath of office or affirmation in the prescribed form, duly subscribed before a person
authorized to administer oath. Copies of the oath or affirmation of office shall be filled and preserved in the office of the
city/municipal mayor of the city/ municipality of Naguilian.

RULE II-PRESIDING OFFICER

SECTION 4. The Presiding Officer. The Punong Barangay shall be the Presiding Officer of the Sangguniang Barangay of
Bariquir, Naguilian, La UnionThe presiding officer shall vote only to break a tie. If the Punong Barangay cannot preside a
regular or special session, the Sangguniang Barangay members present constituting a quorum, shall elect from among
themselves a temporary presiding officer. The temporary presiding officer shall not vote even in case of a tie but shall
certify within ten (10) days from their passage all ordinances and resolutions enacted or adopted by the Sangguniang
Barangay of Bariquir, Naguilian, La Union.

SECTION 5. Powers and Duties of the Presiding Officer. The presiding officer shall:
a) Preside over the sessions of the Sangguniang Barangay
b) Preserve order decorum during sessions and , In case of disturbance or disorderly conduct in the session hall or
within the premises, take measures as he/ she may deem advisable or as the Sanggunian may direct;
c) Decide all questions of order, subject to appeal by any Sanggunian member in accordance with these rules;
d) Sign all acts, ordinances, resolutions, memorial, wrist and warrants issued by, or upon orders of the Sanngunian
and
e) Exercise such other powers and perform such other functions as may be provided by law, ordinance or regulation.
o shall hold office as his pleasure and be entitled to a reasonable allowance to be determined by the Sangguniang
Barangay.
1) No person shall be appointed Barangay Secretary if he/ she is Sangguniang Barangay member or a relative of the
Punong Barangay within the fourth civil degree of consanguinity of affinity.
2) The Barangay Secretary shall:
a) Keep custody of all records of the Sangguniang Barangay and the Barangay assembly meetings.
b) Prepare and keep the minutes of all the meetings of the Sangguniang Barangay and the Barangay
assembly;
c) Prepare separate lists of the members of the Barangay and the registered voters of the Barangay
assembly, and have the same posters of conspicuous places within the Barangay;
d) Register all new members of the Barangay;
e) Assist in the preparation of all necessary election forms and or other forms necessary for the conduct of
the Barangay elections, referenda or plebiscites , in coordination with the Commission on Election;
f) Assist the City or Municipal Civil Registrar in the registration of births, deaths and marriage;
g) Keep a record of all inhabitants of the Barangay containing the following items of information: name,
address, place and date of the birth, sex, citizenship, occupation and such other items of information as
may be deemed necessary; and
h) Exercise such other powers and perform such other duties and functions as may be prescribed by law or
ordinance.

SECTION 7. The Barangay Treasurer

1) The Punong Barangay shall appoint the Barangay Treasurer with the concurrence of the Sangguniang Barangay.
He shall be entitled to a reasonable allowance to be determined by said Sanggunian.
2) The Barangay Treasurer shall be bonded in accordance with existing laws in an amount to be determined by the
Sangguniang Barangay, but not exceeding ten thousand pesos ( Php10,000.00) premiums for which shall be
defrayed by the city or municipal where the Barangay belongs.
3) No person shall be appointed Barangay Treasurer is he/ she is Sangguniang Barangay member or a relative of the
Punong Barangay within the fourth civil degree of consanguinity of affinity.
4) The Barangay Treasurer shall:
a) Keep custody of Barangay property and funds not deposited with the city or municipal treasurer;
b) Collect and received taxes, fees, contributions, monies, materials and other resources accruing to the
Barangay Treasury and issue official receipts therefore;
c) Disburse funds in accordance with the financial procedures provided by laws, rules and regulations;
d) Submit to the Punong Barangay certified and detailed monthly statements of actual receipts within such
period as may provide by law or ordinance.
e) Render a written monthly accounting report of all barangay funds and property under his custody, which
report shall be made available to the public or to the members of the Barangay assembly and other
Government agencies concerned ;
f) Certify to the availability of funds whenever necessary;
g) Plan and attend to the rural postal circuit within his own jurisdiction; and
h) Exercise such other powers and perform such other duties and functions as may be prescribed by law or
ordinance.

SECTION 8. Other Appointive Officials. The qualifications, duties and functions of all other Barangay Officials
appointed by the Punong Barangay hall be governed by the provisions of law or by ordinance.

RULE IV-SESSIONS

SECTION 9. Regular Sessions. The regular session/s of the Sangguniang Barangay of Bariquir, Naguilian, La Union shall
be on the second Wednesday and last Wednesday of each month, at such time and place as the formal notice thereof shall
stipulate, or as may be decided upon in the immediately preceding session.

SECTION 10. Special Sessions. As often as necessary, when public interest so demands, special sessions may be called by
the Punong Barangay of the majority of the members of the Sanggunian.

In special session, a written notice to the Sanggunian members, stating the date, time and purpose of the session, shall be
served personally or left with a members of the household or the Kagawad at his usual place or residence. Unless
otherwise agreed upon by two-third (2/3) vote of the members present, there being a quorum, no other matter may be
considered at a special session except that stated in the notice.

SECTION 11.Call to order. The presiding officer shall open the session by calling the Sanggunian to order. On the first
session day of each month, the National Anthem shall be sung, followed by a one-minute silent prayer or mediation, or at
the instruction of the presiding officer, an invocation by a Sanggunian member designated by him.

SECTION 12. Attendance in Session. Every member of the Sanggunian should be present in all session, unless expressly
excluded by it or necessary prevented from doing so by sickness or other unavoidable circumstances duly reported to the
Sanggunian through the Secretary.

SECTION 13. Open to public.Sanggunian sessions or meetings or committee thereof shall be open to the public unless a
closed session is decided or ordered by an affirmative vote of a majority of the members present, there being a quorum,
the public interest or for reasons of security, decency or morality, or for reasons affecting the dignity of the Sanggunian or
any of its members, or when confidential matters are being considered.

On motion to hold a closed session duly approved, the presiding officer shall direct the session hall clear and doors closed.

Only person specifically authorized by the Sanggunian shall be admitted to the closed session. They shall preserve the
secrecy of whatever may be read or said at the session.

SECTION 14. Suspension and adjournment of session. Sessions of the Sanggunian shall not be suspended or adjourned
except by direction of the Sanggunian itself, but the presiding officer may, in his direction, declare a recess of short
intervals.

SECTION 15. Opening and adjournment to be entered in minutes. The exact hour of opening and adjournment of session
shall be entered in the minutes
RULE V-ROLL CALL AND QUORUM

SECTION 16. Quorum. A majority of all elective and appointive members of the Sanggunian shall constitute a quorum to
transact official business.

Should a question of quorum be raised during a session, the presiding officer shall immediate proceed to call the roll of
the members and thereafter announce the results.

SECTION 17. Absence of Quorum. Where there is no quorum in the given session, the presiding officer may declare a
recess until such time as quorum is constituted, or a majority of the members present may adjourn from day to day and
may compel the immediate attendance of member absent without good cause by issuing to the integrated National Police
assigned in the area an order for the arrest and presentment of the absent member at the session.

If there is still no quorum despite the fore going, no business shall be transacted. The presiding officer, upon proper
motion duly approved by the member present, shall then declare the session adjourned for lack of quorum.

SECTION 18. Motion to adjourn Vacates Call. At any time after the roll call has been completed, a motion to adjourn
shall be in order, and approved by a majority present, all proceedings shall be vacated.

RULE VI- COMMITEES

SECTION 19. Standing committees. The Sangguniang Barangay of Bariquir, Naguilian, La Union shall elect the chairman
and the members of the following standing committees, the general jurisdiction of which shall be as hereunder provided:

a) Committee on Appropriation- All matters relating to the approval of the budget; appropriation of funds for the
payment of obligations; the determination of compensation of personnel; the reorganization of the local offices;
taxation ordinances and monetary and fiscal matters.

b) Committee on Agriculture-All matters relating to agriculture, food production and agribusiness, agricultural,
economic and research, soil survey and conservation; agricultural education and extension services; animal
industry and livestock quarantine and supervision of local cooperatives.

c) Committee on education- All matters relating education and culture, local schools, colleges and universities;
libraries and museums; non-formal and community-audit education; scientific and technological research,
development and advancement and moral and religious formation of the community.

d) Committee on Health- All matters relating to the strengthening and development of family life; and public health
and hygiene.

e) Committee on Peace and Order and Public Safety- All matters in relation to the maintenance of the public order
and security; civil defense, Organization and maintenance of the “TANODS “ implementation of local ordinances;
human rights; fire; accident and crime.

f) Committee on Public Works and Infrastructure- All matters relating to planning, construction, maintenance,
improvement and repair of public buildings, highways, bridges, roads, parks, shrines, monument and other public
edifices, drainage, sewerage and flood control and protection; irrigation and water utilities; tourism;
transportation; And communication services.

g) Committee on Tourism Environmental Protection - All matters relating cleanliness and beautification and
conservation and preservation of the natural resources.

Whenever measure covers subject matters falling within the jurisdiction of one committee, said measure shall be
referred jointly to the committees concerned.

SECTION 20. Membership, Officers, election. Each standing committee shall have a chairman, and at least two (2)
members, who shall be elected by majority vote of the Sanngunian from among its members.

SECTION 21. Limitations. No Sanggunian member shall be a chairman of more than two (2) standing committee.

No member of a committee shall act upon or participate in any matter in which he has a special, direct and substantial
interest.

SECTION 22. Special Committees. The Sanggunian may organize special committee as it any deem necessary. The
officers and members of special committee shall likewise be elected by majority vote of all Sanggunian members.

SECTION 23. Vacancy. Whenever a vacancy is occurred or is declared to exist in any of the committees, the same shall be
filled with election of the Sanggunian.
SECTION 24. Committee Meetings of Hearings. The committees shall determine the frequency of their meeting or
hearings, provided they meet at least once a month. A majority of all the members of the committee shall constitute a
quorum. Committee hearings or meetings shall be held only in a public building.

SECTION 25. Committee Report and Orders. Committee Reports and / or orders on any proposed ordinance or resolution
shall be considered in formal meeting shall not be submitted to the Sanggunian unless accompanied by the minutes of the
meeting or hearing of the committee which adopted them.

When a committee submits a report, the members thereof shall presumed to have concurred in the report and shall
precluded from opposing the same, unless they have entered their objection thereto during the committee meeting.

RULE IV –ORDER OF BUSINESS

SECTION 26. Order of Business. The Order of business of the Sangguniang Barangay for every session shall be:

a) Call to Order
b) National Anthem and 1 minute Prayer
c) Roll Call
d) Approval of the Minutes of the Previous session
e) Calendar of Business (Legislative Agenda)
-Unfinished Business
-New Business
f) Other Matters (Executive Agenda ) ;and
g) Adjournment

SECTION 27. Approval of Minutes. The minutes of each session shall be submitted to the Sanngunian for approval

SECTION 28. Calendar of Business. The calendar of business shall consist of the following parts.

a) Unfinished Business- Business being considered by the Sanggunian at the time of its adjournment. Its
consideration shall be resumed until such unfinished business is disposed of. Thereafter, the presiding
officer shall call for new business.
b) New Business- Proposed ordinances, resolutions or other measures to be considered in the order in which
they are listed in the calendar.

SECTION 29. Distribution of Order of Business. The order of business shall distribute at least three (3) days before the
session.

RULE VIII- ORDINANCES AND RESOLUTIONS

SECTION 30. Ordinances and Resolutions. Distinguished. Legislative actions of a general and permanent character shall
be enacted in the form of ordinances, while those which are of temporary character shall be passed in the form of
resolutions. Matters relating to propriety functions and to private concerns shall be acted upon resolutions.

SECTION 31. Essential Parts of Ordinances and Resolutions. Proposed ordinances and resolutions shall be in writing and
shall contain an assigned number, a title or caption, an enacting or ordaining clause and the date of its proposed affectivity.
In addition, every proposed ordinance shall be accompanied by a brief explanatory note containing the justification for its
approval. It shall be signed by the authors and submitted to the secretary who shall report the same to the Sanggunian at
its next session.

SECTION 32. Distribution of Copies. The secretary shall furnish copies of all proposed ordinances and resolutions to the
Sanggunian members at least three (3) days before a regular or special session.

SECTION 33. Urgent Measures. Any legislative matter duly certified by the Punong Barangay as urgent, whether or not it
is included in the calendar of business, may be presented and considered by the Sanggunian in the same session need of
suspending the rules next session.

The Sanggunian likewise, may consider a proposed ordinance or resolution as urgent and consideration thereof shall be
scheduled according to a time table.

SECTION 34. Debate. In the day set for the consideration of the proposed ordinance or resolution, the proposal shall be
subjected to debate and pertinent motions.

In the discussion of any measure, A motion to close the debate shall be in order after two speeches for and one against, or
after only one speech for has been delivered and none entered against it.

When several members have registered or signified their intention to speak on the matter under consideration and when
said matter has been sufficiently and thoroughly discussed by the member speaking, the presiding officer, motupropio, or
upon motion of a member, order that a member having the floor desist from speaking so that other members may not be
deprived of their opportunity to speak.
SECTION 35. Five- Minute Rule. After the close of debate, the Sanggunian shall proceed to the consideration of
amendments. A member who desires to speak for or against an amendment shall have only five (5) minutes to do so.

After the amendments have been acted upon the proposed ordinance or resolution shall be voted on.

SECTION 36. Approval of Measure. The Sanggunian secretary shall prepare copies of the proposed ordinance or
resolutions in the form it was passed and shall distributed to each Sanggunian member a copy thereof, except that a
measure certified by the Punong Barangay or the Sangguniang Barangay as urgent may be submitted for final voting
immediately after debate and/ or amendments during the same session.

After the amendments have been acted upon the proposed ordinances or resolution shall be voted on.

SECTION 37. Approval of Resolution. A resolution shall be adopted in the same manner prescribed for ordinances, except
that it need not to go through another session for its final consideration unless decided otherwise by a majority of all the
Sangunian members.

SECTION 38. Majority Requirement. No ordinance or resolution passed by the Sanggunian shall be valid unless approved
by the majority of the member present, there being a quorum. Any ordinances or resolution authorizing or directing the
payment of money or creating liability, shall require the affirmative vote of a majority of all Sanggunian members for its
passage.

Upon the passage of all ordinances or resolutions the Sanggunian Secretary shall record the years and days. Each
approved ordinance or resolution shall be recorded in a book kept for the purpose.

SECTION 39. Special Provisions on the Budget Ordinance. The Sanggunian shall in no case increase the appropriation
for any project or program of the Barangay over the amount submitted by the Punong Barangay in his budget proposal.

After the Punong Barangay shall have submitted the annual general appropriation measure shall be considered only if
supported by actually available funds as certifies to by the local treasurer or by funds to be raised by corresponding
revenue proposal included therein.

SECTION 40. Approval by the PunongBarangay. Every ordinance or resolution passed by the Sanggunian shall be
forwarded to the Punong Barangay for approval. The Punong Barangay shall affix his initials on each and every page of
the ordinance or resolution and the word “Approved” shall appear with his signature on the last page thereof.

With the (10) days after receipt of the ordinance or resolution the Punong Barangay shall return the said ordinance or
resolution to the Sanggunian with either his approval or his veto. If he does not return or within that time, the ordinance or
resolution shall be deemed approved.

SECTION 41. Veto Power or the PunongBarangay . The Punong Barangay may veto any ordinance or resolution on the
ground that it would be prejudicial to the public welfare particularly stating his reasons therefor in writing.

The Punong Barangay shall have the power to veto any particular item or items of an appropriation ordinance or of
ordinance or resolution directing the payment of money or creating liability. In such cases, the veto shall not affect the
item/s which is/ are not objected to. The vetoed item/s shall have not effect unless the Sanggunian overrides the veto in the
manner hereunder provided; otherwise, the item/s in the appropriation ordinance of the previous year corresponding to
those vetoed shall be deemed reenacted.

The Sanggunian may override the veto or the Punong Barangay top two-thirds (2/3) vote of all its members, thereby
making ordinance or resolution effective.

The Punong Barangay may veto an ordinance or resolution only once.

SECTION 42. Review by the Sangguniang Bayan. Within ten(10) days after enactment, the Sangguniang Barangay shall
furnished copies of the Barangay ordinance to the Sangguniang Bayan for review, as to whether the ordinance is
consistent with law and with (city/ municipal ) Ordinances.

Failure on the part of the Sangguniang Bayan to take action on Barangay ordinances inconsistent with law or with
municipal ordinances, the Sangguniang Bayan shall return the ordinances with its comments and recommendations to the
Sangguniang Barangay for adjustment, amendment or modification, in which case, the effectivity of the ordinance shall be
deemed suspended.

SECTION 43. Enforcement of Disapproved Measures. Any attempt to improve, promulgated or executed any ordinance,
resolution or executive order after the disapproval thereof shall be sufficient ground for the suspension on dismissal of the
officer making such attempt.

SECTION 44. Effectivity of Enactments. Unless otherwise stated in the ordinance or resolution, the same shall take effect
after the lapse of ten (10) days from the date a copy thereof is posted in a bulletin board at the entrance of the barangay
hall and in at least two(2) other conspicuous places, such as the public market, church or chapel.

Not later than five (5) days after the passage of the ordinance or resolution, the Sanggunian Secretary shall cause the
Posting thereof in English, and shall record such fact in a book kept for the purpose, stating the dates of approval and
posting thereof.
RULE IX-DECORUM AND DEBATE

SECTION 45. Manner of Addressing the Chair. When a member desires to speak, He/ She shall rise and respectively
address the chair, “MR. Chairman” or Mr. Presiding Officer”.

SECTION 46. Recognition of member to speak. When two or more member rises at the same time, the presiding officer
shall determine and recognize the member who is to speak first.

SECTION 47. Time limit for speeches. No member shall occupy more than five (5) minutes in debate and any question or
speak for more than once on any question without leave of the Sangguniangexcept as hereinafter provided. The period of
interpellation shall not be counted against the time of the member speaking.

SECTION 48. Decorum to Open and Close Debate. In all cases, the member who has obtained the floor shall confine
himself/ herself to the question under debate, avoiding personalities. He/ She shall refrain from uttering, words performing
acts which are inconsistent with decorum.

If it is requested that a member be called to order for words spoken in debate, the member making such request shall
indicate the words except to and they shall be taken down in writing by the secretary and read aloud. The member who
uttered such words shall not be held to answer, nor be subjected to censure by the Sanggunian of further debate or other
business has intervened.

SECTION 49.Conduct during sessions. During the Session, members shall be in proper attire and observe proper
decorum.

While the presiding officer is addressing the Sanggunian or putting a question, no members shall walk out or cross the
session hall.

SECTION 50. Smoking in Session Hall is prohibited. Smoking shall not be permitted within the session hall.

SECTION 51. Discipline of Members. The Sanggunian may punish its members for disorderly behavior and , with the
concurrence of two- thirds (2/3) of all members, suspend or exclude from the session a member, but if the penalty is
suspension, this not exceed sixty (60) days.

RULE X. VOTING AND MOTION

SECTION 52. A tie on an Appeal. A tie vote on an appeal from the ruling of the chair sustains the decision of the chair.

SECTION 53. Who May Move? When a motion, report or proposed measures is adopted or lost, it shall be in order for a
member who votes with the majority to move for reconsideration thereof on the same or succeeding session day. Such
motion shall precedence over all other questions, except a motion to adjourn to raise q question of privilege and a call to
order.

SECTION 54. Recording of Motions. Every motion shall be entered in the minutes with the name of the member making
it, unless it is withdraw the same day.

SECTION 55. Reading and Withdrawal of Motions. When a motion is made, the presiding officers shall state it before
being debated. Except as herein otherwise provided, a motion may be withdrawn any time before its approval or
amendment.

SECTION 56. Precedence of Motions. When a motion is made, the presiding officer shall state it before being debated.
Except as herein otherwise provided, a motion may be withdrawn any time before its approval or amendment.

SECTION 57. Amendment. When a motion or preposition is under consideration a motion to amend and a motion to
amend that amendment shall be in order. It shall also be in order to offer further amendment by substitution, but it shall
not be voted upon until the original motion or preposition is perfected. Any of said amendments may be withdrawn before
a decision is had thereon.

SECTION 58. Rider Prohibited. No motion or preposition or a subject different from that under consideration shall be
allowed under color or amendment.

SECTION 59. Motion to Cover One Subject Matter. No motion shall cover one subject matter.

SECTION 60.Amendment of Title. Amendments to the title of the proposed ordinance or resolution shall not be in order
until after the text thereof has been perfected. Amendments to the title shall be decided other than to adjourn.

SECTION 61. Call to Order. A Motion to read any part of the equivalent to a call order and takes precedence over any
motion other than to adjourn.

SECTION 62. Questions of Privilege. Question of Privilege are:


a) Those affecting the rights of the Sanggunian: its safety, dignity and the integrity of its members.
b) Those affecting the rights, reputation and conduct of the members, individually, in their capacity as
such members.
Subject to the five (5) minute rule, questions or privilege shall have precedence over all other questions, except a
motion to adjourn.

SECTION 63. Privileged Questions. Privileged questions are those motions or subject matters which under the rules take
precedence over other motions and subjected matters.

RULE XI-SUSPENSION OF THE RULES

SECTION 64. Vote Required. No rule shall be suspended except by a vote of two-third (2/3) of the member, a quorum
being absent.

SECTION 65. Interruption of Motion. When motion is suspended the rules is pending, one motion to adjourn may be
entertained. If it is lost, no similar motion shall be entertained until the vote is taken on the motion to suspend.

SECTION 66. Effect of Suspension. If the Sanggunian votes to suspend the rules, it shall forthwith to proceed the
measure. A two thirds (2/3) vote of the member present shall be necessary for the passage of said measure, a quorum
being present.

RULE XII- AMENDMENTS

SECTION 67. Amendments. Any portion of these rules may be amended by a majority vote of all Sanggunian Members.
