“ Why the Rules and Regulations are applied on Journalists when they
have right to freedom of speech ”


If media do all things publicly, then it will definitely affect the privacy of government
on international level.or disclose any private issue of political person is not
appropriate able. Therefore, there are some strict rules and regulations just to protect
Government privacy and confidential matters.

 Copy Right and Public domain:


Due to the freedom of speech, it may be possible that someone shared the other
person content across the web. So, it should be legally banned.

 Commercially Issues:
It’s mandatory to monitor commercial and programmes and prohibited those
broadcasting programmes which are unacceptable by society. and that are harmful to
young people.

It will be useful if we develop the habit of Listening. As we see, lots of people don’t
respect the other person point of view we should increase the positivity instead of
negativity or hatred through freedom of speech.
 What Actually Freedom of Speech is ?
Freedom of speech is a principle that refers the freedom of an individual or a
community/group to speak fluently and coherently their ideas, viewpoint, perspective and
opinion without fear of reprisal, threatened penalty or censorship.

 Constitution of Pakistan section 19&19-A on Freedom of Speech:

Article 19 of the Constitution of Pakistan: Freedom of Speech:


Every citizen shall have the right to freedom of speech and expression , and there shall be
freedom of the press, subject to any reasonable restrictions imposed by law in the interest of
the glory of Islam or the integrity , security or defence of Pakistan or any part thereof friendly
relations with foreign states, public order, decency or morality, or in relation to contempt of
court, or incitement to an offence.

Article 19(A) of the Constitution of Pakistan: Right to information


Every citizen shall have the right to have access to information in all matters of public
importance subject to regulation and reasonable restrictions imposed by law.

 PEMRA (Pakistan Electronic Media Regulatory Authority )


Role in Freedom of Speech:
PEMRA is an independent established federal institution. PEMRA is responsible to
regulate, monitor and issue channel licenses for establishment of the mass media
culture. It include both print and electronic media. Pemra's primary objectives are to
facilitate and regulate the private electronic mass-media industry and to improve the
standards of information, education and entertainment.

Why the Rules and Regulations are applied:


 Defamation:
Which occurs when any defamatory material relating to an individual or community is
published. and the statement harms the other person's reputation.
So, this is the reason In Pakistan , defamation constitutes a criminal act under
Ordinance No.LVI of 2002 (“ An Ordinance to make Provisions in Respect of
Defamation”)
There are two kinds of defamation under Pakistani Law:
a) Libel and b)Slander.
Libel:
Libel is an untrue defamatory statement that is made in writing.eg: (False statement
about any person in Print media.)

Slander is an untrue defamatory statement that is spoken orally/verbally.

 Blasphemy:
Speaking against the religious belief of one individual or group to offend them and
getting them hurt with freedom of speech should not be acceptable in any case.
Pakistan inherited these laws when it came into existence after the partition of India in 1947.

 Hate Speech:
Public speaking against a group or race to express hate is not appropriate able. so,
before speaking keep in mind human ethical and moral consideration. Freedom of
speech is not meant to be blunt.

 Spiral of science:
Every person have their thinking and mentality. So ,we should see the majority point
of view before publish the news. That it would not hurt them in some way.
