There was also ambiguity with regard to the exact role of the CC as
to whether such a committee could be equated with an Inquiry
Committee set up in a disciplinary inquiry, or it would have a wider
role. Meanwhile, the Supreme Court in its judgement in Medha Kotwal
Lele & Ors. v Union of India & Ors. case [W.P.(Crl.) No.173-177/1999
dated 26.4.2004] has directed that the Complaints Committee as
envisaged in Vishaka judgement will be deemed to be an inquiry
authority for the purposes of Central Civil Services (Conduct) Rules,
1964 and the report of the Complaints Committee shall be deemed to
be an inquiry report under those rules. In pursuance of this direction,
the Central Government (DOPT) has amended sub-rule (2) of rule 14
of the Central Civil Services (Classification, Control and Appeal) Rules,
1965 to incorporate the necessary provision.
