The death penalty as a sign of the times?

TRANSCRIPT

Is the desire to put a terrorist to death a sign of a brutal and primitive bloodlust?
What explains the great interest taken in meting out such an extreme form of punishment to another human being?
human beings have no business deliberately taking the lives of other human beings.
Not Just moral dimensions but also practical reasons
innocents can mistakenly be executed
a life spent in prison might actually be more of a punishment than death,
In the case of terrorism in death may not be a deterrent at all for dying is often very much a part of the idea of terrorism.
Here too... Two sides of a coin:
The desire to hit back at those that commit crimes that cannot be comprehended in normal human terms and hence difficult to understand.
The death penalty is:
inarticulate and extremely limited way of expressing helplessness
revulsion at actions that cannot be located inside the ambit of humanity.
death penalty may reek of machismo and exaggerated bravado, but at an emotional level, it is an admission of the inadequacy of any response.
Putting someone to death is the most we can do, even if that feels grossly insufficient.
In theory, the judicial system: punishment as a dispassionate response to infractions committed by individuals;
affixes responsibility and apportions on the criminal.
The responsibility of dealing with the crime: state;
the victim’s role :be the reason for the proceedings.
The crime: always against the state and therefore must be dealt with, clinically.
when it takes an aggressive hue: the victim’s rights are often invoked
. In India today, lynch mobs of all kinds are in favour, be they on mainstream media, social media or in everyday life. Hair trigger reactions are common, be they on the road or
in media, and in this context, it is hardly surprising that the death sentence is a valued member of society.
Compassion: unaffordable luxury, as it needs a certain sense of tranquil self-assurance [a commodity that is in scarce supply in the public discourse today.]
The interaction between a sensation hungry media and its consumers :creates a rising spiral of unhappy outrage.
Those that argue against the death penalty: fighting a lost cause
this has nothing to do with the merits of their argument.
As a society, we are perplexed, afraid and we are angry, and we have sophisticated ways of infecting each other with unhappiness, and some people will die because of that.
The rational argument : it acts as a deterrence
Conceptually, the right to existence :not underwritten by society; ( one is born into society and in order to receive its protection and patronage, one must follow its rules.)
When culturally drawn boundaries are crossed by individual acts: punishment guaranteed.
Instruments of a cultural kind or of a legal kind may be used.
Extreme disobedience : ultimate reaction- being put to death.
Is this is the best way to deal with the situation-? doesnt matter at all.
It is the most that society believes it can do.
Death exhausts the human imagination
When people act in a way where their humanity is suspect : dealt with by withdrawing their right to exist.

Discussion: Does Death Penalty serve its Purpose

Definition: Capital punishment, also known as the death penalty, is a government sanctioned practice whereby a person is put to death by the state as a punishment for a
crime.
Always a topic of debate: Human Rights v/s Revenge
Thirty-six countries actively practise capital punishment
The public opinion on the death penalty varies considerably by country and by the crime in question.
The United Nations General Assembly has adopted, in 2007, 2008, 2010, 2012 and 2014[3] non-binding resolutions calling for a global moratorium on executions, with a view
to eventual abolition
Yakub Memon case: controversial (is it needed, does he deserve it?)
The Death Sentence itself is coming under scrutiny ..... Why?
1. There is no place for that mode of punishment in any country that wants to call itself civilized.
2. Yakub Memon's hanging : many took such pleasure in it, and this is a troubling sign.

At a human level : Terrorism being the most pronounced crime , it is impossible to make sense of it at a human level.
Terrorism: markets fear, and terrorists harvest its consequences.
Random killing of innocents: destroys all notions of cause and effect (what did they do to punish them? Meaningless
Suicide bomber: most vexing idea: for here the terrorist begins where civilization ends- no value on his life.
For a suicide bomber: death is no punishment,
Howmuch does Death Penalty act as deterrence in practice?.
In such Cases: Death penalty says: There is no other option to stop him doing it again.
We say we are weak.
