WITNESSETH:
That the parties herein, including CRISTINA CATUBIG are co-owners of Lot No. 4388,
situated in barangay San Antonio, Sibulan, Negros Oriental, covered by Original Certificate of
Title No. O-V-3667, having inherited the same from their parents as shown in a deed of
Extrajudicial Settlement and Partition known as Doc. No. 227, Page No. 64, Book No. 11, Series
of 1957, notarized by Angel Campoy, Notary Public; and which parcel of land is more
particularly described as follows:
That by virtue of the aforementioned Deed, Eufronio Banquerigo and Isidro Banquerigo
owned one-half shares of Lot No. 4388 while the other half was owned by Cristina Catubig,
together with her children, namely: Pablita, Celedonia, Geminiano, and Sergio, all surnamed
Eumague;
That CRISTINA CATUBIG, died intestate sometime in the year 1970, leaving without
any testamentary will nor debts not settled until the present and upon her death she was survived
by her only children and compulsory heirs, namely Pablita, Celedonia, Geminiano and Sergio,
all surnamed EUMAGUE;
That it is to the best interest of the heirs of Cristina Catubig to settle the estate of their
deceased mother, Cristina Catubig, extrajudicially among themselves;
NOW THEREFORE, invoking the provisions of Section 1, Rule 74 and other related
laws on successions, the above-named heirs of Cristina Catubig, do by these presents, hereby
agreed to settle and adjudicate among themselves the one-half portion of the above-described
parcel of land in accordance with their rights, interest and participation therein;
That in order to serve their rights, interest and participations over the said parcel of land
better, the parties herein have caused the subdivision of Lot No 4388 into two (2) sub-lots,
namely Lot No.4388-A and Lot No. 43881-B; and each lot contained an area of EIGHT
THOUSAND TWO HUNDRED EIGHT (8,280) Square meters, more or less; and that they have
mutually and voluntarily agreed to officially partition among themselves and forever bound
therein, the aforementioned sub-lots into the following manner:
That further, the parties herein declare that the said parcel of land is not tenanted nor
worked upon by an agricultural lessee for the herein parties are the ones in possession of the said
parcel of land and that this transaction is in consonance with the provisions of the
Comprehensive Agrarian Reform Law of the Philippines.
