THIS IS AN INTERVIEW TO SAY P. WASKI (Complainant) and SOL B.


NGITBI (Accused) for VIOLATION OF RA 9262 (Violence Against
Women and Children)

Note: This case is for Academic purpose only. All names used in this paper are
not their real name to hide the identity of the Complainant and the Accused.

Say P. Waski and her paternal grandmother Teresita de Castro went to


Municipal Social Welfare and Development Office La Trinidad Benguet and
narrate the incident happen to Ms. Say by her common law partner Sol B.
Ngitbi.

Say and her paternal grandmother were accompanied by the Social Worker Joy
Grace Pamati. They went to the Women and Children’s Protection Desk of the
La Trinidad Municipal Police Station.

PO1 Juana dela Cruz who was on duty on that time made an investigation on the
Complainant.

Sworn Statement is as follows:

MUNICIPAL POLICE STATION THIS 23rd DAY OF JANUARY 2019 BY
PO1 JUANA DELA CRUZ. INVESTIGATION WAS CONDUCTED IN
ILOCANO DIALECT WHICH THE DECLARANT FLUENTLY SPEAKS
AND UNDERSTOOD AND SUBSEQUENTLY TRANSLATED AND
ENCODED INTO THE ENGLISH LANGUAGE BY THE SAME
INVESTIGATOR WITH THE CONFORMITY OF THE DECLARANT AND
IN THE PRESENCE OF HER FATERNAL GRANDMOTHER, TERESITA
DE CASTRO AND MUNICIPAL SOCIAL WORKER, JOY GRACE
PAMATI.

PRELIMINARY: Do you swear to tell the truth and nothing but the whole truth
in this investigation?

ANSWER: Yes, I will.


Question 1: Please state your full name and other personal circumstances?

Answer 1: I am Say P. Waski, 17 years old, born on September 5, 2001 at


Ambaguio, Nueva Viscaya, single, ALS Student at Solano, Nueva
Viscaya, native of Ambaguio, Nueva Viscaya and a resident in
Windyhill, Poblacion, La Trinidad, Benguet.

Question 2: Do you know why did your grandmother accompany you in this
office?

Answer 2: Yes Ma’am.

Question 3: What is it all about?

Answer 3: She accompanied me here for me to give my voluntary statement and


to file my formal complaint.

Question 4: To whom are you filing a complaint?

Answer 4: Against “SOL B. NGITBI”.

Question 5: Kindly state the full name and other personal circumstances of SOL
B. NGITBI

Answer 5: He is SOL B. NGITBI, 23 yrs. old, born on August 15, 1995, single,
driver, native of Buguias, Benguet and a resident at Windy Hill,
Poblacion, La Trinidad, Benguet.

Question 6: Why are you filing a complaint against SOL B. NGITBI?

Answer 6: Because he boxed my left thigh and threatened me by holding knife


near me and uttered hurtful words to me.

Question 7: How did you know SOL B. NGITBI?

Answer 7: I met him at when I stayed at Windyhill, Poblacion, La Trinidad,


Benguet the time I seek the help of “Mr. Elio” (father of SOL)
regarding to our planned of going to police station for blotter
purposes.

Question 8: What happen next?

Answer 8: On September 2015, we stayed at Poblacion, La Trinidad, Benguet


like husband and wife.

Question 9: How is your relationship during that time?

Answer 9: We always argue because he does not have work and I am the one
who initiates to work to have money for our expenses. He has more
time to go to computer shop, drink liquor and flirt with other
woman.

Question 10: What did you do then?

Answer 10: I told him to inform me if he does not like me anymore but he only
find excuses.

Question 11: When was the last time he boxed you?

Answer 11: Sometimes in the night of November 2015.

Question 12: What did you do then?

Answer 12: I cried and just sleep.

Question 13: Kindly tell me what happened the time you told me you were
threatened by him?

Answer 13: It was like this ma’am, between 1:00 to 2:00 PM of September
2018, we were telling stories until we argued inside our room in
Windy Hill, Poblacion, La Trinidad, Benguet then he went outside
our room and when he returned back he was already holding kitchen
knife.

Question 14: What did you do then?

Answer 14: I told him give me the knife and I will be the one to stab so that you
cannot be blame (“Iyeg mo ta kutsilyo ta siyak ti agsaksak ta hanka
pay makabasol”) however his father suddenly came that’s why he
hide the knife.

Question 15: I have no more questions to ask, do you have anything more to say
or add to your statement?

Answer 15: I just want to add that ther are times that he told me hurtful words
such as “Pakim”, “Ukinam”, “ukis-sabam”, “bullshit mo” and there
were time when he is in the influence of liquor he threw bottles of
liquors outside and act violently like boxing wall and anything that
he can see.

Question 16: Anymore?

Answer 16: None ma’am.

Question 17: If none, are you then willing to affix your signature in your
statement to attest the truthfulness of your statement under oath?

Answer 17: Yes, I will.

JUDICIAL AFFIDAVIT OF SOL B. NGITBI

I, SOL B. NGITBI, of legal age, single, and living at Windy Hill, Poblacion, La
Trinidad, Benguet, accused in this case, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Charry Neil B. Polinney with address at 007
Samoyao Alapang, La Trinidad, Benguet. The examination is being held at the
same address. I am answering his questions fully conscious that I do so under
oath and may face criminal liability for false testimony and perjury.

PURPOSE

This affidavit of accused SOL B. NGITBI is being offered to deny the


allegations made by the Complainant.
Question 1: Please state your name and other personal circumstances for the
records.

Answer 1: I am SOL B. NGITBI, 23 yrs. old, born on August 15, 1995, single,
driver, native of Buguias, Benguet and a resident at Windy Hill,
Poblacion, La Trinidad, Benguet.

Question 2: Do you know the complainant in this case?

Answer 2: Yes.

Question 3: How did you know the accused?

Answer 3: I met her when she and her father ask help to my father for filing
case against a man. She stayed in our boarding house for how many
days. I courted her until she answered me yes. She invited me to go
home with her in Ambaguio Nueva Viscaya. Her grandparents
suggested that we will have a traditional wedding because she is only
15 years old on that time. After a month, our traditional wedding was
celebrated. We stayed there for few months, but we decide to come
here in La Trinidad.

Question 4: How long have you been in a relationship as husband and wife?

Answer 4: Almost four years from the time we celebrated out traditional
wedding.

Question 5: Describe your relationship with your common law wife.

Answer 5: The first three years of our relationship was harmonious. She used to
be a loving wife.

Question 6: What happened on the following year?

Answer 6: Our relationship become “sour” when I went out for work, I work as
water delivery boy, bread delivery and as laborer. Sometimes I go to
other place to earn extra income in mining.

Question 7: While you are at work, how about Ms. Say?

Answer 7: She stayed at home at Windy Hill, taking care of our son (only more
than 1 year old) and doing household chores.
Question 8: Why you tell us that your relationship become sour?

Answer 8: One night, she leave us with our son, she went out. One of her friend
a waitress (a friend of mine also) in one of the Video Ok Bar at
Poblacion, La Trinidad texted me that Ms. Say was there with her text
mate drinking liquor. I leave my son asleep and proceeded to the said
Video Ok Bar. I saw them together in one table. Then I boxed the guy
on his face.

Question 9: What happened next?

Answer 9: I leave them, and I went home to look for our son.

Question 10: What happen next?

Answer 10: My common law wife went home in the boarding house of her
friend at Balili. After 2 days I look for her and asked forgiveness to her
for hurting her text mate and she forgives me. I convinced her to go
home with me at Windy Hill.

Question 11: When you argue with Say, did you do any physical violence
against her?

Answer 11: From the time we have our relationship I never hurt her physically.

Question 12: When was the last time you argue with Say?

Answer 12: Sometime in September 2018 a week after I boxed the guy. In our
room at Windy Hill we are telling stories and I express my bad feelings
about them with the guy. I confronted her. I went out from our room
and proceeded to the kitchen and get the kitchen knife. I attempted to
kill myself in front of her because of what they did to me.

Question 13: What happened next?

Answer 13: I put down the knife.

Question 14: Anymore?

Answer 14: None

the corresponding answer that he gave;

regarding his answers;
