LOCADOR LOCATARIO
This is a contract between ___________, Argentina with DNI _________ from
Argentina hereinafter called the LANDLORD, and ________ with passport
_____________, USA, residing_______________, hereinafter the TENANT, on the
other, it is agreed to enter into this Lease Agreement The contract is governed by the
following clauses, conditions and schedules are an integral part of this contract:
FIRST: PROPERTY: The LANDLORD leases to the TENANT and the TENANT leases
from the LANDLORD a furnished apartment of his property located on
--------------------------of this city. The property is rented with furniture and equipment in
accordance to the inventory that the parties shall sign on delivery of possession, which is
considered an integral part of this agreement.
SECOND: TERM: The term of this lease will begin in ___________ and will end on
_________________, definite and non-extendable date when the TENANT shall surrender
the property free of all personal belongings, intruders and occupants with no need for a
notice or demand by the LANDLORD. Should he remain in the property, a penalty of US$
150 wiil be charged for each extra day in addition to the cost of daily, rate.
THIRD: RENT: The total rent has been fixed in the ______________ dollars
( __________),. This amount includes the following services and taxes: building expenses,
cable TV, ABL, gas, electricity (max 200 pesos per period) , water, internet.
FOURTH: DEPOSIT: Upon due execution of this lease, the TENANT shall deposit with the
LANDLORD the amount of --------- USD as a damage deposit. This deposit shall not
accrue any interest nor shall it be applied to the payment of the lease. This deposit shall be
returned to the tenant in the same currency and quantity received, once the LEASE has
expired, the leased property has been actually vacated and after verification that the
property has suffered no damages and that there are no deteriorated or missing items
from the inventory. If damaged or missing items are verified, the corresponding amount will
be deducted from the deposit. If the damage deposit is not enough to cover all the
damages caused by the TENANT, he shall pay cash or replace in the same quantity and
quality, whatever he may have broken, damaged or lost.. Replacement keys: Tenant
agrees to pay u$s 150 if he/she loses their keys. If a key is lost, it is necessary to pay a
locksmith to come out and replace the lock to the door and we must make copies far all
our member staff. Please be careful with your keys.
FIFTH: USE OF THE PROPERTY: The property shall only be used for the Tenant's tourist
TEMPORARY ACCOMMODATION and for no other purposes and shall be occupied only
by the TENANT and his family group up to a maximum of ------------ people. The TENANT
shall not modify or make any alterations of any nature to the property. This lease is not
transferable and it is absolutely prohibited to transfer, sublet or grant in whole or in part this
property, neither claim to be benefited by Article 1598 of The Civil Code, of the lease.
SIXTH: TENANT'S DUTIES: The tenant declares he has examined the property and stated
that everything is working and in good condition. Therefore, upon expiration of the lease,
the tenant shall leave the property in the same general and good habitable condition as
when he/she checked in. If the property is not returned clean, US$ 50 will be charged as a
fine. Occupancy and use of the property and common areas that disturbs or offends other
guests or building residents are grounds for termination.
SEVENTH: INDEMNIFICATION: The LANDLORD shall not be liable for any physical ar
moral damage or injury of the TENANT and/or his family or third parties temporarily in the
property, which results from vandalism, terrorism, cataclysm, floods, leaks and loosening
of material arising from breakage or malfunctioning of the pipes or roofs or any other
accident that may happen in the leased property and that has nothing to do with
LANDLORD, who delivered the leased property in good rentable conditions. The
LANDLORD shall not assume any liability either for any personal belongings that may be
lost are stolen.
EIGTH: INSPECTION OF PROPERTY: The LANDLORD or his representative has the
right to enter the property for the purpose of inspecting it, with previous notice to the
TENANT of at least 24 hours. If the TENANT fails to comply with any of the material
covenants of this LEASE, the LANDLORD may terminate it and demand the Tenant's
immediate eviction of the leased property, with no obligation of indemnity on the part of the
LANDLORD.
TENTH: PAYMENT RECEIPT: Receipt of the sums set forth under the THIRD and
FOURTH covenants are hereby acknowledged and the present lease is sufficient proof of
payment.
ELEVENTH: JURISDICTION: The parties hereto agree that all actions or proceedings
arising in connection with this Agreement shall be tried and litigated exclusively in the
ordinary courts of the city of Buenos Aires, Argentina, waiving any other applicable
jurisdiction or court.
TWELTFH: TRANSLATION: A copy of the agreement has been attached to this contract as
an apendix. In the event of any discrepancies between the Spanish contract and the
Engish Translation, the SPANISH translation shall prevail.
In witness whereof, the parties sign two copies of the same tenor and to only one effect,
