1. BACKGROUND

1.1 The Government of India brought out a revised Centrally Sponsored Scheme for
Vocationalisation of Secondary and Higher Secondary Education (CSS for
VSHSE) by Ministry of HRD (MHRD) to integrate employability education into
School Education in September 2011. In 2018, this scheme got further revised and
brought under the integrated initiative (Samagra Shiksha) by MHRD and termed
as Vocationalization of School Education (VSE). The revised norms allow a
student to complete training in one Job Role in 9th and 10th standards; followed
by another Job Role in 11th and 12th standards. The scheme is operated within the
NSQF (National Skill Qualification Framework), which establishes a system of
clear educational pathways from school to higher education while providing
certification on vocational skills.
1.2 The State Government of Jharkhand hereinafter referred to as Jharkhand
Education Project Council (JEPC) has been implementing VSE in 260 Schools till
2018-19 as per approval and funding from MHRD.
1.3 JEPC is keen to outsource the Training Delivery in 128 secondary and senior
secondary schools for students in class IX, to be continued till class XII as
approved by Government of India, to NSDC approved Training Partners.
This EoI is intended to shortlist NSDC approved Training Partners for the following
trades in the schools (Annexure-4) of the State of Jharkhand.

SELECTION COMMITTEE ARE SUPPOSED TO TAKE UP THE FOLLOWING
ACTIVITIES:

2.1 Trainer Deployment – Provide full time trainer as per the trainer qualification
norms prescribed by the PSSCIVE Bhopal
2.2 Coordinator Deployment – Provide full time Coordinator as per the
Qualification suggested by JEPC.
2.3 Trainer’s Salary - The VTPs will pay the monthly honorarium to Vocational
Trainers.
2.4 VTP Coordinator Salary - The VTPs will pay the honorarium to VTP
Coordinator.
2.5 Training Delivery
2.5.1 Understand the Curriculum and Course content prepared by PSSCIVE
and ensure its delivery through its vocational Trainer, for each level
within stipulated time and meet the quality parameters.
2.5.2 Ensure conduct of internal formative assessments of students on a
periodic basis as per the norms of the Jharkhand Academic Council
(JAC), Jharkhand.

2.5.3 To ensure conduct of theoretical & practical classes as per Scheme
guidelines.
2.5.4 To ensure mobilization of students, parents, trainers and conducting
activities related to community awareness in consultation with schools
Principals.
2.5.5 To provide guidance and counselling services to the students and their
parents/guardians as and when required.
2.5.6 Prepare students for placement process including soft skills, to
facilitate placement of the eligible and desirous students in related jobs
after completion of class 12th.
2.5.7 To provide one Vocational Coordinator (VC) for every 30 schools
allocated.
2.5.8 Each Vocational Coordinator (VC) will visit minimum 15 schools in a
month and visit all schools at least twice in three months. VC should
submit their monthly visit plan to JEPC and concerning schools in 7
working days advance from the beginning of the next month.
2.6 Service Level Terms: Following Service Level Terms will have to be adhered by
the selected VTP
2.6.1 Complete the syllabus as per the time line.
2.6.2 Conduct practical sessions as per the syllabus.
2.6.3 To organize 1 (one) guest lecturers per month with a cap of 10 guest
lecture per job role per sector for each class in an academic year is

compulsory in each selected school.


2.6.4 To arrange industry visits to the student for their improvement in
practical exposure. VTPs shall arrange for a minimum of 3 (three)
industrial visits during an academic year for each class, as per industry
visit guidelines.
2.6.5 To arrange On Job Training (OJT) for at least 80 hours of students
after completing class 10, in their respective sector, when notified by
JEPC.
2.6.6 To provide for giving job to at least 70% of the eligible and interested
students at the end of Class 12th. Arrange campus interview where ever
possible and needed.
2.6.7 To provide Apprenticeship to at least 70% of the interested students
who are below the age of 18 and thereafter a job.
2.7 Role of JEPC

JEPC shall be responsible for activities such as:


2.7.1 Budgeting and expenditure – Obtaining and manage the MHRD
funding as per VSE and the State funds for the project implementation.
Allocate budget and sanction expenses in view of the sanctioned plan
per school for the activities/interventions identified and entrusted to

Training Partners, approved by NSDC and preferably affiliated to
respective SSCs, post selection by the State Government subject to
availability/approval /release of funds by the Central and State
Government.
2.7.2 Identification of districts/schools - Selection of districts and schools
where selected trade could be introduced.
2.7.3 Communication and marketing plan: To create awareness,
stakeholder engagement and bringing in the right talent into the NSQF
aligned program.
2.7.4 Identification of Training Partner: The State Government will
identify NSDC approved VTP for trades through the selection process
prescribed in the Expression of Interest issued by the JEPC on
30/08/2019.
2.7.5 Advisory Group: Creation of advisory/management group at the
various levels for monitoring/feedback/regular assessments as to be
decided from time to time by the JEPC.
2.7.6 Nodal Officers: Designate and recommend Nodal Officer at
Headquarters Level and also at District Level who will be responsible
for overseeing/reporting the implemented by VTPs
2.7.7 Training of Trainers: JEPC would undertake “Training of Trainers
(TOT)” program in consultation with respective Sector Skill Councils
(SSCs)/ PSSCIVE at periodic intervals to update the faculty /

instructors with the content developed, training methodology and


adaptation to industry needs as per the MHRD guidelines of the
scheme and norms laid down by SSCs. This will be executed
considering the financial ceiling fixed there under.
2.7.8 Infrastructure for Setting up of Lab: JEPC will ensure procurement
of equipment and instruments and setting up a lab-cum-classroom as
per the norms laid down by GoI.
2.7.9 Academic Certification: To ensure integration of the courses with the
scheme of studies of Jharkhand Academic Council, Jharkhand.
2.7.10 Maintenance of Tools & Equipment – The school and district
administration will maintain tools and equipment installed in the
school as well as ensure availability of raw material for practical
classes in the Schools.
2.7.11 Textbooks - JEPC shall provide the guidelines for the arrangement of
textbooks as per PSSCIVE guidelines.

3.1 Pre-Eligibility :
3.1.1 A non-refundable amount of Rs 1000/-(as DD from a nationalized
bank) for EOI security fees in favour of Jharkhand Education Project
Council payable at Ranchi.

3.1.2 Should be deposited by registered post only to State Project Director,
Jharkhand Education Project Council, Ranchi before bid opening date
and time.
3.2 Preference to VTPs affiliated to the respective Sector Skill Council (SSC) of the
identified sector and done trainings with the NSDC/SSC ecosystem.
3.3 Preference to the VTPs having their Operational SELF-OWNED training centres
in Jharkhand.
3.4 Preference will be given to VTPs already implementing VSE in Schools across
any other State.

4.1 Each VTP may apply for a maximum of THREE (3) trades.
4.2 JEPC reserves the right to add or remove the schools at given instance
4.3 The VTPs are bound to discharge their deliverables such as Career counselling,
Placements and Apprenticeship of students of last batch even if contract duration
expires.

5. PAYMENTS: The broad model is that VTP will be paid salary for the vocational trainers
and in addition per trainer administrative cost shall be charged by the VTP
5.1 Regarding Vocational Trainers (VTs) Honorarium
5.1.1 The VTP shall pay a gross honorarium not exceeding Rs.2.40 lakhs per
annum at Rs. 20,000 per month for 12 months in a year fixed to each
VT deployed by the VTP in the selected 128 schools.
5.1.2 Every VTP to ensure a buffer of at least 2 months honorarium of VTs
so that the payment can be made to VTs within the 15th of each month
and bill can be submitted on the 20th day of each month.
5.1.3 The invoice must be accompanied with section wise details summary
of expenditure sheet along with proper certified bills/vouchers etc.
5.1.4 The due amounts shall be paid by the JEPC to the VTP after
scrutinizing the invoices in another two months (60 days) from
submission of the invoices along with satisfactory supporting
documents as listed.
5.1.5 In case the VTP fails to make the payment of honorarium to VTs by
15th of each month, JEPC may impose a penalty of 1% of their entitled
management and monitoring expense from 1st day of the month and in
case the payment is delayed for two months and above, the VTPs will
not be eligible for any management and monitoring expense.

5.2 Regarding Vocational Coordinator (VCs) Honorarium

5.2.1 The VTP shall pay a gross honorarium not exceeding Rs.3.0 lakhs per
annum at the rate of Rs 25,000 per month for 12 months in a year fixed
to each Vocational Coordinator deployed by the VTPs.
5.2.2 The payment details are to be maintained in a transparent manner by
the VTPs.
5.2.3 VTPs will directly credit the honorarium to the VTP Coordinator's
account through ECS/RTGS. Every VTP will provide a copy of the
ECS/RTGS statement post transaction of the aforesaid amount,
monthly school visit and progress report to JEPC along with Invoice
with break up excel sheet.

5.3 Payment to VTPs by JEPC: For the service being provided by the VTPs,
JEPC shall pay to VTPs the following amounts:
5.3.1 Reimbursement of the amount equal paid to the VTs and VCs as
honorarium by the VTPs.
5.3.2 15 percent of the amount paid to the VTs towards honorarium. This
amount shall cover the cost of
5.3.2.1 Recruitment of VTs,
5.3.2.2 Management of VTs as leave reserve, appointing alternative
VTs (in case a VT quits or takes long term leave), and

5.3.2.3 Miscellaneous expense for the handling of the Project.
5.3.3 Payment of honorarium at Rs.500 per lecture of at least one hour
duration will be made for the unit/class consisting of students up to 40.
VTPs will have to arrange one guest lecture per month, amounting to
10 guest lectures per academic year for each class (class IX to XII). In
case of outstation, guest faculty actual travel will be reimbursed
subject to the prior approval from concerned School Principal &
SMDC Chairman. VTP need to provide acknowledgement from Guest
Lecturer, counter signed by the Head of the School to JEPC, along
with copy of Guest Lecture Report which will be considered as proof
of expense for the present clause.
5.3.4 VTPs will have to arrange for Three (3) industrial visits each academic
year to industrial and commercial establishment for class IX to XII as
per the industry visit guidelines.
5.3.5 Maximum Rs. 25000/- per annum per sector per school towards office
expenses (for awareness, publicity (IEC), guidance of transport,
internet, stationary, communication charges and field visits of
coordinators and expenses related to travel) per VTP per Vocational
Trainer per year. The actual Non-AC travelling fare (by Public/shared
Transport) is permissible for field visit of Vocational Coordinator, on
submission of bill and / or vouchers.

5.4 Other Tenets


5.4.1 In addition, the State Government will reimburse the actual expenses
to the VTPs for the activities that the VTPs will undertake for the
effective implementation of the scheme. The activities are as follows:
Guest Lectures, OJTs, Field Visits, and Office Expense etc.
5.4.2 The VTP shall provide a single point of contact with JEPC and shall be
solely responsible for the execution and delivery of the work. It shall
not further outsource the work to a 3rd party including its franchisees /
licensees.
5.4.3 VTP shall give notice to school and JEPC 1-month before they replace
any VT (Either VT resigns or VTP removes him/her).
5.4.4 Formats of Different Reports (SOPs, Vocational Trainer
attendance/inspection report/ Vocational Coordinator Visit Report/
Guest Lecture Report/Field/Industry Visit Report etc.) for proper
monitoring and implementation of the Project will be finalized and
may be drafted and shared with all the VTPs in advance. In case of any
change in the format, the revised version during the project period will
be intimated to the VTPs by JEPC

6. WAY FORWARD

6.2 A list of ELIGIBLE Vocational Training Partners shall be prepared based on the
eligibility conditions mentioned above (chart name: “ELIGIBILITY
CONDITIONS”).
6.3 Based on evaluation criteria, the eligible Vocational Training Partners will be

evaluated, and a list of shortlisted Vocational Training Partners will be prepared


depending on the requirements of the sector.
6.4 Final number of VTPs selected for implementation is the discretion of State Govt.
In case of Sectors where number of schools is less, Training Partners having
expertise in multiple sectors may be preferred considering operational feasibility.
6.5 Through evaluation, number of VTPs shortlisted will be at a ratio of 1:3 (number
of VTPs to be selected: number of VTPs to be shortlisted). This ratio may alter
depending upon the number of eligible VTPs showing willingness to participate
(applied) / qualification points secured by any VTP in the mentioned sectors (as
specified below). Total number of shortlisted VTPs will not exceed the count as
specified in the EoI document / 10 (In case of number of VTPs to be selected is
more than 3), in any sector until and unless any exceptional scenario arises as
mentioned below.
6.6 Through evaluation, VTPs are listed in descending order of marks obtained by
them. In case, as per evaluation criteria, the last shortlisted partner obtains the
same marks with the next in the list, then more number of VTPs may be
shortlisted.
6.7 Shortlisted Training Partners in each sector will be required to make a
presentation to the State Government for technical presentations.

6.8 Final selection of Training Partners will be done by the State Level Selection
Committee formed by State Government. For each sector the ranking of the VTPs
would be done according to the total Qualification Points received.
6.9 Indicative Contract Period: Initial contract period is of two (2) academic year
session from the year 2019-20 and maybe extended further subject to overall
annual performance.
6.10 Performance Security Deposit- The approved training partner should deposit
with the JEPC a sum of Rs 10,000 per trade per school as security deposit for
the due and faithful performance of the agreement within 15 days of signing the
contract, it shall be forfeited in the event of supplier not performing his duties as
per terms of agreement. Bank Guarantee from any nationalized bank in the name
of Jharkhand Education Project Council should be provided. This deposit shall be
renewed on every expiry of the financial year till the time agreement is in force.
6.11 Project Site: 128 Schools have been selected for the project as per PAB 2019-20.
33 existing schools are also listed for VTP replacement. The list of schools is
provided at Annexure 4.

7. APPLICATION PROCEDURE
7.1 All applications shall be submitted in sealed envelopes through registered post or
courier. Applications submitted either by facsimile transmission or e-mail shall
not be acceptable.

7.2 If the envelope is not sealed and marked as instructed above, JEPC assumes no
responsibility for the misplacement or premature opening of the contents of the
Application submitted and such Application may at the sole discretion of JEPC,
be rejected.
7.3 All the Applicants are entitled to submit one Application either as an individual or
as a member of Consortium. An Applicant cannot submit an Application in
response to this EOI both as an individual and as a member of Consortium. In case

an Applicant submits, more than one Application in response to this EOI then all
the Applications submitted by the Applicant would be rejected.
7.4 Interested Training Partners would be required to apply through JEPC and should
strictly adhere to the following instructions:

7.4.11 In case the Partner does not submit any of the aforesaid
supporting documents (as specified ONLY), the related data
provided in the proposal will not be considered for the concerned
parameters. In such cases, the related data will be considered as
‘0’ (‘zero’ in case of numeric data) and/or ‘Negative’ (in case of
factual data)

8. SELECTION PROCESS
8.1 The Applications received shall be scrutinised for completeness and fulfilment of
minimum requirements for eligibility as detailed out in elsewhere in this EOI.

8.2 A Sector wise list of applicants who fulfil the minimum eligibility criterion shall
be prepared and called as LIST-1
8.3 The LIST-1 Applicants shall be awarded points as per the criteria mentioned

8.4 Up to a maximum of three applicants scoring highest points per sector, shall be
shortlisted. This shall be called LIST-2

8.5 The applicants in LIST-2 shall be invited to make a detailed presentation to the
JEPC Selection Committee. The Committee shall award points as per the criteria
given in the following table:

8.7 The selected VTPs shall enter into a written Service Level Agreement with
JEPC within 7 days of the finalization of LIST-3 and intimation to the VTPs.

Annexure – 5
Terms and Condition
1. EXCLUSION OF EOI/ DISQUALIFICATION
1.1 JEPC shall exclude/ disqualify an EOI, if: -
1.1.1 the information submitted, concerning the qualifications of the
applicant, was false or constituted a misrepresentation; or
1.1.2 the information submitted, concerning the qualifications of the
applicant, was materially inaccurate or incomplete; and
1.1.3 the applicant is not qualified as per pre-qualification/ eligibility criteria
mentioned in the bidding document;
1.1.4 the EOI materially departs from the requirements specified in the
bidding document or it contains false information;
1.1.5 the applicant, submitting the EOI, his agent or any one acting on his
behalf, gave or agreed to give, to any officer or employee of the JEPC
or other governmental authority a gratification in any form, or any
other thing of value, so as to unduly influence the procurement
process;
1.1.6 An applicant, in the opinion of the JEPC, has a conflict of interest
materially affecting fair competition.
1.1.7 Applicant should submit the proposal only in the prescribed format and
in sequencing order with index.

1.2 An EOI shall be excluded/ disqualified as soon as the cause for its exclusion/

disqualification is discovered.
1.3 Every decision of JEPC to exclude an EOI shall be for reasons to be recorded in
writing and shall be:
1.3.1 Communicated to the concerned applicant in writing;
1.3.2 Published on the State Public Procurement Portal, if applicable.

2. JEPC’S RIGHT TO ACCEPT OR REJECT ANY OR ALL EOI’S


2.1 The JEPC reserves the right to accept or reject any proposal, and to annul (cancel)
the EoI process and reject all proposals at any time prior to award of contract,
without thereby incurring any liability to the applicants.
2.2 JEPC makes no commitments, explicit or implicit, that this process will result in a
business transaction with anyone.
3. CANCELLATION OF EOI PROCESS
3.1 If EoI process has been cancelled, it shall not be reopened but it shall not prevent
the JEPC from initiating a new EoI process for the same subject matter of EoI, if
required.
3.2 JEPC may, for reasons to be recorded in writing, cancel the process of EOI
initiated by it -
3.2.1 at any time prior to the acceptance of the successful EOI; or

3.2.2 After the successful EOI is accepted in accordance with (3.5) and (3.5)
below.
3.3 The decision of the JEPC to cancel the EoI and reasons for such decision shall be
immediately communicated to all applicants that participated in the EOI process.
3.4 If the applicant who’s EOI has been accepted as successful, fails to sign any
written contract as required, or fails to provide any required security for the
performance of the contract, the JEPC may cancel the process.
3.5 If an applicant is convicted of any offence the JEPC may: -
3.5.1 cancel the EOI of the convicted applicant who has been declared as
successful, but no contract has been entered into;

4. CODE OF INTEGRITY FOR APPLICANTS


4.1 No person participating in the EOI process shall act in contravention of the code
of integrity prescribed by the State Government.
4.2 The code of integrity include provisions for: -
4.2.1 Prohibiting
4.2.1.1 any offer, solicitation or acceptance of any bribe,
reward or gift or any material benefit, either directly or
indirectly, in exchange for an unfair advantage in the
procurement process or to otherwise influence the
procurement process;

4.2.1.2 any omission, including a misrepresentation that misleads


or attempts to mislead so as to obtain a financial or other
benefit or avoid an obligation;
4.2.1.3 any collusion, EOI rigging or anti-competitive behaviour to
impair the transparency, fairness and progress of the
procurement process;
4.2.1.4 improper use of information shared between the JEPC and
the applicants with an intent to gain unfair advantage in the
procurement process or for personal gain;
4.2.1.5 any financial or business transactions between the applicant
and any officer or employee of the JEPC;
4.2.1.6 any coercion including impairing or harming or threatening
to do the same, directly or indirectly, to any party or to its
property to influence the procurement process;
4.2.1.7 any obstruction of any investigation or audit of a
procurement process;
4.2.2 disclosure of conflict of interest;
4.2.3 Disclosure by the applicant of any previous transgressions with any
entity in India or any other country during the last three years or of any
debarment by any other JEPC.

4.3 Without prejudice to the provisions below, in case of any breach of the code of
integrity by a applicant or prospective applicant, as the case may be, the JEPC
may take appropriate measures including: -
4.3.1 exclusion of the applicant from the procurement process;
4.3.2 calling-off of pre-contract negotiations;
4.3.3 forfeiture or encashment of any other security or bond relating to the
procurement;
4.3.4 recovery of payments made by the JEPC along with interest thereon at
bank rate;
4.3.5 cancellation of the relevant contract and recovery of compensation for
loss incurred by the JEPC;
4.3.6 Debarment of the applicant from participation in future procurements
of the JEPC for a period not exceeding three years.

5. INTERFERENCE WITH EOI PROCESS


5.1 An applicant, who: -
5.1.1 withdraws from the process after opening of EOI’s;
5.1.2 withdraws from the process after being declared the successful
applicant;
5.1.3 fails to enter into contract after being declared the successful applicant;

5.1.4 fails to complete the contract period after getting the contract
shall, in addition to the recourse available in the EoI document or the
contract, be punished with fine which may extend to fifty lakh rupees or
fifteen per cent of the assessed value of the contract with the applicant, whichever
is greater.
6. APPEALS
6.1 Subject to “Appeal not to lie in certain cases” below, if any applicant or
prospective applicant is aggrieved that any decision, action or omission of
the procuring entity is in contravention to the provisions of the Act or the
rules or guidelines issued there under, he may file an appeal to such officer of the
JEPC, as may be designated by it for the purpose, within a period of 10 days from
the date of such decision or action, omission, as the case may be, clearly giving
the specific ground or grounds on which he feels aggrieved:
6.1.1 Provided that after the declaration of a applicant as successful in terms
of “Award of Contract”, the appeal may be filed only by an applicant
who has participated in procurement proceedings:
6.1.2 Provided further that in case a JEPC evaluates the technical EOI before
the opening of the financial Bid, an appeal related to the matter of
financial EOI may be filed only by a applicant whose technical EOI is
found to be acceptable

6.2 The officer to whom an appeal is filed under (a) above shall deal with the appeal
as expeditiously as possible and shall endeavour to dispose it of within 30 days
from the date of filing of the appeal.
6.3 If the officer designated under (a) above fails to dispose of the appeal filed under
that sub-section within the period specified in (b) above, or if the applicant or
prospective applicant or the JEPC is aggrieved by the order passed, the applicant
or prospective applicant or the JEPC, as the case may be, may file a second appeal
to an officer or authority designated by the State Government in this behalf within
15 days from the expiry of the period specified in (b) above or of the date of
receipt of the order passed under (b) above, as the case may be.
6.4 The officer or authority to which an appeal is filed under (c) above shall deal with
the appeal as expeditiously as possible and shall endeavour to dispose it of within
30 days from the date of filing of the appeal:
6.5 The officer or authority to which an appeal may be filed under (a) or (d) above
shall be :
6.5.1 First Appellate Authority: Administrative Officer, JEPC
6.5.2 Second Appellate Authority: State Project Director, JEPC
6.6 Form of Appeal:
6.6.1 Every appeal under (a) and (c) above shall be as per Annexure-10
along with as many copies as there are respondents in the appeal.
6.6.2 Every appeal shall be accompanied by an order appealed against, if

any, affidavit verifying the facts stated in the appeal and proof of
payment of fee.
6.6.3 Every appeal may be presented to First Appellate Authority or Second
Appellate Authority, as the case may be, in person or through
registered post or authorised representative.
6.7 Fee for Appeal: Fee for filing appeal:
6.7.1 Fee for first appeal shall be rupees two thousand five hundred and for
second appeal shall be rupees ten thousand, which shall be non-
refundable.
6.7.2 The fee shall be paid in the form of bank demand draft or banker’s
cheque of a Scheduled Bank payable in the name of Appellate
Authority concerned.
6.8 Procedure for disposal of appeal:
6.8.1 The First Appellate Authority or Second Appellate Authority, as the
case may be, upon filing of appeal, shall issue notice accompanied by
copy of appeal, affidavit and documents, if any, to the respondents and
fix date of hearing.
6.8.2 On the date fixed for hearing, the First Appellate Authority or Second
Appellate Authority, as the case may be, shall,-
6.8.2.1 hear all the parties to appeal present before him; and

6.8.2.2 Peruse or inspect documents, relevant records or copies
thereof relating to the matter.
6.8.3 After hearing the parties, perusal or inspection of documents and
relevant records or copies thereof relating to the matter, the Appellate
Authority concerned shall pass an order in writing and provide the
copy of order to the parties to appeal free of cost.
6.8.4 The order passed under (c) shall also be placed on the State Public
Procurement Portal.
6.9 No information which would impair the protection of essential security interests
of India, or impede the enforcement of law or fair competition, or prejudice the
legitimate commercial interests of the applicant or the JEPC, shall be disclosed in
a proceeding under an appeal.

7. STAY OF PROCUREMENT PROCEEDINGS


7.1 While hearing of an appeal, the officer or authority hearing the appeal may, on an
application made in this behalf and after affording a reasonable opportunity of
hearing to the parties concerned, stay the procurement proceedings pending
disposal of the appeal, if he, or it, is satisfied that failure to do so is likely to lead
to miscarriage of justice.
8. VEXATIOUS APPEALS & COMPLAINTS

8.1 Whoever intentionally files any vexatious, frivolous or malicious appeal or


complaint under the “The Jharkhand Transparency Public Procurement Act 2012”,
with the intention of delaying or defeating any procurement or causing loss to any
JEPC or any other applicant, shall be punished with fine which may extend to
twenty lakh rupees or five per cent of the value of procurement, whichever is less.

9. OFFENSES BY FIRMS/ COMPANIES


9.1 Where an offence under “The Jharkhand Transparency Public Procurement Act
2012” has been committed by a company, every person who at the time the
offence was committed was in charge of and was responsible to the company for
the conduct of the business of the company, as well as the company, shall be
deemed to be guilty of having committed the offence and shall be liable to be
proceeded against and punished accordingly: Provided that nothing contained in
this sub-section shall render any such person liable for any punishment if he
proves that the offence was committed without his knowledge or that he had
exercised all due diligence to prevent the commission of such offence.
9.2 Notwithstanding anything contained in (a) above, where an offence under this Act
has been committed by a company and it is proved that the offence has been
committed with the consent or connivance of or is attributable to any neglect on
the part of any director, manager, secretary or other officer of the company, such

director, manager, secretary or other officer shall also be deemed to be guilty of
having committed such offence and shall be liable to be proceeded against and
punished accordingly.
9.3 For the purpose of this section-
9.3.1 "company" means a body corporate and includes a limited liability
partnership, firm, registered society or co- operative society, trust or
other association of individuals; and
9.3.2 "Director" in relation to a limited liability partnership or firm, means a
partner in the firm.
9.4 Abetment of certain offenses: Whoever abets an offence punishable under this
Act, whether or not that offence is committed in consequence of that abetment,
shall be punished with the punishment provided for the offence.

10. DEBARMENT FROM SUBMISSION OF EOI

10.1 A applicant shall be debarred by the State Government if he has been


convicted of an offence
10.1.1 under the Prevention of Corruption Act, 1988 (Central Act No. 49 of
1988); or
10.1.2 under the Indian Penal Code, 1860 (Central Act No. 45 of 1860) or any
other law for the time being in force, for causing any loss of life or

property or causing a threat to public health as part of execution


of a public procurement contract.
10.2 A applicant debarred under (a) above shall not be eligible to participate in a
procurement process of any JEPC for a period not exceeding three years
commencing from the date on which he was debarred.
10.3 If a JEPC finds that an applicant has breached the code of integrity prescribed
in terms of “Code of Integrity for applicants” above, it may debar the applicant for
a period not exceeding three years.
10.4 Where the entire performance security or any substitute thereof, as the case
may be, of an applicant has been forfeited by a JEPC in respect of any
procurement process or procurement contract, the applicant may be debarred from
participating in any procurement process undertaken by the JEPC for a period not
exceeding three years.
10.5 The State Government or a JEPC, as the case may be, shall not debar an
applicant under this section unless such applicant has been given a reasonable
opportunity of being heard.
