SUBJECT: - LEGAL NOTICE U/S 138 OF THE NEGOTABLE INSURUMENT

ACT READ WITH SECTION 141, FOR DEMANDING AN AMOUNT
OF RS.96, 000/- (RUPEES NINETY SIX THOUSANDS ONLY)

Under Instructions on and behalf of my client SH .GANGA PRASAD S/o ,

R/o HOUSE NO PUNJABI COLONY New Delhi-110082, hereby serve upon you
this legal notice.

1. That my client is a law abiding citizen and Doing Wholesale Trading of Pepsi
beverages you have very good business relation with my client.

2. That you the above said addressee approached to my client in month of March 2019
and requested a friendly loan of Rs 1,00,000/-and according to your wish /desire,
my client agreed to give you the said amount on your dire need and requirement but
due some financial crunch my client only arrange 96,000/-( Ninty Six Thousands
only) from cash sale.
3. That you the above said addressee promises to returned the aforesaid amount with
in 3 Months and promise to pay the handsome interest on the principal amount.

4. That when my aforesaid client asked his amount after expiry of three months, you
did not take any heed on my clients requested and prolonged the loan amount on
one pretext to another, or the reason best known to you the above said addressee.

5. That finally after many visits to your place and after great persuasion in the second
week of june 2019 you above said addressee came to my clients shop with folded
hands felt sorry and assure that the amount taken shall be paid shortly and issued a
cheque bearing No.062840, drawn on Union Bank, Shram Shakti Branch, New
Delhi-110001, dated 21/06/2019, for an amount of Rs 96,000/-(Ninety Six
Thousand Only) and left the premises with the assurance that the same shall be
honored on presentation.

6. That my client faith upon on your words presented the afore said cheque with its
banker on 25/06/2019 but unfortunately the same above said cheque was
dishonored with the remarks, “Funds Insufficient” vide memo date
26/06/2019.Upon this .my client shocked and surprise and apprised this facts to
you on phone but you did not bother and prolonged the matter on one pretext to
another and straight away denied for making payment and finally with no other
option remained to my client to send you this legal notice.

7. That I finally called upon you to pay the aforesaid amount within fifteen days from
the receipt of this legal notice failing which you the above said addressee are liable
for committing an offence under section 138 of N. I. Act. Any failure on your part
would entitle my clients to proceed against you under Criminal Procedure Code,
IPC and chapter XVII of the Negotiable Instruments Act.

8. It is brought to your notice that as per the provisions of chapter XVII of the
negotiable Instruments Act, the dishonoring of cheque attracts imprisonment to the
extent of two year or with fine or with both.

9. You shall ignore this notice at your own peril & cost and consequences and my
client has given me strict instruction, that non payment of cheque amount by you I
shall filed the case under specific provision of law.

Copy of this notice is retained in my chambers for future necessary action, if it so desired.
