SERVICE RULES

The following services rules(01 – 53, from page 01 to 07) are of Baba Saudan Singh Veermati Devi
Public School, Kurawali, Luheta, Mursan, Hathras, UP (CBSE Aff No. 2131732, School No. 55219). These
rules include the provisions of the Right of Children to Free and Compulsory Education Act (RTE Act)
2009, Uttar Pradesh Education Act and CBSE Affiliation Bye – Laws in its entirety wherever required.
The School Management Committee adapted and enacted these service rules on date 26 day Thursday
Month October Year 2017 and made them effective from the same date, day, month& year onwards.
Now, some amendments have been made in Service Rule No. 01,02,04,10,16,24,31 and 34 by the
School Management Committee on ________________ in its meeting held on the same day. The Service
Rules of BSSVDPS, Kurawali, Hathras, U.P. after amendments are given below-
1- The School Management Committee (the Governing Body of the School) has the authority of
appointment, confirmation, promotion, demotion, suspension, and termination etc. of all of the
employees of the school. However, this authority is delegated to the Principal of the school with
regard to teachers as well as librarian and employees of the Principal’s office.
2- The Principal is the Head of Academic Administration only in the school premises. He is ex-officio
Hon. Secretary of the School Management Committee. All the academic staff (teachers as well as
librarian and employees of Principal’s office) has to work under his/her order and instruction. He /she
runs only overall academic administration of the school. The appropriate authority is delegated to
him/her to do his/her work properly. He/she is accountable/responsible to the School Management
Committee (the Governing Body of the School) of which orders and instructions he/she has to follow.
3- Whenever the Principal is on leave or absent or unavailable in the school premises due to any reason,
the Vice – Principal will work as the In – charge Principal. If the Vice – Principal also is on leave or
absent or unavailable in the school premises due to any reason or if there is no Vice – Principal, the
senior most Post Graduate Teacher(PGT) will work as the In-charge Principal. If the senior most PGT
also is on leave or absent or unavailable due to any reason, the Examination In-charge will work as
the In-charge Principal. If the Examination In-charge also is on leave or absent or unavailable due to
any reason, any other senior most available teacher will work as the In-charge Principal.
4- The Principal can delegate his/her authority to any employee under him for doing any specific work
for which that employee, to whom the authority is delegated, shall be responsible.
5- All the teachers will be appointed on the basis of minimum qualification as determined by the
National Council for Teacher Education (NCTE) read with rule 53 of CBSE Affiliation Bye – Laws.

6- All the non-teaching staff will be appointed on the basis of minimum qualification as prescribed by
Uttar Pradesh Government.
7- The school shall ensure that all appointments be in accordance to rule 25 of CBSE Affiliation Bye –
Laws and / or procedure prescribed in UP Education Act.
8- The school shall ensure that the vacancies of teachers shall not exceed 10% of the total sanctioned
strength of the teachers as required under sec. 28 of RTE Act 2009.
9- (A) The school shall pay salaries and admissible allowances to the staff not less than the
corresponding categories of employees in the State Government Schools or as scales etc. prescribed
by the Government of India (CBSE Affiliation Bye – Laws, Rule 3.3 – v ). Salaries with admissible
allowances shall be paid to the staff only through bank accounts of the employees or through bank
account payee cheques.
(B) The school shall give liberal increment to the staff from the first month of every session not less
than the corresponding categories of employees in the State/Central Government Schools. Every
employee after completing at least nine months’ continuous service shall be entitled to get the benefit
of increment.
10- All the employees shall be employed in the first instance on probation for a period of one year/on
temporary basis. The period of probation may be extended by the Governing Body of the school for a
further period not exceeding one year. The information of such extension with genuine reason shall
be given in writing to concerned employees. The total probationary period shall in no case exceed
two years.
11- After satisfactory completion of the probationary period the services of the employees shall be
confirmed with effect from the expiry of the said period of probation or the extended period of
probation and the confirmation letter shall be served to them.
12- If the work and conduct of the employees during the period of probation or extended period of
probation are not found satisfactory, the services of the employees are liable to be terminated by
serving one month notice in writing to them or one month salary in lieu of the same before the expiry
of the period of probation. The same can be done by the employees if they want to leave the service
before the expiry of the period of probation.
13- The employees shall be entitled to the benefits of Employee Provident Fund and shall be governed by
the rules of that Fund as in force from time to time. They shall also be entitled to the benefits of
Medical, EL, free education upto two children and other facilities determined by the Governing Body
of the school from time to time.

14- The employees shall during their service be eligible, subject to the exigencies of the school, to get one
Casual Leave in one month. If any employee does not take CL, he/she will be paid one day extra
salary with his/her monthly salary. The CL is not claimable as a matter of right but may be granted at
the discretion of the Governing Body of the school/Principal of the school.
15- Unless the service of the employee is terminated, he/she shall continue in the employment of the
school till he/she attains the age of superannuation as per State Govt. rule, when he/she shall retire,
provided that the School Management Committee or any other person authorized by it in its behalf
may retain his/her service for a further period as admissible according to rules of the State Education
Deptt. for such extension if the employee is fit for such extension and has no mental or physical
incapacity which would disentitle him to get such extension provided further that the extension shall
not exceed one year at a time.
16- On retirement or otherwise relinquishing the job, even in the case of resignation, the employee shall
be entitled to the benefit of Gratuity under the school rules as in force from time to time.
17- During the service the employee will be liable to disciplinary action in accordance with the rules and
regulations framed by the school from time to time for any act of insubordination, intemperance or
other misconduct or the commission of an act which constitute a criminal offence, or the non-
performance of duties assigned to him/her. These rules will normally conform to the Govt. rules in
this behalf.
18- If the employee is suspended from duty during investigation into any charge of his conduct
mentioned above, he/she shall not be entitled to any pay during such period of suspension but shall be
entitled to receive a Subsistence Allowance as prescribed by Govt. Rules normally.
19- If the employee is exonerated from the charge brought against him/her, he/she shall be paid his/her
salary including all allowances for the period, if any, during which he/she was suspended and
Subsistence Allowance already paid will be adjusted.
20- The school will follow the same disciplinary procedure as is given in Rule 44 of CBSE Affiliation
Bye – laws.
21- The school may impose penalties on the employees whenever required as per rule 45, 46 & 47 of
CBSE Affiliation Bye – laws.
22- The school shall form a Disciplinary Committee as per Rule 49 of CBSE Affiliation Bye – Laws.
23- The school shall keep Service Books and Confidential Rolls of all of its employees as per Rule 43 of
CBSE Affiliation Bye – Laws.

24- (A) The Governing Body / the Principal may terminate the services of the employee as provided in
Rule 29 chapter VII of the CBSE Affiliation Bye – Laws by giving three months’ notice in writing
with genuine reason or three months’ salary including all allowances to the employee in case he/she
is a confirmed employee. Similarly, if after confirmation the employee wants to relinquish his/her
job, he/she shall be required to give three months’ notice in writing with genuine reason or three
months salary including all allowances to the Governing Body / The Principal.
(B) Notwithstanding anything said above in this regard, the services of the Principal may be
terminated/suspended either before confirmation or after confirmation by the School Management
Committee only by passing a Resolution in this regard showing genuine reason with 2/3 majority of
its total members. A certified true copy of this Resolution must be handed over to the concerned
Principal along with the Letter of Termination/Suspension and signature for receiving the same must
be taken from the concerned Principal on the photocopy of that Resolution and Letter of
Termination/Suspension. From the date of such receiving the concerned Principal shall be considered
as terminated/suspended.
(C) The employees shall be given proper opportunities to put their side in their defence before the
competent authority if termination, demotion, suspension or any other action is to be taken against
them either before or after confirmation.
(D) Termination of service of the employees either before or after confirmation is to be taken as last
action. Before it other available measures are to be used to deal with the employee.
25- The employee shall apply himself/herself honestly, diligently and efficiently under the orders and
instructions of the Governing Body/ Principal / any of the authorized member of the staff under
whom he/she shall be placed as teacher/employee in the school and shall always act in paramount
interest of the institution.
26- The employee will conform to all the rules and regulations of the school in force from time to time.
27- The employee shall not apply or appear for interview etc. for any job outside the school without the
prior written permission of the authorized officer of the school. If he/she has already applied before
joining this school, it will be his/her duty to inform the Governing Body (School Management
Committee)/ the Principal at the time of appointment and seek written permission, if he/she is
required to appear for interview later on.
28- The employee shall devote his/her whole time to duties assigned and shall not directly or indirectly
carry on or be concerned in any trade or business whatsoever which is likely to interfere with the due
and efficient discharge of his school duties.

29- The employee will not on any pretence absent himself from duties without first having obtained the
permission of the Principal / the Governing body or in the case of sickness or accident without
forwarding a medical certificate to the satisfaction of the Principal / the Governing Body. If any
employee remains absent without informing the competent authority and getting permission, two
days’ salary per day absence will be deducted from his/her monthly salary.
30- The employee shall not leave the station without having first obtained the written permission of the
authorized officer of the school.
31- A teacher is expected to maintain the documents such as Students Attendance Register(Class
Register) of the class for which he/she is the Class Teacher, Personal Log Book and Class Log Book,
Program of Instruction and Lesson Plans, Cumulative Result of his/her Class, Attendance Diary of
optional subjects in case of teachers teaching such optional subjects, Stock Register of properties held
by him/her, Cumulative Record Book, Fee Collection Book of the class for which he/she is a Class
Teacher and any other document asked by the Principal.
32- Every employee is expected to reach the school punctually and sign at the Attendance Register on
arrival and mark the time before the working of the school begins and also sign at the time of
departure and mark exact time. An employee who has not signed the Attendance Register is liable to
be considered absent from duty for that date. If an employee leaves the school at the time of departure
without putting his/her signature and marking the exact time, he/she shall be marked DSPS (departed
from School without putting signature) and his/her ½ day salary shall be deducted. If an employee
puts signature of departure at the time of putting signature for arrival, his/her ½ day salary shall be
deducted as a disciplinary measure.
33- As per Rule 36 of CBSE Affiliation Bye – Laws representation to the School Management
Committee, the Chairman of the society or Manager may be made only through the Principal in case
of teacher/other employees. The Principal may submit his/her representation to the School
Management Committee / Chairman of the Society through his next higher up the Manager /
Correspondent of the school.
34- As per Rule 37 of CBSE Affiliation Bye-Laws no teacher shall be permitted to apply for adding
qualification before completing two years’ service, however, individual cases duly recommended by
the Principal may be considered by the School Management Committee under special circumstances
before completion of two years.

35- The school has approved the same code of conduct for teachers/employees as it is given in Rule 42 of
CBSE Affiliation Bye –Laws.
36- The school shall ensure that teachers are given specific academic duties as provided under sec. 24 (1)
of RTE Act 2009, read with rule 21(2) of RTE Rules 2010. They may not be deployed for non-
academic activities as per direction given by the CBSE vide circular no. CBSE/Aff. 04 /Circular/2016
dated 28th October 2016.
37- No teacher shall engage in private tuition or private teaching activities as per sec. 28 of RTE Act
2009 and rule 39 of CBSE Affiliation Bye-Laws.
38- As per Rule 10.5 and 32 of CBSE Affiliation Bye – Laws normally a teacher shall be engaged as a
whole time employee in the school except in special cases wherein the work load does not justify a
whole time teacher due to its unique nature. No teacher, teaching secondary and/ or senior secondary
classes shall be required to teach more than 3/4th of total periods in a week.
39- The working days and holidays will be as per State Government Schools or Kendriya Vidhyalayas.
40- The working hours will be such as may be specified from time to time by the Principal. Normally the
working hours will conform to the Kendriya Vidhyalayas. Working hours may be different for
teaching and office staff as may be specified by the Principal.
41- As and when required an employee may be assigned any special duty even if it is to be done beyond
the normal working hours in the interest of the school.
A teacher is also required to conduct and organize co-curricular programs even beyond the
normal working hours if needed.
42- The school shall ensure timely promotion and benefit of Modified Assured Career Progression
(MACP) to its teachers at par with teachers working in the similar grades in Central/State Govt.
Schools.
43- The school shall prescribe transparent and objective Annual Performance Appraisal System on the
lines similar to APAR in respect of teachers under Central/State Government, which shall be the basis
for promotion and /or MACP.
44- The school shall enter into a Contract/Agreement of Service with the employees in accordance to
Appendix III of CBSE Affiliation Bye-Laws.
45- The school shall give due recognition to the academic responsibilities of the teachers and involve
them in the educational activities in a dignified manner.

46- The school shall not retain the original degree/ diploma/ mark sheet/ certificate/ important document
of the employees after their appointment. Self attested photocopies of degrees/ diplomas/ mark sheets
/ certificates shall be placed in the personal file of the teacher in lieu of the original documents.
47- The school shall establish the ‘Internal Grievance Redressal Mechanism’for the teachers as mandated
under sec. 24(3) of RTE Act 2009.
48- The school shall provide in-service training facility for the teachers on similar lines as mandated
under sections 8 (i) and 9(i) of RTE Act 2009 regarding Appropriate Government and Local
Authority respectively or the school shall organize at least one week training program for the teachers
in association with any Teacher’s Training Institute recognized by the Central / State Government or
by any agency identified by the CBSE.
49- The school shall constitute an ‘Internal Complaints Committee’ and take appropriate action as per the
provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal)
Act 2013.
50- The school shall ensure that the School Library has appropriate books/ periodicals useful for teachers
and designate a dedicated area for them in the Library to enrich their subject knowledge.
51- The school shall ensure adequate provisions for staff rooms, crèche facility, canteen facility, separate
rest rooms and other welfare measures for teachers/employees.
52- The school shall always adhere to the instructions given by the CBSE or Central / State Govt. from
time to time with regard to the service conditions of the employees.
53- In the better interests of the institution and its employees the Governing Body/ Principal can frame
other rules as per requirement from time to time.
The above mentioned Service Rules are binding in nature, letter and spirit for both the Governing Body of
Baba Saudan Singh Veermati Devi Public School, Kurawali, Luheta, Mursan, Hathras, U.P. (CBSE Aff. No.
2131732 and School No. 55219) and its employees.
