1st Speaker Opposition: Asserts that the problem is non-existent, or that there exists a fault in the

(Opening Introduction) Good _________ ladies and gentlemen!

Our side, the opposition team opposed the idea of imposing death penalty on Heinous Crimes. Before
anything else, I would like to start my speech by saying that death is irrevocable and I would let the following
statements instill in your minds the real essence of what you call: “the answer to our war against heinous
crimes.”

 Why inflict such inhumane punishment that directly contradicts the constitution? The problem is not
within the punishment imposed but in some parts of our justice system. Having this stated, due to
the obvious imperfections in our system, how could one bring back the life of a dead person who
was wrongly accused of being guilty?
 Moreover, according to debate.org, a link that tackled about the current debate topic: that death
penalty is only a paradox which would only put the legal system in a bad position that would show
that killing is acceptable but only if the State does the killing. Why should the State counter violence
through violence? Additionally, it was also implied that only the rich, powerful and influential would
be in an advantageous position that could hire the best lawyers and get off freely without even a

 However, living a life with fair and humane society and justice system, it would better influence the
people of the State to be against violence.

2nd Speaker Opposition: Refutes data/examples of proposition 2nd speaker, and re-asserts opposition
principle, offering data/examples as support.

As the 2nd speaker of the opposition team, we hereby contradict the following assertions made by the
Proposition team:

 A barbaric and inhumane punishment would never heal the wounds of the victim and even the
victim’s grieving family, acquaintances, or relatives. There is nothing good that would be ripped out
from a vengeful thinking instead of seeking the greater and real meaning of justice.

Furthermore, it was clearly stated by our first speaker that the implementation of death penalty would
contradict our Constitution; I am here to elaborate our legal basis.

First, R. A. 9346: An, act prohibiting the imposition of Death Penalty of the Philippines, (which repealed
death penalty by lethal injection)

Second, Amnesty International holds that the death penalty breaches human rights, in particular the
right to life and the right to live free from torture or cruel, inhuman or degrading treatment or
punishment. Both rights are protected under the Universal Declaration of Human Rights, adopted by
the UN in 1948.
Over time, the international community has adopted several instruments that ban the use of the death
penalty, including the following:

o The Second Optional Protocol to the International Covenant on Civil and Political Rights, aiming
at the abolition of the death penalty.
o Protocol No. 6 to the European Convention on Human Rights, concerning the abolition of the
death penalty, and Protocol No. 13 to the European Convention on Human Rights, concerning
the abolition of the death penalty in all circumstances.
o The Protocol to the American Convention on Human Rights to Abolish the Death Penalty.

Therefore, implementing Death Penalty would oppose and violate the Philippines’ agreement with the
International Laws.
