INQUEST DISPOSITION

Brought to this Office for Inquest is the person of ROSTUM SANTIAGO y PURA for
the crime of Violation of Section 11, Article II of R.A. No. 9165 otherwise known as the
Comprehensive Dangerous Drugs Act of 2002.

Complainants are police officers of Marikina City assigned at PCP 1 of Brgy. San Roque.
They alleged that at around 1:30 a.m. of February 18, 2018, they were on patrol duty along the
stretch of Abad Santos St., Brgy. San Roque. While so patrolling, they saw a male person
walking but as the police officers approached, he started to run away and drop a paper bag. PO1
Culili alighted from the patrol vehicle to check the paper bag and whereupon found inside a
cluster of dried leaves suspected as marijuana, with stems and seeds. PO1 Culili then informed
the other police officers about the contents of the bag. PO1s Lobos and Pati thus chased the man
whom they found at the corner of M.A. Roxas and Abad Santos Sts. They placed him under
arrest and upon questioning, he introduced himself as herein respondent, ROSTUM
SANTIAGO y PURA.

PO1 Culili thereafter marked and inventoried the confiscated items as follows:

a. One (1) piece suspected marijuana dried leaves with stem and fruiting tops marked in
plastic cellophane as “RSP 02/18/18-1 with signature”, and;
b. One (1) piece brown paper bag brown as “RSP 02/18/18-2 with signature.”

To substantiate their claims, complainants submitted the following documents, to wit:

1. Sinumpaang Salaysay of complainants;

2. Request for Laboratory Examination;
3. Physical Science Report No. D-78-18E finding the one (1) transparent plastic
cellophane with markings “RSP 02/18/18-2 with signature”, used to wrap 109.76
grams of dried suspected Marijuana fruiting tops, POSITIVE to the presence of
MARIJUANA.
4. Request for Drug Test on Arrested Suspect
5. Initial Laboratory Report (Physical Science Report No. DT-133-18E” finding the
urine sample taken by from respondent POSITIVE to the presence of THC-
metabolites and Methylamphetamine, both dangerous drugs.
6. Chain of Custody Form;
7. Inventory of Evidence;
8. Case Referral Memorandum to the Chief of SAID, Marikina Police.
9. Photographs of the inventory taking, marking and of the confiscated evidence, and of
the arrested suspect.

During Inquest, respondent was apprised of his rights including his right to be assisted by
counsel. He was referred to PAO-Marikina City and thereafter manifested that he will no longer
avail of a preliminary investigation. He was assisted by Atty. Ladao.

After circumspect evaluation of the evidentiary record, this Office finds probable cause to
indict ROSTUM SANTIAGO y PURA to the crime of violation of Section 11, Article II, R.A.
No. 9165 or the Comprehensive Dangerous Drugs Act of 2002.

All the elements of illegal possession of dangerous drugs as defined and penalized under
the said provision are present in this case. As he ran away, complainants saw respondent drop a
brown paper bag which contained dried leaves with stems and sees/fruiting tops which was
confirmed, though, Physical Science Report No. D-78-18E as MARIJUANA weighing 109.76
grams. Respondent failed to give proof that he is authorized by law to possess the contraband
drugs.

WHEREFORE, premises considered, it is respectfully recommended that an

Information for violation of Section 11, Article II, R.A. No. 9165 or the Comprehensive
Dangerous Drugs Act of 2002 be filed against ROSTUM SANTIAGO y PURA.

Bail Recommneded: Php200,000.00.

The undersigned Assistant City Prosecutor accuses ROSTUM SANTIAGO y PURA of

the crime of Violation of Sec. 11, Article II of Republic Act No. 9165 otherwise known as the
Comprehensive Dangerous Drugs Act of 2002, committed as follows:

That on or about the 18th day of February, 2018 in the City of Marikina, Philippines, and
within the jurisdiction of this Honorable Court, the above-named accused, without being
authorized by law, did then and there willfully, unlawfully, feloniously and knowingly have in his
possession, direct control and custody, dried leaves with stem and fruiting tops wrapped in a
plastic cellophane marked as “RSP 02/18/18-1 with signature”and weighing 109.76 grams,
which after laboratory examination was found to be positive for MARIJUANA, a dangerous
drug, in violation of the above-cited law.

Referring to the case of VIOLATION OF SECTION 11, ARTICLE II of R.A. No. 9165
against respondent ROSTUM SANTIAGO y PURA, which you brought to this Office for
Inquest, please be informed that Inquest Prosecutor LOTIS P. ROSARIO recommended the
filing of an Information for Violation of Section 11, Article II, R.A. No. 9165 or the
Comprehensive Dangerous Drugs Act of 2002 with a recommended bail of Php200,000.00
(TWO HUNDRED THOUSAND PESOS) for his provisional liberty.

Said recommendation was approved by this Office.

In view thereof, said suspect/respondent may now be released from custody upon posting
of the afore-mentioned bail unless held on the other charges or causes.
