Whether or not the appointed Executive Director (ED) and who at the same
time a designated Religious Officer (RO) be entitled to honorarium in his
discharge of his function for the latter? Base on the facts given, I give my analysis of the query as follows: or RM has been designated to the ED in a concurrent capacity. (Copy of Designation Order not secured yet) There is distinction, however, among their respective duties (Comparison of the positions as Annex B). The ED shall act as the administrative head of the RDI while the RM shall exercise general supervision of the same. Under Section 56, Chapter 8 Prohibitions of Executive Order 292, no elective or appointive public officer or employee shall receive additional or double compensation unless specifically authorized by law nor accept without the consent of the President, any present, emolument, office, or title of any kind from any foreign state. It is further bolstered by analogous case of _________, which the following is enlightening: Designation connotes an imposition of additional duties, usually by law, upon a person already in the public service by virtue of an earlier appointment. Designation does not entail payment of additional benefits or grant upon the person so designated the right to claim the salary attached to the position. Without an appointment, a designation does not entitle the officer to receive the salary of the position. The legal basis of an employee's right to claim the salary attached thereto is a duly issued and approved appointment to the position, and not a mere designation. Moreover, the following shall be followed: ● Employee designated should hold permanent appointments to career positions; ● Designees can only be designated to positions within the level they are currently occupying ● Designation shall be made through an office order issued by the Head of Agency or the Head of Office concerned; ● Designees cannot be granted the salaries of the positions they are being designated to, except allowances that go with the performance of the functions such as RATA. Applying the above in the instant situation, the ED is actually and in legal contemplation responsible to fill the vacuum to ensure smooth operation of the RDI. Conclusion: Although it can be gleaned from the above that these two positions have different duties, powers and functions distinct from each other. Designation by the ICM of the Executive Director as Regional Mufti concurrently will not give rise to honorarium. Designation is merely an additional assignment being carried out in the exercise of the present duties.
