Sub: Statutory Notice under Section 138(b)

read with Section 141 & Section 142 of
the Negotiable Instruments Act, 1881.

Mr.Kuldeep Singh resident of 483, opposite AGI

144001, has approached me for issuing appropriate
legal notice to you. I, Shivam Singh, advocate,
practicing at Hon'ble High Court of Punjab &
Haryana, therefore, call upon you to take this legal
notice, which is as under:
1. That my client had supplied 1000 kg zink
powder worth Rs.10 lakh to Zink Punjab Limited
Jalandhar, after having a deal with Directors
Mahesh Kumar and Suresh Kumar, my client
was issued a cheque .

2. That you approached my client personally through

your Directors Mr.Mahesh Kumar and Mr.Suresh
Kumar to purchase 1000Kg of Zink Powder for your
company. Subsequently you have issued purchase
order amounting to Rs.10,00,000-/ for 1000Kg of
Zink Powder.

3. That our client had relied on your promise and as

instructed by you delivered the Zink Powder
weighing 1000Kg at your Jalandhar situated
company at vide Invoice No. A125.

4. That One post dated cheque of Rs.10 lakh

bearing cheque no:556732,dated: 5.3.2019 was
issued by Zink Punjab Limited towards payment
against the invoice to my client and drawn on
Bank of Baroda Jalandhar City main branch.

5. That my client deposited the said cheque in his

account in State Bank of India Jalandhar City
main branch. The said cheque was dishonoured
and his bank had issued “bank memo” dated
9.3.2019 showing reason for dishonor of said
cheque as “Fund Insufficient”.

6. That the company and its directors have

committed fraud due to which my client has
suffered financial loss and he also went through
mental agony .

7. I, therefore, call upon you to pay

Rs.10,00,000/- which is amount stated in the
cheque bearing No.556732 dated 5.3.2019
drawn at Bank of Baroda Jalandhar City main
branch. The said cheque was dishonoured and
his bank had issued “bank memo” dated
9.3.2019 showing reason for dishonor of said
cheque as “Fund Insufficient”. drawn at State
Bank of India Jalandhar City main branch, G.T
Road, Opp-Old Dist Courts, Jalandhar, Punjab
144001, therefore a cheque be issued by you to
my client within fifteen days from the date of

receipt of this notice, failing which you will be
committing an offence under Section 138(b)
read with Section 141 & Section 142 of the
Negotiable Instruments Act, 1881, may please
be noted.

8. That this notice is served to you, well within the

limitation period of 30 days of receiving the
bank memo, and hence satisfies the conditions
of section 138(b).

9. This is without prejudice to all other legal rights and

remedies available to our client for the
above-stated purpose.

10. You are liable to pay a sum of Rs.10000/- as

necessary cost and expenses of sending the
present legal notice to you.

11. Copy of this legal notice is also kept at our office

for further ready reference it required in future.
