Gender Discrimination in Jollibee food court incorporation

I. Introduction

Gender discrimination refers to unfair rights between male and female based on different
gender roles which leads to unequal treatment in life. The term gender inequality has been widely
known in human history but not until the beginning the 20th century has the transformation of
gender relations become “one of the most rapid, profound social changes” (Wright & Rogers
2009). Gender Discrimination in the workplace is a huge problem even in the current modern
world. Gender discrimination occurs when a person is treated in his job on basis of his sex. This
is a serious problem in developed, developing country and least-developed countries Regarding to
the reasons and the origin of gender inequality, it can be seen that Asia would be the place where
gender discrimination has seemed to be a “tradition”. According to the General office for
population family planning, the idea of distinguishing men from women came from the impacts of
Confucianism and the awareness of people about life. Men were thought to have a duty of
continuing the ancestral line. In that society, not having a son meant to be disrespectful towards
the ancestor. Going on with this wrong conception, women are more likely to lose the role in
community (Nguyen n.d.)

This issue has been a topic of debate around the world different countries have made law
regarding gender discrimination in the workplace. And at the same time, the position of men and
women were generally set. The growth of this situation has been obviously seen. According to a
survey in America, female’s salary at work is 75% as low as males. Coming back to last century,
at work, when men were paid 1 dollar, the amount that women received was just 58 cents, in
accordance with the law in 1963 (Tran 2012). And in Vietnam, gender inequality is shown in the
difference between two genders in the number of babies. Statistics of Ministry of Planning &
Investment in 2010 reported that there were 110.6 new-born boys out of 100 new-born girls which
was much higher than in the past. However, as a matter of fact, gender discrimination has made a
big argument in society about whether the equality among genders should be encouraged or not.
Regarding to this problem, American people seem to appreciate the position of women,
meanwhile, the Chinese tend to think of higher power of men in life (Chang n.d.)

II. Counter Argument


A. Summarize the counterclaims

There a lot of issues that against of existing of them like Gender Discrimination and one of
hottest trending issues in our country is Gender Discrimination in Jollibee food court
incorporation. A member of the LGBTQ community alleges that Jollibee Foods Corporation (JFC)
discriminated against their employment because of how they expressed their sexuality. In a
Facebook post, Bunny Cadag, who identifies as gender queer, recounted in chronological order
how they were hired to do transcription work but were asked not to appear at the office. On June
30, the complainant said that they were invited as a transcriber at an evaluation interview of JFC
for three days through Human Capital Development (HCD). On the first day, they and two others
were able to complete the work and were properly compensated for it On July 3, Cadag received
a call from a certain Louie Angsico of HCD claiming that JFC was not willing to accept LGBTQ
members in their office. The reasons cited were that JFC was “not ready” to accept LGBTQ culture
and that the company held Catholic beliefs. Angsico told them that the company was willing to
have Cadag finish the work through a recording. When Cadag asked the identity of the person who
ordered that they could not show up at the office, Angsico ignored queries even via a follow-up
email on July 11. On the same day, the complainant took it upon themselves to pass a complaint-
letter through Jollibee’s official Facebook page and website. On July 14, Cadag, still without a
response from Angsico, called JFC’s customer service. They were attended to by a certain Cherry
who said that the complaint letter has been seen, and requested a few more days for the
investigation. After two weeks without word from either HCD or JFC, Cadag took to the
Commission on Human Rights at NCR and submitted the complaint letter, emails, and texts with
Angsico. The CHR said it is still looking for an investigator. Cadag’s statement also appealed that
they be recognized for the work they do as a person rather than how they express their gender
identity. The statement also pointed out that this experience also represented what a lot of members
of the LGBTQ community also experience in other workplaces. Jollibee has since issued a
statement, where the company “sincerely apologized” to Cadag regarding the “unfortunate
incident.”

B. Providing supporting information for counterclaims

According to one article saying that “The Philippines is ranked as one of the most gay-
friendly nations in Asia.” But the truth is We are not totally accepted LBGT Community in our
country. In 100 million population of Filipino in our country 81% percent are Catholic and we all
know that Catholic is one that against LGBT Community in the Philippines.This just means that
our country is not a gay friendly country like what they always claim. It is really deeply hurting
that a company that represents our country like JFC would have an issue like this. It was also
documented that due to its religious belief, they are not ready yet to this kind of acceptance and
quality. I don’t know if the employers pay for the gender of the employees they hire or whatsoever.
I dream, we dream, that someday, this country would be a country that embodies the real essence
of equality.

C. Refute the Counterclaims

According to Dantilton Rean, “Transgendered people want to be accepted for who they are
yet they weren’t able to accept themselves for who they were?” Many comments in Facebook
saying that theirs is no discrimination of it because Jollibee food court incorporation because they
are held catholic belief and they following the dress code. Some saying in Jollibee they encounter
gay manager and crew and this is the point because they are wearing what is the right wearing
according to their gender. There is no problem of being Gay, Lesbian, or being transgender if we
all know the limits of our behavior and attitude. Every Company have their own enforcing policies
and rules. If we are applying in one company We should know they don’t and do about being
employees.
D. Give evidence for Argument

III. Argument

I’m agree that there is no Discrimination between Jollibee Food Court Inc. because they have
their own freedom to make their own policies for the sake of their company. Every human being
has their own freedom to be what they want but the importance we should know the limits of what
we want. Like JFC Company, they have rules and policies enforcing. I’m not seeing something
wrong about their reason their stated.

Claim No. 1 (Catholic Beliefs)

According to Bishop Oscar Cruz, “Those who commit homosexual acts shall not enter the
kingdom of God”. It is one prove that LGBT Community are not accepted in Catholic.

Claim No. 2 (Not ready in LGBT CULTURE)

Mr. Louie Angsico saying that Jollibee are not ready for this kind of culture.

Claim No. 3 (Strictly policy about Dress code)

According to Mr. Louie Angsico, JFC have their own policy about the dress code of their
employees.

Chapter IV.
Conclusion
Restate Argument:

In general, gender inequality is obviously an urgent problem in the world. Despite the fact that
its volume much decreases, it still exists and makes a lot of people suffer its consequences every
day and there are many reasons leading to gender discrimination which cannot be solved easily.

Plan of Action:

However, with education and progressive thoughts of people, there are also reasons to trust in
the future of gender inequality being stopped. Then, hopefully, people can live in fairness no matter
what gender they are and also, I think there is some room for the Philippines to become more
inclusive whether it is legally or socially in workplaces, families, education and institution. And
that might make LGBT people a better contributor to the economy.
