Nevada Circuit Court of Appeals

The state of Nevada belongs to the Ninth Circuit of the thirteen courts of appeals. The

Ninth Circuit is the largest of the courts with 29 active judges. The chief judge is Sidney Runyan

Thomas, and the circuit justice is Anthony Kennedy. The other districts included in this circuit

are Alaska, Arizona, California broken up into four smaller districts, Hawaii, Idaho, Montana,

Oregon, and Washington broken up into two smaller districts. This larger court can also review

and change the outcomes of courts in the districts of Guam and the Northern Mariana Islands.

Education in Nevada’s Constitution

In the Nevada Constitution Education is the eleventh article. Under the main article is ten

sections.

Section one, legislature to encourage education; appointment, term and duties of

superintendent of public instruction. This legislation is here to make sure that all other legislation

encourages education. It also provides a superintendent of the schools in Nevada and what they

will do. As well as defines how long the superintendent will serve in this position.

Section two, uniform system of common schools. This legislature says there must be a

system for all the public schools in a district to use. These systems should be maintained at least

six months a year. It states that any school that does not adhere to this system may not be funded

by the state. This legislature also covers the security of general attendance of the students.

Section three, pledge of certain property and money, escheated estates and fines collected

under penal laws for educational purposes; apportionment and use of interest. This legislature

pledges that all land and property granted by Congress to the state for educational purposes may

only be used for educational purposes. Any proceeds made by these educational facilities, or by

the sale of the land, may only be used for educational purposes as well. Any interest made on

these may be used for educational purposes during the year. If necessary some may be used by

the state university. If any is left at the end of the year it gets pooled for general educational

purposes.

Section four. establishment of state university; control by board of regents. This

legislature provides for the establishment of a state university. This university should allow for

departments of agriculture, mechanic arts, and mining to be controlled by a board of regents.

Section five, establishment of normal schools and grades of schools; oath of teachers and

professors. This legislature establishes what a public school is, as well as what the grading

system should be for these schools. It also establishes that each teacher should take an oath, those

who fail to do so will not receive any public funding.

Section six, support of university and common schools by direct legislative appropriation;

priority of appropriations. Schools should be provided for by the general fund upon presentation

of budgets. The Legislature will use one or more appropriations to fund the K-12 schools. During

a special session at the end of the normal session, if the legislature has failed to provide the

necessary funds they are required to pay the expenses of that special session. The same goes for

the special session at the end of every two years. Any money gained in a way that violates any of

the previous is void.

Section seven, board of Regents: Election and duties. The Governor, Secretary of State,

and Superintendent of public schools should be elected every four years. A Board of Regents

should qualify each. The Board of Regents will be elected during the regular session before the

end of their term, and their duties will be defined.

Section eight, immediate organization and maintenance of state university. The Board of

Regents will organize and maintain the Mining department in a way that is effective and useful.

Any money made by the different departments shall stay in the departments. If any of the money

is lost or misappropriated the state will refund it.

Section nine, sectarian instruction prohibited in common schools and university. No

individual sect will be taught at a public school or university.

Section ten, no public money to be used for sectarian purposes. Basically, this means that

public funds cannot be used by individual sects, but by the whole.
