THE$QUALIFIEDS$

$
Felony/Crime$ Qualifying$Circumstances$
$ The$ penalty$ of$ reclusion* perpetua* shall$ be$ imposed$ upon$ those$ who$ commit$ any$ of$ the$
$ crimes$of$piracy$under$any$of$the$following$circumstances:$
$ a.$ Whenever$they$have$seized$a$vessel$by$boarding$or$firing$upon$the$same<$
$ b.$ Whenever$ the$ pirates$ have$ abandoned$ their$ victims$ without$ means$ of$ saving$
$ themselves<$or$
Qualified$Piracy$ c.$ Whenever$ the$ crime$ is$ accompanied$ by$ murder,* homicide,* physical* injuries,* or$
rape.$(RPC)$

Or*any*other*crime*committed$as$a$result$or$on$the$occasion$of$the$piracy$(AntiC
Piracy$Act,$P.D.$No.$532)$
$ a.$ Whenever$ he$ has$ fired$ upon$ the$ pilot,$ member$ of$ the$ crew,$ or$ passenger$ of$ the$
$ aircraft<$
Qualified$Hijacking$ b.$ Exploded$or$attempted$to$explode$any$bomb$or$explosive$to$destroy$the$aircraft<$or$$
c.$ Crime$is$accompanied$by*murder,*homicide,*serious*physical*injuries,*or$rape.$
Qualified$Violation$of$ a.$ Committed$in$the$nighttime<$or$
Domicile$ b.$ Any$papers$or$effects$not$constituting$evidence$of$a$crime$not$returned$immediately$
after$search$
Qualified$Interruption$of$ Any$public$officer$or$employee$who$shall$prevent$or$disturb,$ with*violence*or*threats,$the$
Religious$Worship$ ceremonies$or$manifestations$of$any$religion$
Qualified$Direct$Assault$ a.$ When$committed$with$the$use$of$a$weapon<$
b.$ When$the$offender$is$a$public$officer<$or$
c.$ When$the$offender$lays$hands$upon$a$person$in$authority.$
$ If$convict$escapes:$
Qualified$Evasion$of$ a.$ By$means$of$scaling<$
Service$of$Sentence$ b.$ By$breaking$doors,$windows,$gates,$walls,$roofs,$or$floors<$
c.$ By$using$picklocks,$false$keys,$disguise,$deceit,$violence$or$intimidation<$or$
d.$ Through$connivance$with$other$convicts$or$employees$of$the$penal$institution.$
Qualified$Delivery$of$ Any$person$who$removes$a$prisoner$from$jail$or$any$penal$establishment$or$helps$in$the$
Prisoners$from$Jail$ escape$of$such$person$therefrom$by$means$of$violence,*intimidation,*or*bribery.$
$ When$the$trafficked$person$or$victim:$
$ a.$ Is$a$child<$
$ b.$ Is$ recruited$ to$ engage$ in$ prostitution$ with$ any$ member$ of$ the$ military$ or$ law$
$ enforcement$agencies<$
$ c.$ Dies,$becomes$insane,$suffers$mutilation,$or$is$infected$with$HIV/AIDS,$by$reason$
$ or$on$occasion$of$the$act$of$trafficking<$or$
$ d.$ Is$a$victim$of$large$scale$trafficking.$
$ $
Qualified$Trafficking$in$ When$the$offender:$
Persons$ a.$ Adopts$through$InterCCountry$Adoption$for$exploitative$purposes<$
b.$ Is$a$spouse,$an$ascendant,$parent,$sibling,$guardian,$or$a$person$who$has$authority$
over$the$trafficked$person<$
c.$ Is$a$public$officer$or$employee<$
d.$ Is$a$member$of$the$military$or$law$enforcement$agency<$
e.$ Commits$ one$ or$ more$ acts$ of$ trafficking$ in$ persons$ over$ a$ period$ of$ 60$ days$ or$
more,$continuous$or$not<$
f.$ Directs,$ or$ through$ another$ manages$ the$ victim$ in$ carrying$ out$ the$ exploitative$
purpose<$or$
g.$ Is$part$of$a$syndicate.$
$ Any$public$officer$entrusted$with$law$enforcement$who$refrains*from*arresting*or*prosecuting$
Qualified$Bribery$ an$ offender$ who$ has$ committed$ a$ crime$ punishable$ by$ reclusion* perpetua* or* death$ in$
consideration$of$any$offer,$promise,$gift,$or$present,$shall$suffer$the$penalty$for$the$offense$
which$was$not$prosecuted.$
Qualified$Trespass$to$ When$trespass$is$committed$by$means$of$violence*or$intimidation.$
Dwelling$
$ If$coercion$is$committed:$$
Qualified$Grave$ a.$ In$violation$of$the$exercise$of$the$right$of$suffrage<$$
Coercion$ b.$ For$the$purpose$of$compelling$another$to$perform$any$religious$act<$or$
c.$ To$prevent$one$from$exercising$such$right$or$from$so$doing$such$act.$

 $ Theft$whereby:$
$ a.$ Committed$by$a$domestic$servant<$
$ b.$ Committed$with$grave$abuse$of$confidence<$
$ c.$ Property$stolen$is$motor$vehicle,$mail$matter$or$large$cattle$or$consists$of$coconuts$
Qualified$Theft$ taken$from$the$premises$of$the$plantation$or$fish$taken$from$a$fishpond$or$fishery<$
d.$ Property$is$taken$on$the$occasion$of$fire,$earthquake,$typhoon,$volcanic$eruption,$
or$any$other$calamity,$vehicular$accident$or$civil$disturbance.$
Qualified$Carnapping$ When$the$owner,$driver,$or$occupant$of$the$motor$vehicle$is$killed$or$raped$on$occasion$of$
the$carnapping.$
$ Rape$is$committed$when:$
$ a.$ The$victim$is$a$child$below$7$years$of$age<$
$ b.$ The$victim$is$below$18$years$of$age$but$above$7$years$and$the$offender$is$a$parent,$
$ ascendant,$ stepCparent,$ guardian,$ relative$ by$ consanguinity$ or$ affinity$ within$ the$
$ third$civil$degree,$or$the$commonClaw$spouse$of$the$parent$of$the$victim<$
$ c.$ The$ victim$ is$ under$ the$ custody$ of$ the$ police$ or$ military$ authorities$ or$ any$ law$
$ enforcement$or$penal$institution<$$
$ d.$ The$rape$is$committed$in$full$view$of$the$spouse,$parent,$any$of$the$children$or$other$
$ relatives$within$the$third$civil$degree$of$consanguinity$of$the$victim<$
$ e.$ The$victim$is$a$religious$engaged$in$legitimate$religious$vocation$or$calling$and$is$
Qualified$Rape$through$ personally$known$to$be$such$by$the$offender$before$at$the$time$of$the$commission$
sexual$intercourse$or$ of$the$crime<$
sexual$assault$ f.$ The$ offender$ knows$ that$ he$ is$ afflicted$ with$ HIV/AIDS$ or$ any$ other$ sexually$
transmissible$disease$and$the$virus$or$disease$is$transmitted$to$the$victim<$
g.$ Committed$by$any$member$of$the$AFP$or$paramilitary$units$thereof$or$the$PNP$or$
any$law$enforcement$agency$or$penal$institution,$when$the$offender$took$advantage$
of$his$position$to$facilitate$the$commission$of$the$crime<$
h.$ The$ offender$ knew$ of$ the$ pregnancy$ of$ the$ offended$ party$ at$ the$ time$ of$ the$
commission$of$the$crime<$
i.$ The$ offender$ knew$ of$ the$ mental$ disability,$ emotional$ disorder,$ and/or$ physical$
handicap$of$the$offended$party$at$the$time$of$the$commission$of$the$crime<$
j.$ When$by$reason$or$on$the$occasion$of$the$rape,$the$victim$has$suffered$permanent$
physical$mutilation$or$disability<$or$
k.$ When$by$reason$or$on$the$occasion$of$the$rape,$the$victim$has$become$insane<$or$
l.$ Whenever$the$rape$is$committed$with$the$use$of$a$deadly$weapon$or$by$two$or$more$
persons.$
$ Seduction$of$a$virgin$over$twelve$years$of$age$and$under$18$years$of$age,$committed$by:$
$ a.$ Any$person$in$public$authority<$
$ b.$ Priest<$
$ c.$ HomeCservant<$
$ d.$ Domestic<$
Qualified$Seduction$ e.$ Teacher<$or$
f.$ Any$person,$who$in$any$capacity,$shall$be$entrusted$with$the$education$or$custody$
of$the$woman$seduced$
$
Seduction$of$a$sister$or$a$descendant,$whether$or$not$she$be$a$virgin$or$over$18$years$of$
age.$
